CONDITIONS OF ENTRY
1.Information on how to enter and the prizes form part of these Conditions of Entry. Entry into this promotion is deemed to be acceptance of these Conditions of Entry.
2.Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter, its associated companies, advertising agencies and participating Woolworths/Safeway stores are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.The Promoter reserves the right at any time to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who the Promoter believes, acting reasonably, either has tampered with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs) or has submitted an entry which is not in accordance with these Conditions of Entry or acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4.Incomplete, indecipherable or illegible entries will be deemed invalid.
5.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
6.Promotion commences on 23/05/2012 and ends for purchases at close of business on 03/07/2012 ("Promotional Period"). Entries for the second chance draw for any unclaimed prizes and all claims for instant win prizes must be received by 11:59pm AEST on 03/07/2012.
7.To be eligible to enter, a participant must, during the Promotional Period, purchase any two (2) packets of Participating Arnott's Chocolate Biscuit Products in a single transaction (see clause 10 below for list of products) from a participating Woolworths or
Safeway supermarket nationally.
8.To enter, a participant must then either:
1.Visit
www.arnotts.com.au/promotions, follow the prompts to the promotional page, fully complete the online entry form providing all of the requested information including the last five (5) digits from the barcode of each of the two (2) Participating Arnott's Chocolate Biscuit Products purchased and the full Woolworths/Safeway receipt number for the eligible purchase, and submit the completed online entry form so that it is received by 11:59pm AEST on 03/07/2012. Each entrant will be notified instantly online whether or not they are an instant winner; OR
2.Send an SMS to 1999 5005 containing the last five (5) digits from the barcode of each of the two (2) Participating Arnott's Chocolate Biscuit Products purchased, their full name, postcode and the full Woolworths/Safeway receipt number for the eligible purchase (in that order, with a space between each item and no commas) so that it is received by 11.59pm AEST on 03/07/2012. Each entrant will be notified instantly by return SMS whether or not they are an instant winner.
Premium SMS cost is 55c. Entrants must have premium service access. SMS provider is Prime Focus. SMS helpline: 1800 818 957. All valid entries received from winners and non-winners of an instant prize will be automatically placed in the second chance draw for any unclaimed prizes.
9.Entrants will be required to retain their original Woolworths or Safeway receipt(s) as proof of purchase. Failure to provide this to the Promoter upon request will, at the Promoter's discretion, result in an invalid entry (and, at the Promoter's discretion, in all of the entrant's entries being invalid). Purchase receipt(s) must clearly specify Woolworths/Safeway as the store of purchase and that the purchase was made during the promotional period but prior to entry.
10.Participating Arnott's Chocolate Biscuit Products include all Arnott's: Chocolate Tim Tam, Chocolate Tim Tam Chewy Caramel, Chocolate Tim Tam Classic Dark, Chocolate Tim Tam Dark Mint, Chocolate Tim Tam Dark Rum and Raisin, Chocolate Tim Tam Double Coat, Chocolate Tim Tam White, Chocolate Tim Tam Crush Honeycomb, Chocolate Tim Tam Indulgence Pack, Chocolate Butternut Snap, Chocolate Scotch Finger, Milk Chocolate Wheaten, Dark Chocolate Wheaten, Chocolate Gaiety, Chocolate Monte, Chocolate Teddy Bear, Chocolate Tee Vee Snacks Malt Sticks, Chocolate Tee Vee Snacks Original, Chocolate Caramel Crown, Chocolate Royals Dark, Chocolate Royals Milk, Chocolate Mint Slice, Mini Wagon Wheels Originals and Chocolate Mint Slice Value Pack ("Participating Arnott's Chocolate Biscuit Products").
11.Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per two (2) packets of Participating Arnott's Chocolate Biscuit Products purchased in a single transaction from a Woolworths/Safeway store during the Promotional Period; (b) a maximum of one (1) entry per household per day is permitted for online entries; (c) a maximum of one (1) entry per mobile number per day is permitted for SMS entries; and (d) each entry must be submitted separately and in accordance with entry requirements.
12.Any entry that does not comply with these Conditions of Entry will be invalid.
13.All website and SMS entries are deemed to be received at the time of receipt into the Promoter's database NOT the time of transmission by the entrant. SMS entries via the Internet are ineligible.
