Terms and Conditions

1. INTRODUCTION
1.1. The following Terms and Conditions apply for the ‘Win $5,000 Cash to Splash Competition’ (“Competition”). Information on how to enter forms part of the Terms and Conditions. By submitting an entry into this Competition, entrants warrant that they have read, understand and agree to be bound by them.
1.2. A copy of these Terms and Conditions can be collected at the Service Counter in participating Good Guys stores.
2. PROMOTER
2.1. The promoter is Crest Electronics (a division of Olbertz Holding PTY LTD (ABN 31260 452 208) of 165 South Pine Rd, Brendale BC Qld Australia 4500).
3. DURATION
3.1. Competition commences at 9.00 am AEDST on Tuesday 01/5/2012 and entries close at 6.00 pm AEDST on Tuesday 31/7/2012 (“Competition Period”).
4. ELIGIBILITY
4.1 Entry is only open to Australian permanent residents.
4.2 Employees and the immediate families of the Promoter and its related bodies corporate are ineligible to enter. Employees and the immediate families of all associated sponsors and participating companies are also ineligible to enter.
5. METHOD OF ENTRY
5.1. To be eligible to enter, individuals must, during the Competition Period, purchase a Crest branded product from any participating The Good Guys store nationally.
5.2. To enter, individuals following purchase must, during the Competition Period, complete the official entry form available at www.goodguys.com.au/ and complete an answer to the question “How would you Splash the Cash in a Good Guys store” in twenty-five (25) words or less to ‘Win 1 of 5, $5,000 Cash to Splash prizes’.
5.3. Incomplete, illegible or incomprehensible entries (whichever is applicable) will not be eligible and will be disqualified. The Promoter reserves the right to disqualify any entry which in the opinion of the Promoter includes any content that may be unlawful, profane, inflammatory, defamatory and/or damaging to the goodwill or reputation of the Promoter.
5.4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5.5. Multiple entries permitted, subject to the following: (a) only one entry permitted per purchase on any one store visit; (b) each entry must be substantially unique; and (c) each entry must be submitted separately and in accordance with entry requirements.
5.6. Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
5.7. Entrants must retain their copy of their The Good Guys receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Competition Period but prior to entry.
6. JUDGING
6.1. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the question.
6.2. Entries will be judged at 10.00 am AEDST on Thursday 16/08/2012. The best original/humorous/imaginative valid entry (as determined by the judges in their absolute discretion) will win the prize.
7. PRIZE
7.1. The prize value is the recommended retail value as provided by the supplier, is in Australian dollars and is correct at the time of printing.
7.2. There are five (5) major prizes to be won. The best five valid entries, (as determined by the judges in their absolute discretion), will each win one (1) x $5,000 Cash. The Promoter will present the winning entrants the $5,000 cash in person.
7.3. Any ancillary costs associated with redeeming the cash in person are not included and the responsibility of the winners.
7.4. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
7.5. Total prize pool value is $25,000.
8. PRIZE CONDITIONS
8.1. A prize is non transferable and non exchangeable.
8.2. If a prize winner does not take any element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner.
9. NOTIFICATION
9.1. Prize winner will be notified on Friday 17/08/2012 by telephone and make themselves available to receive the prize at a local Good Guys store within 14 days after this date.
10. PRIZE COLLECTION
10.1. The Promoter reserves the right to request that the winner provide proof of identity, proof of residency and/or proof of entry validity (for example, a phone bill or the Good Guys store receipt for purchase requirement) in order to claim the prize. Proof of identity, residency and/or entry validity considered suitable for verification is at the Promoter’s sole discretion. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
10.2. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form reasonably required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
9. TAXES
12.1. Any tax payable as a result of a prize being awarded or received will be the responsibility of the respective winner. The winner should seek independent financial advice prior to accepting a prize if this is a concern.
13. PUBLICITY MATERIALS
13.1. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
14. COPYRIGHT
14.1. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this Competition, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future Competition, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their rights pursuant to the Copyright Act 1968 (Cth). Entries will not be returned to any entrant.
15. RELEASE AND INDEMNITY
15.1. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
15.2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e)any tax liability incurred by a winner or entrant; or (f) use of the prize.
16. TAMPERING AND OTHER MATTERS
16.1. If for any reason this Competition is not capable of running as planned as a result of any (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile phone failure, tampering, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right to disqualify any individual who (whether directly or indirectly) causes the same and/or to cancel, terminate, modify or suspend the Competition.
16.2. The Promoter accepts no responsibility for any late, lost or misdirected entries including but not limited to electronic messages not received by the Promoter due to technical disruptions, network congestion or any other reason.
16.3. The use of any automated entry software or any other mechanical or electronic means that permits any person to enter the Competition repeatedly is prohibited.
17. LEAVE FOR PARTICIPATION
17.1. Obtaining time off work and/or study or related activities to participate in the Competition and/or receive a prize will be the sole and absolute responsibility of each entrant.
18. EXCLUSION OF PARTICIPANTS
18.1. The Promoter reserves the right to exclude any person from participating in the Competition or a prize for any reason, including but not limited to, the preservation of the safety of the Promoter’s staff members or any other person or because the Promoter deems that the behaviour of a person may bring the Promoter’s brand into disrepute.
19. MINORS
19.1. If the prize winner is under the age of 18 years, the winner’s parents or legal guardians must sign any legal documentation as and in the form reasonably required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form, before the prize is awarded. The prize may at the absolute discretion of the Promoter be awarded to the prize winner’s parent or legal guardian on the winner’s behalf.
20. TERMINATION OF COMPETITION
20.1. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
21. DECISIONS FINAL
21.1. All decisions and actions of the Promoter relating to the Competition and/or redemption of the prize are exercised according its absolute discretion and are final. No discussions or correspondence with entrants or any other person will be entered into.
22. FAILURE TO ENFORCE TERMS AND CONDITIONS
22.1. A failure by the Promoter to enforce any one of these Terms and Conditions in any instance(s) will not give rise to any claim or right of action by any other person or entrant.
23. PERSONAL INFORMATION AND PRIVACY
23.1. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to customers, agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. All entrants may have their details removed from the Promoter’s database by simply contacting the Promoter or by sending an email to support@thegoodguys.com.au. If details are removed prior to the conclusion of the Competition and/or award of the prize, entrants will forfeit their right to claim the prize.
