TERMS AND CONDITIONS
1.Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to NSW, ACT, VIC and QLD residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
3.Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4.Promotion commences on 16/4/12 and entries close at 11:59pm AEST on 3/6/12 (Promotional Period).

5.To enter, individuals must, during the Promotional Period: a.visit
www.sportsslurpee.com.au (Website) and login with their Facebook account details;
b.click to “Allow” the Slurpee Application to access their basic contact information;
c.click the link to play the ‘rock-paper-scissors’ game (Game), choose an available opponent, and elect to be Rock, Paper or Scissors. Opponents will also select whether they will be Rock, Paper or Scissors. Full details on Game rules will be available on the Website; and
d.Games will be won and lost according to the following: i.Rock beats Scissors;
ii.Paper beats Rock;
iii.Scissors beats Paper; and
iv.any two (2) of the same will result in a draw.
6.The Promoter reserves the right, at any time, to verify the validity of Games, entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry or Game process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7.The Promoter reserves the right, at any time, to invalidate any entries or Games which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries or Games that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to Facebook accounts.
8.Incomplete, indecipherable or illegible entries or Games will be deemed invalid.
9.Multiple entries permitted, subject to the following: (a) each entry must be submitted separately and in accordance with entry and Game requirements.
10.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

11.Entrants will be notified instantly on the Website if they have won or lost a Game. Winners of a Game will be notified instantly on the Website if they have won an instant prize. Only winners of Games will be eligible to win an instant prize. Winners of Games will have a one (1) in six (6) chance of winning an instant win prize. Maximum one (1) instant win prize per winning entrant per day.

13.Instant win prize vouchers must be redeemed from a participating 7-Eleven store in NSW, ACT, VIC and QLD. Vouchers will be sent to successful entrants' email addresses and (if requested at the time of completing a prize claim form) to their mobile phone numbers via MMS.
14.Vouchers expire at 11:59 AEST on 15/6/12. Any ancillary costs associated with redeeming a voucher are not included. Any unused balance of a voucher will not be awarded as cash. Redemption of a voucher is subject to any terms and conditions of the issuer including those specified on the voucher.

Slurpee VIP Card of a year’s free Slurpees. A year’s free supply equates to 365 free medium Slurpees. Slurpees are redeemable at participating 7-Eleven stores. A maximum of five (5) medium Sluprees can be redeemed per day. The voucher will be valid for 365 days from the date of first Slurpee redemption or until 365 medium Slurpees have been redeemed (whichever is first to occur). (Major Prize)

16.Winners will be notified in writing. The winner of Major Prize will be published in The Australian on 8/6/12. The Promoter’s decision is final and no correspondence will be entered into.
17.In the event of a tie to determine a weekly prize winner, the tied entrants will be required to submit an answer to the promotional question “In 25 word or less, what is your favourite Slurpee flavour and why”. The tie-breaker element is a game of skill and chance plays no part in determining a winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question. Full details on the tie-breaker will be provided to tied entrants.
18.Prizes are subject to the standard terms and conditions of individual prize and service providers.
19.If a winner of a weekly prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
20.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21.Total prize pool value is up to $274,494. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
22.A draw for any unclaimed weekly prizes may take place on 18/6/12 at Rodeo Offices, Level 1, 102 York Street, South Melbourne at 12:00pm AEST, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing and any Major Prize winner’s name will be published in The Australian on 22/6/12.
23.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25.Any cost associated with accessing the promotional Website is the entrant’s responsibility and is dependent on the Internet service provider used.
26.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter or play Games repeatedly is prohibited and will render all entries/Games submitted by that entrant invalid.
27.Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. There will be a maximum of 85,000 instant win game notifications for this promotion.
28.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
29.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
30.As a condition of accepting a weekly prize, a winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
31.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
32.Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at

33.This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions.
