Walt Disney Australia Muppet Mania Twitter Competition
TERMS AND CONDITIONS OF ENTRY
 
1. Information on how to enter forms part of these conditions. Entry into the Muppet Mania Twitter Competition (“Competition”) constitutes acceptance of these terms and conditions.
 
2. The promoter of this Competition (“Promoter”) is The Walt Disney Company (Australia) Pty Limited (ABN 30 054 610 025), located at Level 5 The Como Centre, 650 Chapel Street, South Yarra VIC 3141, (03) 9832 6155.
 
3. The Competition commences Wednesday, 16th May at 12:00pm Australian Eastern Standard Time (AEST) and closes Wednesday, 30th May 2012 at 10:00am (AEST) (“Competition Period”).
 
4.  Competition will comprise ten (10) separate challenges set by the Promoter during the Competition Period, each consisting of a specific question which entrants must answer as set out in clause 8 (each a “Challenge”).
 
5. The Promoter will issue each Challenge during the Competition Period by posting a Tweet setting out the Challenge question, following which, entries will be accepted during the following times:
 

 
 
6. Each Challenge will be a question set by the Promoter which entrants must answer as set out in clause 8.
 
7. Entry is only open to Australian citizens aged 18 and over. Employees of the Promoter (and their immediate families), or agencies or companies associated with the provision of this Competition, are ineligible to enter.
 
8. To enter, you must:
 
 i. have a registered Twitter account and follow the @DisneyStudiosAU Twitter  handle; and
 
ii. during the relevant Challenge period (as set out in clause 5 above), tweet a message in response to the then current Challenge that includes the following elements:
 
a. a creative and innovative answer in response to the then current Challenge using 140 characters or less; and
 
b. include the hashtag #muppetmania.

 
Once the entry period for a Challenge has closed as set out in clause 5, no further entries will be accepted for that Challenge and you must wait for the next Challenge to open before entering.
 
9. There will be five (5)  winners selected for each Challenge, each judged on their creativity and innovativeness of their respective tweet responses to the Challenge (each a “Winner”). There will be fifty (50) Winners selected in total during the Competition..
 
10. Each Winner will receive:
1 x The Muppets DVD valued at a maximum of $AUD39.95.
The total prize pool for this Competition is valued at $AUD1,997.50.
11. In the instance that no entries are received for a Challenge, the Promoter reserves the right not to issue a prize for that Challenge. 
Winners will be selected in accordance with clause 16.  All Winners will be notified within 1-2 business days from the close of each Challenge entry period, via a direct message from @DisneyStudiosAU on Twitter.
12. Participation in this Competition is deemed acceptance of these Terms and Conditions. Entries are deemed to be received at the time of posting on Twitter.com. 
 
13. There is no limit to the number of times a person can enter, provided each response to the same Challenge is different. However, each person must use a single Twitter account to enter the Competition. Any individual found to have used multiple accounts will be ineligible.
 
14. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries by that entrant invalid.
 
15. Incomplete or indecipherable entries will be deemed invalid.
 
16. Entries will be judged on both creativity and innovativeness  in 140 characters. Entries for each Challenge must include the hashtag #muppetmania.
 
17. All valid entries posted on Twitter during the Competition Period will be judged by Mango Communications (on behalf of the Promoter) at 7 Electric Street, Richmond, VIC 3121 (03 9254 3599) immediately following the Closing Date & Time of the Challenge as outlined in clause 5 above.
Winners will be notified within 1-2 business days from the Closing Date & Time of each Challenge, via a Direct Message from @DisneyStudiosAU on Twitter. Prizes will be sent via Express Post as soon as possible after Winners provide their preferred postal address via direct message.
When contacted via Direct Message from @DisneyStudiosAU, each Winner will be required to further confirm their agreement to these Terms and Conditions by response. Prizes will be issued to Winners in accordance with receipt of this agreement.
The Judges’ decisions are final and no correspondence will be entered into.
18. This is a game of skill and chance plays no part in determining the Winners.
 
19. Prizes are not transferrable or exchangeable and cannot be taken as cash. If a prize is unavailable, for any reason, the Promoter reserves the right to substitute the prize to the equal value and / or specification.
 
20. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 
 
21. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as the Promoter considers appropriate.
 
22. The winner agrees to participate in any news and media/PR activities surrounding the Promotion. The Winner authorises the Promoter to use the winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.  The Winner agrees to sign such other documentation as the Promoter may require to confirm these rights.
 
23. The Competition and Consumer Act 2010 (Cth) as well as other laws in Australia may imply certain conditions, warranties and undertakings, and give you other legal rights.  If they apply, these cannot be modified or excluded by any contract.  You may consider seeking legal advice as to whether they apply to you.
 
24. Nothing in these Terms and Conditions generally affects the entrant’s rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law.  Other than these consumer guarantees and subject to clause 23, the Promoter makes no warranties about any prizes offered as part of the Competition, including warranties as to the quality, merchantability or fitness for purpose of such prizes.
 
25. Subject to clauses 23 and 24, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
 
26. All claims and entries become the property of the Promoter. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, announce the winners and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.

Thanks JRN for the post! I was one of the challenge winners but am having real problems trying to DM them back with my address details!  Twitter says they have to follow me for me to DM them back!  Arggghhh they haven't responded to my tweets to do this!  Did anyone else have any problems DMing your details?

Thanks JRN for the post! I was one of the challenge winners but am having real problems trying to DM them back with my address details!  Twitter says they have to follow me for me to DM them back!  Arggghhh they haven't responded to my tweets to do this!  Did anyone else have any problems DMing your details?

I think they were already following me when I won.  I should tweet them once daily asking them to follow you