14.The Promoter's decision is final and no correspondence will be entered into.
15.Instant winners will be notified immediately and in writing according to their entry method: (a) SMS – via return SMS; (b) online – upon entry submission. Winners' names (for prizes over $250) will be published in The Australian on 31/07/2012. Prizes will be delivered to each winner's nominated Australian address, unless stated otherwise in these Terms and Conditions.
16.If required (in order to distribute any unclaimed instant win prizes), the second chance draw will take place at Prime Focus, Suite 403, 62 Beach Street, Port Melbourne VIC 3207 on 14/08/2012 at 12noon AEST, subject to the written directions given by any relevant authority. Prizes in the second chance draw will be awarded in descending order of value. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
17.Winners in the second chance draw will be notified by mail within 2 days of the draw and winners of prizes valued at over $250 will be published in The Australian newspaper on 10/09/2012.
18.The instant win prizes available to be won are as follows:
◦Fifteen (15) x pairs of 18ct White Gold Diamond Earrings, each valued at $3,000. Each earring will feature a round brilliant cut diamond in a four claw setting with a post and butterfly fitting. Total item weight for both earrings will be 1.5 grams. Diamond weight for both earrings will be 0.60ct (round brilliant cut). Colour of the diamonds is G/H (near colourless stone) and clarity is SI (small inclusions).
◦Ten (10) x $1,500 Free-2 Travel Holidays travel vouchers. Travel voucher may be used up to the value of the voucher towards any of the following travel services offered by Free-2 Travel Holidays: flights, accommodation, day tours, cruising, attractions, travel insurance, car hire, group tours such as coach or special interest trips, sporting events, adventure activities (diving etc), concerts, festivals and any taxes involved in the bookings thereof. Winners of the Free-2 Travel Holidays travel voucher prize will be contacted by Free-2 Travel Holidays with prize arrangement details. All travel using the travel vouchers is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partners. Travel vouchers are valid for one (1) year from the date of issue.. Travel using the travel vouchers must be booked through Free-2-Travel and their suppliers/agents - no direct bookings by the winner are permitted. Travel vouchers are not redeemable for cash or cash products e.g. Travelex, foreign currency etc. Redeeming the travel vouchers is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. No portion of the travel vouchers is redeemable for cash. The travel vouchers are not refundable or transferable. Winner (and any companion/s) must be in possession of a valid
passport with a minimum of 6 months validity on it prior to departure for international destinations. Each winner is responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed (that arose due the winner's or their companion's actions). The voucher cannot be used toward any costs incurred in procuring visas, passports, toward spending money, meals (other than those included with the travel package purchased), insurance (other than costs included with the travel package purchased) or toward any other ancillary services not listed above.
◦Twenty five (25) x third generation Apple iPads, 16GB (WiFi), each valued at $539;
◦One hundred (100) x seventy two (72) packets of Arnott's Tim Tam original biscuits, each valued at $208;
◦Two hundred (200) x Double Gold Class Movie Tickets, each double pass valued at $79. The Double Gold Class Movie Tickets are valid for use at Event, Birth, Carroll & Coyle, Greater Union, and Village Cinemas and are valid for 12 months from the date of issue;
◦One thousand six hundred and fifty (1,650) x movie ticket e-vouchers to the winner's choice of either Hoyts Cinemas or EVENT/ Greater Union/ Birch Carroll & Coyle Cinemas (as selected by the winner upon winner notification). The e-voucher will be emailed to the winner within 7 days of the winner being validated. If a winner chooses the Hoyts Cinemas e-voucher they will be awarded a voucher redeemable for one (1) general admission seat at a particpating Hoyts Cinema or a participating Palace Cinema in Australia valued at $18.50. If a winner chooses the ‘EVENT, Greater Union and Birch Carrol & Coyle' e-voucher, they will be awarded a voucher for one (1) adult or student admission to any standard session at a participating EVENT, Greater Union or Birch Carroll & Coyle Cinema within Australia valued at $18.50. The voucher will be valid for 6 months from the date of issue.
