Terms and Conditions By entering the RACO “taste for life” Consumer Promotion Game of Skill Competition (the “Competition”), you are agreeing to the following terms and conditions: 1. STANDARD TERMS 1.1. Information on how to enter forms part of the terms of entry. 1.2. The Promoter is Meyer Cookware Australia Pty Ltd, 1-19 Merrindale Drive, Croydon South VIC 3136, ABN 28 073 818 069 Tel: 03 9761 5655 (“Promoter”) 2. WHO CAN ENTER? 2.1. Subject to clause 2.2, entry is open to all residents of Australia, who are 18 years of age or over. 2.2. Employees, their immediate families and agents of Meyer Cookware Australia Pty. Ltd are not eligible to enter. 3. HOW TO ENTER 3.1. The Competition commences on Monday 14th May 2012 at 09:30 AEST and concludes on Sunday 24th June 2012 at 23:59 AEDT (“Competition Period”). 3.2. To enter, entrants must register their entry as follows: a) Logon to
www.everydaygourmet.tv , or
www.raco.com.au, follow the prompts, and complete the entry fields required. b) The Entrant must leave their full name, address (including postcode), email address and daytime telephone number (including STD area code) 3.3. All entrants in the Competition may enter only once. Any multiples will be discarded. 3.4. All entries must be received by 23:59 AEDT on Sunday 3rd June 2012. 3.5. Entry details remain the property of the Promoter and Sponsor and will not be returned to the entrant. 3.6. The time of entry will in each case be the time indicated in the entry as received by the RACO® Cookware website address. 3.7. Entry into the Competition is free with the exception of any costs the entrant may incur for access to an internet provider, or server, is the responsibility of the entrant. 3.8. Personal details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant. The Promoter reserves the right to validate and check the authenticity of any entry and to disqualify any entrant who is found to have tampered with the entry process or submitted an entry that is not in accordance with these Conditions of Entry. Any incomplete or illegible entries will be considered invalid. 4. PRIZES 4.1. There will be a total of five (5) prize winners. This will consist of four (4) runner up prizes and one (1) major prize winner. The prize winners will receive the prize package, as set out in clause 4.2 below. 4.2. Combined Prize Value is: AUD $1265.90 (including GST). Prize value is correct as of 10/04/12. The Promoter accepts no responsibility for any change in prize value and the winner will not be entitled to any cash or substitute prize should any discrepancy in price occur between the date of printing these terms and conditions and the date of accepting the prize. 4.4. The winning Entrants should seek independent financial advice about any tax implications that may arise from the prize winnings. 4.5. Any additional expenses not outlined in these terms and conditions will be the responsibility of the winner. 4.6. The prize is non-transferable, non-refundable, and may not be redeemed for cash. 4.7. The Promoters accept no responsibility for any variation in the prize value. Where a prize is unavailable for any reason, the Promoters may substitute for that prize another item of equal or higher value as determined by the Promoters, subject to the approval of the gaming authorities in each state and territory, where required. 4.8. Subject to state government legislation the Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing. 5. HOW TO WIN 5.1. For the Major prize, there will be One (1) winner. For the runner up prizes there will be four (4) winners. Each entrant who has entered the Competition within the opening and closing dates and complied with all entry requirements will be entered into the pool of entries. Competition entries that do not contain the information required by clause 3.2 and 3.3, or that do not otherwise comply with these terms and conditions, may be deemed to be invalid at the Promoter’s absolute discretion. 5.2. The first valid entry drawn will win the major prize. The next four (4) valid entries drawn will win the runner up prizes. The entries will be drawn by the RACO Brand Manager at Meyer Cookware Australia Pty Ltd. 5.3. The judging for all prizes will take place at Meyer Cookware Australia Pty Ltd, 1-19 Merrindale Drive Croydon South VIC 3136 from 09:30 AEST on Monday 4th June, 2012 from 9.30am. 5.4. The winners will be notified by phone call or email within two (2) days of the draw and a letter advising the winners of their prize and delivery timeframe will also be sent. Winner of the major prize will have their name published in The Australian newspaper. 5.5. The Promoter may in its absolute discretion deem entries invalid subsequently to a Winner being notified or a Winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw will be conducted. 5.6. The promoter’s decision is final and the promoter will not enter into correspondence regarding the result. 5.7. It is a condition of accepting the prize that the winner (and any companions) must comply with all conditions of use of the prize and also the prize supplier’s requirements. 5.8. All entrants are providing consent to subscribe to the Promoter's electronic updates and periodically receive promotional materials by email and/or post from the Promoter. Entrants can unsubscribe from receiving correspondence from the Promoter via the unsubscribe link at the bottom of all electronic updates. 5.9. Subject to relevant legislation, if any winner is not contactable an unclaimed prize draw will take place at Meyer Cookware Australia Pty Ltd, 1-19 Merrindale Drive Croydon South VIC 3136 from 09:30 AEDT on 3rd September 2012. The winner of any redraw will be notified by email and mail. The original winner will forfeit the prize and have no further claim as of this date. 6. NO LIABILITY 6.1. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter and Sponsor in its absolute discretion. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion, to modify the terms of the promotion including the prizes and these Conditions of Entry, subject to the approval of all relevant State and Territory Lottery Departments. 6.2. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions. 6.3. Meyer Cookware Australia Pty Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 6.4. Meyer Cookware Australia Pty Ltd. and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the judging; b) as a consequence of late, lost or misdirected mail; c) due to the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person. d) in relation to failure of an entry message to be received by the Promoter on account of technical problems or traffic congestion; or e) arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion.Permit numbers NSW LTPS1203374 ACT TP12/01674
