Terms and Conditions

“BE CURIOUS” SUMMER 2012 PROMOTION TERMS AND CONDITIONS

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. Promotion commences on 2 March 2012 and entries at close 11.59pm AEDST on 13 April 2012 (“Promotional Period”).

4. To enter, individuals must visit www.BeCuriousinBC.com, follow the prompts to the promotion entry page to:

a. input the requested details including but not limited to their full name, valid email address, State/Territory and post code of residence;

b. provide an answer to the following question: “Why are you curious to visit British Columbia?” in twenty-five (25) words or less;

c. indicate the following:

• that they have read and agree to these Terms and Conditions;

• whether or not they would like to receive Tourism BC eNewsletters;

• whether or not they would like to receive information on British Columbia travel offers from Adventure World; and

d. submit the fully completed entry form during the Promotional Period.

5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

6. Incomplete or indecipherable entries will be deemed invalid.

7. Only one (1) entry permitted per person.

8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

9. The winner will be notified by email. 

10. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.

11. Should the winner not make contact with the Promoter by return email within 7 days, the first valid runner up will be awarded the prize.

12. This is a game of skill and chance plays no part in determining the winner.

13. Each entry will be individually judged based on creative merit and originality of the answer provided to the promotional question.

14. The Promoter’s decision is final and no correspondence will be entered into.

15. The best valid entry, as determined by the Promoter’s panel of judges, will win a trip for four (4) people to Vancouver, Canada, valued at up to AU$15,500 depending on the date and point of departure, which includes the following:

• Return economy airfares for four (4) people from Sydney to Vancouver with Air New Zealand;

• All airport charges, air taxes and fuel charges;

• Five (5) nights twin share accommodation for four (4) people – 2 nights Vancouver, 2 nights Whistler, 1 night Victoria (valued at up to $1,300, subject to availability;

• Guided Edible Canada 2 hour tour for four (4) people of the Granville Island Public Market in Vancouver, including tote bags;

• Panorama Flightseeing tour for four (4) people from Victoria;

• Bear Awareness Walk for four (4) people with Whistler Eco Tours (tour does not run on Mondays, Wednesdays or Sundays);

• Peak2Peak Alpine Adventure for four (4) people in Whistler;

• Transfers by coach and ferry between the hotels in Vancouver, Victoria and Whistler.



16. Transport to and from Sydney airport and transfers to the Vancouver hotel from Vancouver International airport are not included as part of this prize and are the responsibility of the winner..[NB: PLEASE ENSURE THAT IT IS MADE CLEAR ON ADVERTISING MATERIAL THAT TRAVEL TO SYDNEY IS THE RESPONSIBILITY OF THE WINNER]

17. The winner and his/her companions are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.

18. Prize cannot be taken during school holidays, public holidays periods or other peak periods in Australia and Canada.

19. Travel must be taken between 1 July 2012 and 10 October 2012. The trip must be booked via Adventure World and is subject to availability at the time of booking. The winner must provide Adventure World with a minimum of 21 days advance notice of intention to travel. The prize cannot be transferred to another person, nor upgraded, nor exchanged or sold for cash or used with any other promotions. The prize is non-commissionable and cannot be extended past 31 October 2012. Failure to complete the prize by this date will amount to forfeiture of the prize by the winner.

20. All components of the prize must be pre-arranged prior to the winner (and his/her companions) taking the prize and must be taken together on the same trip.

21. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.

22. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the winner. Please refer to Adventure World Booking Conditions at www.adventureworld.com.au.

23. The winner and their guests will be subject to, and must abide by the terms and conditions of Adventure World and of third parties, including but not limited to the airline and hotels. Any breaches of such terms and conditions may affect the ability to receive benefits of the prize. In that case, such benefits will be forfeited.

24. Spending money, excess baggage charges, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point (being Sydney only), transfers (unless otherwise advised), items of a personal nature, in-room charges and all other ancillary costs are not included.

25. The winner and his/her companions must depart from and return to the same departure point and travel together.

26. Frequent flyer points will not form part of the prize.

27. Winner may be required to present credit card at time of accommodation check in.

28. Itinerary for the prize to be determined by the Promoter in its absolute discretion.

29. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

30. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

31. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

32. In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same value as the original prize or to cancel, terminate, modify or suspend the promotion.

33. Total prize pool value is up to AU$15,500.[INSERT]. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.

34. Prize values are based on the recommended retail prices at the time of printing and may vary depending on the exchange rate at the time of redemption. The Promoter accepts no responsibility for changes in prize value between now and the ultimate prize redemption date.

35. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

36. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

37. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

38. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

39. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

40. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize

41. As a condition of accepting the prize, the winner and his/her companions must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

42. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. If the entrant opts in upon entry, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All information will remain confidential and will not be sold or disclosed to undisclosed third parties.