In the event that a winner uses the voucher for a movie ticket at a Hoyts Cinemas, the following conditions apply:
■Voucher may be used for any movie session at any Hoyts or Palace Cinema within Australia (except Saturday after 5pm) including the Bean Bag cinema and Xtremescreen at Hoyts and selected Palace Cinemas in Australia.
■Voucher may be used for any 3D movie session with an upgrade fee payable by the entrant, which will be applied at time of redemption.
■Voucher is valid until the expiry date indicated on the voucher and cannot be exchanged, extended or replaced.
■The voucher cannot be: (i) redeemed for La Premiere, Directors Suite, Hoyts IMAX ® or special or group events; (ii) used to purchase 3D glasses and 3D glasses must be purchased separately at an additional cost; (iii) used in conjunction with any other offer; (iv) replaced or refunded if lost, stolen, damaged or expired; (v) used to purchase any pre-paid movie vouchers or gift cards or Hoyts Rewards memberships; (vi) exchanged for cash and change will not be given irrespective of cinema pricing; or (vii) sold without the prior written consent of Hoyts Corporation Pty Ltd.

In the event that a winner uses a voucher for a movie ticket at an EVENT, Greater Union or Birch Carroll & Coyle cinema the following conditions apply:
■The voucher cannot be used for any movie session after 5pm on Saturdays.
■In the event that the voucher is used to book a ticket online, online booking fees may apply and will be payable by the winner.
■Seating is subject to availability. Voucher may not be used on a movie session if no seats are available for that session
■Surcharges apply for Vmax and 3D screenings. 3D glasses must be purchased separately at an additional cost to the winner.
■The voucher cannot be: (i) transferred, sold or exchanged for cash; (ii) used at Village, Beverley Hills, Cronulla, Noosa or Moonlight cinemas; or (iii) used at Gold Class, group bookings, movie marathons or any special screening.

19.Any ancillary costs associated with redeeming any voucher/movie ticket are not included. Any unused balance of any voucher/movie ticket will not be awarded as cash. Redemption of all vouchers/movie tickets is subject to any terms and conditions of the issuer including those specified on the voucher/movie ticket.
20.The maximum value of the total prize pool is $140,600 (including GST).
21.No responsibility is accepted for late, lost, incomplete, incorrectly submitted, delayed or misdirected entries.
22.Prizes are not transferable or exchangeable and cannot be taken as cash.
23.Subject to the second chance prize draw clause, if for any reason a winner does not take a prize, then the prize will be forfeited by the winner and cash will not be supplied in lieu of that prize. The Promoter accepts no responsibility for any variation in the prize values. Where a prize is unavailable for any reason, the Promoter may substitute the prize for a prize of equal or higher value and/or specifications, as determined by the Promoter, subject to any written directions from a regulatory authority.
24.The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter, including without limitation technical malfunctions or failures.

25.Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Conditions of Entry, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the second chance draw.
26.The Promoter is not responsible for any technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, or any other technical failures, including any injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this competition.
27.Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28.If for any reason this competition is not capable of running as planned in any respect due to any cause beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, subject to the written directions of any relevant authority, in its sole discretion to cancel, postpone or amend the competition, as appropriate.
29.The Promoter reserves the right in its sole discretion, to the fullest extent permitted by law, to disqualify any individual who the Promoter has reason to believe, acting reasonably, has breached any of these Conditions of Entry or any instructions or directions on the promotional website, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the competition. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
30.Any costs associated with accessing the promotional website are the entrant's responsibility and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website or in the SMS will deem the entry to be invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
31.Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
32.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; or (f) use or redemption of a prize.
33.As a condition of accepting a prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
34.Winners should seek independent financial advice about any tax implications that may arise from the prize winnings.
35.Each entrant agrees to participate and co-operate in any reasonable publicity activities connected with the promotion should he/she be a winner of any prize. This may include having photographs taken of him/her (and his/her prize) and having his/her name and picture appears in advertising, marketing and publicity material within Australia at the Promoter's sole discretion. Each entrant acknowledges that he/she will not receive any compensation in this regard, and the Promoter will determine, in its absolute discretion, the content, format and style of any material to appear in such publications.
36.The Promoter may require the winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter's absolute discretion.
37.The Promoter, through its agent, 31st Second, collects personal information in order to conduct the promotion (including conducting the draw and notifying winners) and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
