Can Stories - Terms & Conditions

1. Information on how to enter and prize details set out in all communications regarding the Commonwealth Bank of Australia ‘Share your Can story’ Promotion (the “Promotion”) form part of these Conditions of Entry (Conditions). Any entry not complying with these Conditions is invalid and will not be considered for a prize.
 
2. Acceptance of these Conditions is a condition of entry into the Promotion and by entering the Promotion you confirm that you have read and accept these Conditions.
 
3. Please note this Promotion is no way sponsored, endorsed, administered by or associated with Facebook and by entering this Promotion you agree:
 
•    not to make any claim against Facebook; and
•    to release Facebook from any liability in regard to the Promotion.
 
4. The Promoter is the Commonwealth Bank of Australia ABN 48 123 123 124 of 201 Sussex Street, Sydney, NSW 2000. Telephone 13 22 21 (the “Promoter”).
 
5. The Promotion commences at 12:00am 12/06/2012 and closes at 11:59pm AEST on 25/06/2011 (the “Promotion Period”) and will only be drawn on each working day (10 working days)
 
6. Entry into the Promotion is open to individuals who satisfy the following eligibility requirements (“Eligibility Requirements”):
•    are aged 18 years or over and a permanent resident of Australia, residing in Australia;
•    hold a current passport and are eligible to travel to United Kingdom

•    are not employees of the Promoter or its Related Bodies Corporate (as that term is defined in the Corporations Act 2001 (Cth);
•    are not members of the immediate family of employees of the Promoter or the Promoter’s Related Bodies Corporate.
 
7. To enter, individuals must:
•    first like the Commonwealth Bank facebook page.
•    confirm they have read (and accepted) these Conditions which are available by visiting the ‘Can your bank get you here’ Olympics Ticket application on the Commonwealth Bank Facebook page, available at www.facebook.com/commonwealthbank;
•    complete all mandatory details about themselves including their full name, age, email address, contact number.
•    only submit one Can story .
 
8. The Promoter will monitor the eligibility of individuals who enter the Promotion and may at its absolute discretion exclude or prohibit persons from entering the Promotion if the Promoter considers that an individual is not eligible to enter the Promotion.
 
9. An individual is required to enter his/her ‘Can story’ in 200 words (or 1,000 characters) or less. A Can story is your proudest moment in reaching your individual goal. All Can stories will be judged by a Commonwealth Bank representative and selected upon merit to go into the major and minor prize draws.
 
10. Can stories that are malicious or contain inappropriate content such as; slander, sexual reference, profanities will not be accepted to enter the competition
 
11. Major prize will be selected by James Magnussen. This will be the best of the Can stories entered.
 
o  Major Prize includes;

♣    Two return economy flights from Australian city to London Heathrow.
♣    Six nights’ accommodation in 4 star hotel in London, double room.
♣    Arriving 26/7/12 - Departing 1/8/12
♣    $1,000 Spending money
♣    Two tickets to the following events;
•    Official Australian Olympic Team Reception in London
•    Opening Ceremony (Category A)
•    Gymnastics
•    Basketball
•    Tennis
•    Swimming
•    Beach Volleyball
 
 
12. Runner up prize will be five of the second best Can stories also selected by James Magnussen.
•    Runner up prize;

•    3-course dinner and beverages with James Magnussen
•    4 winners in total, each winner will bring one guest
Dinner venue time and date will be determined once winners are selected. Date will be prior to 30 June 2013 and according to the availability of James Magnussen
•    Interstate prize winners will receive 2 x economy flights and 1 x nights 4-star hotel accommodation for them self and their guest.  
 
13. 10 Minor prizes will be drawn each working day between (and including) 12th June - 25nd June 2012
daily, a Commonwealth Bank representative will select the best Can stories and post these to the winner page the following working day.
 
•    Minor prize packs, up to 100 to be won;1 x Adidas sports pack1 x Adidas cap1 x Adidas water bottle
 
14. The total value of the Prize pool for the Promotion is $58,013AUD.
 
15. Winners of each day’s manual draw will be notified by phone and email within 24 hours of winning the daily Prize (Winner). By acceptance of a prize the winner agrees to their Can story being published within the competition on Facebook and the name of a winner being published in the public notices section of the Australian Newspaper. Winners from the major draw and runners up will be drawn on 26/06/12 to 28/06/12 will be notified by phone and email within 24 hours of winning. Their stories will be published with in the competition on Facebook and published in The Australian Newspaper on XX.
 
16. If the major prize winner does not claim their prize by 12:00pm on 28th June 2012 by contacting the Promoter after receiving notification that they are the Winner the Prize will be re-drawn on 29th June 2012 12.30pm by a representative of the Promoter from all remaining Eligible Entries for each day that the Prize has not been claimed (a “Re-Draw”)
 
17. The major prize winner will be required to write a blog post about their experience to the Olympic Games which will be posted on CommBank Blog.
 
 
18. Prizes are not transferable or exchangeable. The winners accept the prize ‘as is’ and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from the prize. Winners should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser if they are a Winner.
 
19. The Promoter’s decision is final and no correspondence will be entered into regarding the Winner or an entry. The Promoter will arrange for delivery of the Prize to the Winners within Australia by mutual agreement with the Winners.
 
20. In the event that a Winner does not take an element of the Prize as agreed with the Promoter then that element of the Prize will be forfeited by that Winner and no further prize will be awarded.
 
21. The Promoter reserves the right to request that Winners demonstrate their eligibility for the prize as a condition of receipt of a Prize. Identification considered suitable for verification is at the discretion of the Promoter. If the Promoter, acting reasonably, does not consider a Winner meets the Eligibility Requirements or was not an Eligible Entrant, the Promoter may refuse to award the Prize and a re-draw for the Prize will take place in accordance with Condition 16
 
 
22. If for any reason this Promotion is not capable of running as planned (including, but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion, subject to any legal requirements or compliance with the directions from a authority who has capacity to administer the promotion.
 
23. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or the Promotion. You may not use any equipment or software that may interrupt or disrupt the Promotion or that tampers with the Promotion or the awarding of the Prizes.
 
24. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Conditions.
 
25. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or related to or resulting from participation in or downloading any materials in this Promotion.
 
26. Entrants are responsible for any costs associated with entering the Promotion and enter the Promotion at their own risk. To the extent permitted by law, the Promoter will not be liable for any interruption, delay in operation or transmission, virus, communications failure, Internet or Facebook access difficulties, or malfunction in equipment or software.
 
27. Nothing in these Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
 
28. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of a Prize.
 
29. All entries become the sole property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and notify Winners. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions in running the Promotion.
 
30. The Promoter will retain and deal with any personal information you disclose in accordance with the Privacy Act 1988 (Cth) and agrees not to use your personal information for any other purpose other than for the purposes of the Promotion.
