Terms and Conditions of Entry for the “Caption It Competition” Promotion

Information on how to enter and prize details form part of these conditions.  Entry into the Promotion is deemed acceptance of these conditions.
The promoter is Cricket Australia, ABN 53 006 089 130, of 60 Jolimont Street, Jolimont, Victoria 3002 (Promoter).
Entry is open only to members of the Australian Cricket Family (ACF) who are members of the ACF at the time of entering this Promotion and who remain as members until the end of the Promotion Period as defined in clause 4 (Eligible Entrants). To become a member of the ACF, you must visit http://www.cricket.com.au/ACF/register and complete the registration form and accept the confirmation email. Directors, management and employees (and their immediate families) of the Promoter, and suppliers, associated companies and agencies of the Promoter are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promotion commences at 9.00am AEDST on 14 June 2012 and closes at 11.59pm AEDST 3 July 2012 (Promotion Period).
To enter the Promotion, during the Promotion Period an Eligible Entrant must visit http://www.cricket.com.au/fans/caption-contest, fill out the entry form and tell us in 250 characters or less “Tell us your best idea for a caption for the photo!” The Eligible Entrant must also provide the member’s name, address, contact phone number and ACF membership number on the online entry form. Eligible Entrants may submit multiple entries although Eligible Entrants may not win more than one prize in the Promotion.
The Promoter reserves the right to disqualify any Eligible Entrant who provides incorrect or fake contact details or who otherwise fails to comply in any respect with these Terms and Conditions of Entry and the ACF Membership Terms and Conditions.   If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Judging of the entries will commence at 9:00am AEDST on 4 July 2012 at 60 Jolimont Street, Jolimont, Victoria.  The Eligible Entrant whose entry is judged by the judging panel in its sole and absolute discretion to be the most creative and unique answer to the entry question, “Tell us your best idea for a caption for the photo!” in 250 characters or less and who are validated through the ACF database as an Eligible Entrant shall win the prize. If an entry selected is found not to be that of an Eligible Entrant then the next best entry will be selected and validated, and so on, until the winner has been selected and validated.
All entries must be submitted in the name of good sportsmanship. If Cricket Australia deems an entry to be inappropriate in its sole discretion, such entry shall be deemed invalid, and discounted for the purposes of determining the winning entry.
The winner will receive a 2011-12 Vodafone Test Series cricket bat signed by the Australian Men’s International Team. The prize is valued at $AUD500.00 RRP.
The prize will be posted to the address provided by the Eligible Entrant on the entry form when entering the Promotion, unless an alternative address is specified at the time that the winner is notified. The winner should allow up to four weeks for postage. The Promoter accepts no responsibility whatsoever for prizes lost or misdirected from the point of postage.
If the winner of the major prize is under 18 years of age, the prize will be awarded to the winner’s parent or guardian.
The prize value is accurate as at the Promotion date.  The Promoter accepts no responsibility for any variation in prize value after that date.   Prize is not transferable or exchangeable and cannot be redeemed for cash.  If for any reason the prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value, subject to the approval of the gaming authorities in each State and Territory, where relevant.
In the event that the prize is not accepted or claimed by 6 October 2012 or if, after making all reasonable attempts, the Promoter cannot personally contact a prize winner by 6.00pm AEST on 6 October 2012, that winner’s entry will be deemed invalid and the Promoter reserves the right to select the next best validated entry/entries on 7 October 2012 commencing from 9.00am AEST at 60 Jolimont Street, Jolimont, Victoria in order to distribute the unclaimed prize/s, subject to any written directions given by any relevant gaming authority, where required.
The prize winners will each be notified by email and by telephone and the name and state of residence of notified winners will be published in the Inside Australian Cricket e-newsletter on 17 July 2012.
The Promoter reserves the right to disqualify entries in the event of non-compliance with the conditions of entry or if, in the opinion of the Promoter, an Eligible Entrant tampers or interferes with any entry mechanism in any way.
The Promoter's decision in relation to any aspect of the competition is final and binding on each person who enters.  No correspondence will be entered into.  No responsibility is accepted for late entries.
All entries become the property of the Promoter. Eligible Entrants consent to the Promoter using their entry in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
At the Promoter’s request, each winner must participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge.  Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
If for any reason any aspect of this Competition is not capable of running as planned, including, but not limited to, by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, where required.
Any cost associated with accessing the www.cricket.com.au website or acf@cricket.com.au email address is the entrant’s responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use and disclose the information for promotional, marketing, publicity, research and profiling purposes and other purposes set out in the Promoter’s Privacy Policy (including sending electronic messages or telephoning the entrant) which is available at http://www.cricket.com.au/privacy-policy or by emailing privacy@cricket.com.au. Entrants should direct any request to access, update or correct information to the Promoter.
