Terms and Conditions for CatchOfTheDay.com.au Chrysler Jeep Compass Sport Giveaway
1 Definitions
1.1 AEST means Australian Eastern Standard Time.
1.2 Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
1.3 Jeep means Chrysler Australia Pty Ltd (ACN 125 956 505) of 1-27 Princes Highway Dandenong South, Victoria, Australia 3175 trading as Fiat Chrysler Group.
1.4 Promoter means CatchOfTheDay.com.au Pty Ltd (ABN 22 149 779 939) of 64-70 Cochranes Road, Moorabbin, Victoria 3189.
1.5 Promotion means this CatchOfTheDay.com.au Pty Ltd Jeep Compass Sport Giveaway.
1.6 Promotional Period means the period starting on 22 May 2012 at 12:00pm AEST and ending on 1 August 2012 at 11:59pm AEST.
1.7 Vehicle means a 2012 Jeep Compass Sport CVT Automatic Transmission 2.0L Petrol Engine with Black Paint.
2 Who May Enter
2.1 Entry is only open to Australian residents aged eighteen (18) years or over who hold a current valid Australian driver's licence.
2.2 Employees of the Promoter and Jeep and their Immediate Families as well as agencies associated with this promotion are ineligible to enter.
3 Requirements for Entrants
3.1 Participation in this promotion is deemed acceptance of these Terms and Conditions.
3.2 It is compulsory for entrants to provide their full name and email address to enter the promotion.
4 Validity
4.1 To enter, entrants must, during the Promotional Period:
(a) submit the fully completed entry form on the CatchOfTheDay.com.au website; and
(b) agree to opt in to email marketing for the Promoter’s new Baby Goods website.
4.2 Only one (1) entry permitted per person.
4.3 Incomplete entries will be deemed invalid.
4.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's sole and unfettered discretion.
5 The Prize
5.1 The prize for the overall winner will be the Vehicle valued at AUD$30,992.00, including all on road costs, registration, stamp duty and dealer delivery charges (which may vary from State to State and which has been calculated on the basis that the Winner is a resident of Victoria). A secondary prize draw for 10 runner-up prize winners will take place following the draw of the Vehicle ("Secondary Draw"). Each Secondary Draw prize will be a pram valued at up to AUD$500.00 each. The total prize value for the Secondary Draw will be up to AUD$5,000.00.
5.2 The total prize pool will be up to AUD$35,992.00 (which may vary from State to State and which has been calculated on the basis that the Winner is a resident of Victoria).
5.3 In relation to the Vehicle, compulsory third party insurance (or any other insurance), options, petrol and all other ancillary costs are the responsibility of the winner. The winner must collect the prize from their nearest authorised Jeep dealership within one month from day the draw takes place. Secondary Draw winners will receive items via post once their identity is confirmed by the Promoter.
5.4 No prize is transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
5.5 If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
6 Details of Draw
6.1 The winners of the prizes will be randomly drawn from eligible entries as described in condition 4.
6.2 The draw will take place at the Promoter’s office located at 198 Boundary Road, Braeside, Victoria on 2 August 2012 at 10:00am AEST. The winner of the Vehicle, as well as the winners of the Secondary Draw will be drawn at this time.
6.3 The winner of the Vehicle and winners of the Secondary Draw prizes ("Winners") will be announced on 2 August 2012 following the Draw on the Promoter's:
(a) Website:
www.catchoftheday.com.au;(b) Twitter feed; and
(c) Facebook page.
6.4 In addition to the Winners being announced in accordance with condition 6.3, the Winners will also be contacted by the Promoter via email following the draw on 2 August 2012, and an announcement will be published in The Australian newspaper on 3 August 2012 identifying the Winners.
6.5 The Winners of the prizes must sign any release form(s) as may be required by the Promoter (and its associated agencies and companies), and/or any other third party directly or indirectly involved in and with the prize and refusal to sign such form(s) shall result in the immediate forfeiture of the prize and that person shall have no claim, action or recourse at law or otherwise, against the Promoter in respect of the forfeiture.
6.6 If the winner of the Vehicle is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the Vehicle to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded.
6.7 A draw for any unclaimed prize will take place at the Promoters’ office on 2 November 2012 at 10:00am AEST. The winner(s) will be notified in the same manner as conditions 6.3 and 6.4, with an announcement being published in The Australian Newspaper on 3 November 2012.
7 Method of Claiming Prize
7.1 The respective Winners are not required to be on-site at the draw. Once the Winners are announced, the Promoter will contact the Winners in the manner set out in condition 6.3 to make arrangements for claiming the prizes.
7.2 If for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.
8 Database
8.1 All entries will be entered into a database for future advertisement and marketing.
8.2 The Promoter and Jeep may use entrants' names and addresses for future marketing and promotional purposes unless notified otherwise in writing by the entrant.
8.3 Subject to clause 8.4, the Promoter will classify all entries as confidential and will not disclose any entrant’s details to any other parties, and by entering this promotion the entrants agree to accept email communications from the Promoter and Jeep until the entrant opts out to receive the email communications from the Promoter and Jeep.
8.4 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to Jeep, third parties including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
9 General
9.1 Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9.2 Entrants consent to the Promoter and Jeep using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
9.3 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
(a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
9.4 The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
9.5 All entries become the property of the Promoter.
9.6 The Promoter reserves the right to alter or amend these Terms and Conditions, and conditions of operation of the Promotion, subject to the approval of the gaming authorities in each State or Territory, where required.
9.7 Except for any liability that cannot by law be excluded, including the non-excludable guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by the winner or any entrant; or
(f) use of the prize.
