TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.

Entries will only be received during the periods outlined below (“Entry
Periods”). Each entry period will be for a duration of 4008 minutes only:Entry Period Entries Open Entries Close

Australian residents aged 21 years or over with a current
and valid driver’s licence issued in an Australian State/Territory.
4. Employees (and their immediate families) of the Promoter and agencies
associated with this promotion are ineligible to enter. Immediate family means
any of the following: spouse, ex-spouse, de-facto spouse, child or step-child
(whether natural or by adoption), parent, step-parent, grandparent, stepgrandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or 1

5. To enter, individuals must complete the following steps during an Entry
Period:
(a) visit the Peugeot Australia Facebook Page at
http://www.facebook.com/peugeotau;(b) become a fan of the Page by clicking the ‘like’ button, if not already a fan
of the Page;
(c) follow the prompts to the promotional application;
(d) input the requested details including their first name, last name, valid
email address, postcode, their State/Territory, and answer the question
“Why do you want to borrow the Peugeot 4008?” (in 50 words or less);
and(e) submit the fully completed entry form.
6. The Promoter reserves the right, at any time, to verify the validity of entries
and entrants (including an entrant’s identity, age and place of residence) and
to disqualify any entrant who submits an entry that is not in accordance with
these Terms and Conditions or who tampers with the entry process. Errors
and omissions will be accepted at the Promoter's discretion. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver
of those rights.
Incomplete or indecipherable entries will be deemed invalid.

. Multiple entries permitted, subject to the following: (a) each entry must be
substantially unique; and (b) each entry must be submitted separately and in
accordance with entry requirements.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the
right, in its sole discretion, to determine the identity of the entrant.
10. This is a game of skill and chance plays no part in determining the winners.
Each entry will be individually judged based on originality, creativity, brand fit
and feasibility of the answer provided to the promotional question.
11. The judging will take place at 110 Argyle Street, Fitzroy, Victoria 3065. The
judges may select additional reserve entries which they determine to be the
next best, and record them in order, in case of an invalid entry or ineligible
entrant.
12. The Promoter’s decision is final and no correspondence will be entered into.
13. There will be one (1) round of judging at the end of each Entry Period (five (5)
judging rounds in total). One (1) winner will be determined from each judging
round (five (5) winners in total). Each judging round will include all entries
received from the preceding Entry Period and any non-winning entries from
any previous Entry Periods.
14.
The best valid entry, as determined by the judges from each judging round,
will win the rental of a Peugeot 4008 with automatic transmission, for three (3)
nights valued at $500 and a $500 Caltex Fuel Card. The car must be collected
and returned to the nearest authorised dealer as nominated by the Promoter.
The use of the Peugeot 4008 car is subject to Peugeot’s standard terms and
conditions in relation to test drives and similar arrangements. It is a condition
of accepting the prize that the winner and driver if applicable signs any such
document as the Promoter may require prior to accepting the prize (including
but not limited to a deed of release and indemnity). The Peugeot 4008 will be
provided to the winner with a full tank of petrol. The exact dates of borrowing
the vehicle will be determined by the Promoter in consultation with the winner,
subject to availability. In the event of a disagreement as to the dates the car
rental must be taken, the Promoter’s decision will be final. Each winner is
limited to travelling a maximum of 3,000km on the road with the vehicle. Any
traffic infringements incurred during the loan period are the responsibility of
the winner. Any ancillary costs associated with redeeming the prize, including
but not limited to, travel to and from the dealership, are the responsibility of
the winner The car rental prize includes car insurance up to the value of $400.
This value is included in the rental prize value listed above. Car insurance is
subject to the terms and conditions issued by the Promoter’s nominated car
insurer, including but not limited to any limitations on the covered amount.
The
insurance excess is $2,000. In the event that the winner damages the
Peugeot 4008 car or another vehicle or other property while driving the
Peugeot 4008, they are liable to pay the first $2,000 of any resulting damage.3
15. Any ancillary costs associated with redeeming the Caltex Fuel Card are not
included. Any unused balance of the Caltex Fuel Card will not be awarded as
cash. Redemption of the Caltex Fuel Card is subject to any terms and
conditions of the issuer including those specified on the Caltex Fuel Card.
16. The winners will be notified by email.
17. If for any reason a winner does not take a prize (or an element of the prize) by
the time stipulated by the Promoter, then the prize (or that element of the
prize) will be forfeited.
18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion,
reserves the right to substitute the prize (or that part of the prize) with a prize
to the equal value and/or specification.
19. Total prize pool value is $5,000.20. Prizes, or any unused portion of a prize, are not transferable or exchangeable
and cannot be taken as cash.
21. As a condition of entering this promotion, each entrant licences the Promoter
to use their entry in any media for an unlimited period for any reason including
but not limited to future promotional, marketing or publicity purposes. Each
entrant warrants to the Promoter that each entry submitted is an original
literary work of the entrant that does not infringe the rights of any third party.
Entrants agree to indemnify the Promoter against all costs and claims by third
parties arising from a breach of this warranty. Entrants consent to any use of
their entry which may otherwise infringe their moral rights pursuant to the
Copyright Act 1968 (Cth).
22. Entrants consent to the Promoter using their name, likeness, image and/or
voice in the event they are a winner (including photograph, film and/or
recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this promotion (including any
outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter.
23. If this promotion is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, including but not limited to technical
difficulties, unauthorised intervention or fraud, the Promoter reserves the right,
in its sole discretion, to the fullest extent permitted by law (a) to disqualify any
entrant; or (b) to modify, suspend, terminate or cancel the promotion, as
appropriate.
24. Any cost associated with accessing the promotional website is the entrant’s
responsibility and is dependent on the Internet service provider used. 4
25. Nothing in these Terms and Conditions limits, excludes or modifies or
purports to limit, exclude or modify the statutory consumer guarantees as
provided under the Competition and Consumer Act, as well as any other
implied warranties under the ASIC Act or similar consumer protection laws in
the State and Territories of Australia (“Non-Excludable Guarantees”). Except
for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and
agents) excludes all liability (including negligence), for any personal injury; or
any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.
26. Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter (including its respective officers,
employees and agents) is not responsible for and excludes all liability
(including negligence), for any personal injury; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any
theft, unauthorised access or third party interference; (c) any entry or prize
claim that is late, lost, altered, damaged or misdirected (whether or not after
their receipt by the Promoter) due to any reason beyond the reasonable
control of the Promoter; (d) any variation in prize value to that stated in these
Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or
(f) use of the prize.
27. As a condition of accepting a prize, each winner must sign any legal
documentation as and in the form required by the Promoter and/or prize
suppliers in their absolute discretion, including but not limited to a legal
release and indemnity form.
28. The Promoter collects personal information in order to conduct the promotion
and may, for this purpose, disclose such information to third parties, including
but not limited to agents, contractors, service providers and prize suppliers.
Entry is conditional on providing this information. The Promoter may, for an
indefinite period, unless otherwise advised, use the information for
promotional, marketing, publicity, research and profiling purposes, including
sending electronic messages or telephoning the entrant. Entrants should
direct any request to access, update or correct information to the Promoter.
All entries become the property of the Promoter.
29. Entry and continued participation in the promotion is dependent on entrants
following and acting in accordance with the Facebook Statement of Rights
and Responsibilities, which can be viewed at

associated with, Facebook. Entrants understand that they are providing their
information to the Promoter and not to Facebook. The information an entrant
provides will only be used for the purposes outlined in these Terms and
Conditions. Any questions, comments or complaints about this promotion

liable for any loss or damage or personal injury which is suffered or sustained
