Prize distribution: The prize draws will all be held at 53 Henderson Road, Yarra Glen, Vic 3775 as follows:
(i) Major Prize draw at 3.05pm on 3/5/12;
(ii) Jay Jays Prize Draw at 3pm on 3/5/12;
(iii) Daily Draws at 3pm on day each from 6/3/12 to 30/4/12 inclusive that is not a Saturday, Sunday or Public Holiday in Victoria. (One TRANSFORMER Prize Pack will be awarded in each Daily Draw.)
CONDITIONS
PARTICIPATION
1. This competition ("Competition") is conducted by Hasbro Australia Limited, ABN 69 004 348 565, of Level 2, 37-41 Oxford Street, Epping NSW 2121 ("Promoter").
2. Entry to the Competition constitutes acceptance of these conditions.
3. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 18 years, or older, as at the time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
4. Competition entry opens at 00:00 hrs on 5/3/12 and closes at 24:00 hrs on 29/4/12 ("Entry Period"). All and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. Where times are stated using the 24 hour clock, 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.
ENTRY
5. To enter, an Eligible Entrant must first, during the Entry Period, purchase from an Australian retail outlet, one TRANSFORMERS branded toy product that has been sold or licensed for sale by the Promoter ("TRANSFORMERS Product"). For the purposes of the Competition, a pack that is branded TRANSFORMERS and contains multiple items is considered to be one TRANSFORMERS Product.
6. Subject to these conditions, there is no limit to the number of entries that an Eligible Entrant may submit into the Competition. Each entry requires the purchase of a separate TRANSFORMERS Product.
7. Entry can only be made by internet. To submit an entry, an entrant must use a compatible browser to visit
www.transformers.com.au ("Competition Website") and follow the directions there. For each entry, the entrant must provide: (a) the last 6 digits of the barcode of the TRANSFORMERS Product being used to enter; (b) the name of the store from which the TRANSFORMERS Product was purchased; (c) the date of that purchase; and (d) all other details required at the Competition Website, including first and last names, residential address, postal address, email address and contact telephone number.
8. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.
9. For each and every TRANSFORMERS Product an entrant uses to submit an entry, he/she MUST retain the original receipt from the purchase of the TRANSFORMERS Product that: (a) is issued by the store from which the TRANSFORMERS Product was purchased; and (b) identifies the TRANSFORMERS Product as an item purchased.
10. All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.
(i) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 9 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
(ii) An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
11. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 10 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these conditions.
12. An entry by more than one person (ie a joint entry) is invalid.
SUBMISSION OF ENTRIES
13. Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
14. Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
MAJOR PRIZE DRAW
15. The Major Prize Draw, from all entries received during the Entry Period (including those entries based upon a TRANSFORMERS Product purchase from a Jay Jays store), will be held at 3.05pm on 3/5/12 at 53 Henderson Road, Yarra Glen, Vic 3775.
16. The Eligible Entrant who submitted the first valid entry drawn in the Major Prize Draw will win a trip for 4 people to Universal Studios in Los Angeles, USA (the "Major Prize"), valued at a maximum of $14,678 (further details of the Major Prize are set out below).
JAY JAYS PRIZE DRAW
17. The Jay Jays Prize Draw, from all entries received during the Entry Period that indicated that the TRANSFORMERS Product upon which the entry was based was purchased from a Jay Jays store, will be held at 3pm on 3/5/12 at 53 Henderson Road, Yarra Glen, Vic 3775.
18. The Eligible Entrant who submitted the first valid entry drawn in the Jay Jays Draw will win a trip for 2 people to Universal Studios in Los Angeles, USA (the "Jay Jays Prize"), valued at a maximum of $6,638 (further details of the Jay Jays Prize are set out below). An Eligible Entrant who purchased a TRANSFORMERS Product from a Jay Jays store may, with the same entry, win both the Jay Jays Prize and the Major Prize.
DAILY DRAWS
19. There will be 56 daily draws (each a "Daily Draw"), one for each day during the Entry Period (each a "Day").
20. Each entry received during a Day will be allocated to the draw for the Day during which it was received by the Promoter. An entry received exactly on the start of a Day will be allocated to the Day that is just commencing.
21. In each Daily Draw, the Eligible Entrant who submitted the first valid entry drawn will win one TRANSFORMERS Prize Pack, valued at $516.74 (further details of the TRANSFORMERS Prize Pack are set out below).
22. Entries into one Daily Draw that do not win a prize will be included in any subsequent Daily Draw. If there are no entries that may be included in a Daily Draw, the prize that would have been awarded in that Daily Draw will be awarded in the next Daily Draw.
23. Each Daily Draw will be held at 3pm at 53 Henderson Road, Yarra Glen, Vic 3775 The Daily Draw for each Day will be held on the next day that is not a Saturday, Sunday or VIC public holiday. Accordingly, the first Daily Draw will be held on 6/3/12 and the last on 30/4/12.
MAJOR PRIZE DETAILS
24. The Major Prize comprises, for its winner and, subject to condition 26, each of three guests of his/her choice:
(i) return economy flights to Los Angeles , California, USA from the Australian State or Territory capital city nearest to the winner's place of residence and return private car ground transfers between Los Angeles airport and the Accommodation;
(ii) 5 nights twin or quad share accommodation at the Renaissance Hollywood hotel & Spa ("Accommodation");
(iii) VIP tickets to Universal Studios;
(iv) Cirque du Soleil tickets; and
(v) a Starline Tour.
25. The Major Prize will be arranged by the Promoter. The winner of the Major Prize must give at least 30 days notice of proposed commencement of travel. All travel must be completed no later than 29/4/13, and no travel or accommodation may be undertaken/taken: (i) during Australian public school holidays; (ii) between 3 and 6 July 2012 inclusive; (iii) on 24 November 2012 (US Thanksgiving); or (iv) between 23 December 2012 and 2 January 2013 inclusive. The Major Prize is subject to availability at the time of booking and, if any component of the Major Prize is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative, dates on which the Major Prize will be booked.
26. All aspects of the Major Prize (including travel and accommodation) are for the winner and three guests travelling and staying together. The winner of the Major Prize is free to select any person as a guest, provided that the Promoter may require the guests to confirm in writing that they agree to comply with the provisions of these conditions relating to guests (see condition 49).
27. Once tickets have been arranged by the Promoter, changes to the travel or accommodation arrangements cannot be made.
28. All components of the Major Prize must be taken together as a single trip to be booked by the Promoter. Any part of the Major Prize that is not taken for any reason is forfeited.
29. The Major Prize does not (except as expressly stated) include:
(i) any transport between a traveller's residence and the departure airport;
(ii) any overnight accommodation while travelling to the departure airport or destination;
(iii) any other travel or accommodation;
(iv) any meals;
(v) any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages);
(vi) any spending money;
(vii) any insurance (such as travel or health cover);
(viii) any excess baggage charges;
(ix) any costs associated with any passport, visa, health or other requirements for entry into any foreign country and return to Australia.(Departure taxes and other flight related taxes are included in the Prize);
(x) any vaccinations or other medical or health related services;
(xi) any other ancillary costs which may be incurred by the winner or his/her guests in relation to the Prize.
30. The Major Prize cannot be exchanged for other travel or accommodation at other destinations.
31. The winner of the Major Prize and his/her guests are responsible for compliance with any health, passport, visa and other requirements for entry into USA, any country en-route and return to Australia and bear all risks associated with any refusal of entry into any country. No compensation will be payable if the winner or a guest is unable to use the Major Prize (or any part of it) as stated for whatever reason.
JAY JAYS PRIZE DETAILS
32. The Jay Jays Prize comprises, for its winner and, subject to condition 34, one guest of his/her choice:

TRANSFORMERS PRIZE PACK DETAILS
40. Each TRANSFORMERS Prize Pack comprises one of each of:
(i) a TRANSFORMERS toy pack comprising:
(a) 1 x Robopower Robofighter figure, 2 x Mectech Deluxe Figures, 1 x Mechtech Voyager & 1 x Mechtech Leader;
(b) a TRANSFORMERS Dark of The Moon PS3 video game;
(c) a TRANSFORMERS book tin;
(d) a TRANSFORMERS back pack and five TRANSFORMERS books of the Promoter's choosing; and
(e) a TRANSFORMERS Dark of the Moon DVD.
PRIZES GENERALLY
41. The prizes are valued as at 17/1/12. The maximum total value of all prizes is $50,253.44. The Promoter takes no responsibility for any variations in value of a prize.
42. If a prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.
43. A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment.
44. Unless expressly stated in these conditions, all expenses incurred in relation to enjoyment of a prize are the responsibility of the winner.
WINNERS
45. The prize winners, whenever determined, will be notified by email. The notification will include instructions as to how the winner is to claim their prize and establish his/her entitlement to it.
46. The names of the winners will be published in The Australian.
47. The winners of:(i) the Daily Draws held before 1/4/12, will be published on 6/4/12; (ii) the Daily Draws held from 1/4/12 to 20/4/12, will be published on 27/4/12; and (iii) all other draws, will be published on 10/5/12.
48. Subject, where relevant, to any directions given under the legislation regulating the Competition, if a prize is not claimed by a winner within 3 months of the draw for that prize, the prize will be awarded to another Eligible Entrant in a redraw commencing at 3pm on 17/8/12 at 53 Henderson Road, Yarra Glen, Vic 3775. If there is a redraw, the names of any winners in the redraw will be published in The Australian on 31/8/12.
49. In order to be entitled to any prize, the winner (and each person accompanying the winner on the Major Prize / Jay Jays Prize trip) must, if requested by the Promoter, agree to and sign and return:
(i) an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and
(ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.
If any guest on the Major Prize or Jay Jays Prize trip is under 18 years of age, the winner must ensure that a parent or guardian of that guest agrees to and signs the documents referred to above (if requested by the Promoter). A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize are signed and returned in accordance with this condition, as and when required by the Promoter.
GENERAL
50. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
51. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
52. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
53. All of the Promoter's decisions are final and no correspondence will be entered into.
54. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
55. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant or the winner's guest on the Prize trip in connection with the Competition or Prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant's rights under the Competition and Consumer Act 2010.
56. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
57. Each winner and every guest on the Major Prize and Jay Jays Prize trips consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
58. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s) and, if an entrant consents, may be used to market its products to the entrant. The personal information of the winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
