Promotional Period and Promoter

Emergency Services Superannuation Board (the Board) ABN 28 161 296 741 of Level 16 / 140 William St, Melbourne VIC 3000 is the Promoter (the Promoter). Authorised under permit numbers: NSW Permit LTPS/12/02914 and ACT Permit TP 12/01513.

1. Table 1 details the starting and closing dates for the promotion.

Eligibility & Entry Requirements

2. Information on how to enter and the prizes forms part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions.

3. Entry is only open to residents in the state of Victoria who are aged 18 years or over. Employees of the Promoter, its associated companies and agencies and their immediate families are ineligible to enter.

4. Participants are automatically entered into the promotion by:
    a) Registering for a Members Online account, this can only be done online via the website: www.esssuper.com.au
    b) Logging onto their existing Members Online account via: www.esssuper.com.au

5. Participants must be existing members of ESSSuper at the time the competition is drawn.

6. Participants are responsible for ensuring that their contact details entered during registration are correct.

7. Only one entry will be accepted per member.

8. After the draw, the prize winners’ names only will be published on www.esssuper.com.au on 9 July 2012.

9. Any Members Online registrations or Member Detail updates submitted after 11:59 PM Saturday 30 June 2012 will not be eligible to participate in this promotion.

10. The draw will be held on Monday 3 July 2012 at 11:00 AM at ESSSuper Head Office, Level 16/140 William St, Melbourne, VIC 3000.

11. The Promoter’s decision in relation to all aspects of this competition will be final and binding on all participants. No correspondence will be entered into.

Prize

12. There are Three (3) prizes, each being an Apple iPad3 16GB WiFi to the value of $539.

13. The total value of the prize pool is $1,617

14. The winner will be contacted by email and phone. Delivery of the prize will be coordinated with the winner (depending on location).

15. Prizes are non-refundable, non-transferable, not redeemable and not exchangeable in whole or part for cash or services.

16. Participants are responsible for keeping their member account details up to date. If the winner of a prize cannot be contacted within 3 months after the conducted draw, the winner will be deemed to have forfeited any entitlement to the prize, and a new winner will be drawn on Wednesday 3 October 2012 at 11:00 AM at ESSSuper Head Office, Level 6/140 William St, Melbourne, VIC 3000. Redrawn members will be notified in writing.

17. The draw will be conducted by a draw panel appointed by the Promoter.

18. By entering this competition, an entrant agrees to receive marketing material from ESSSuper in relation to their superannuation held with ESSSuper.

General Terms and Conditions

18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents or associated agencies) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion or the prize offered as part of the promotion, including, but not limited to, where suffered or sustained out of the following: (a) any technical difficulties or malfunction or defect of any systems, software, telephone or other communication lines or other equipment or any unavailability of service (whether or not under the Promoter’s control); (b) any theft, destruction, unauthorised access or alteration or third party interference; (c) any entry or prize claim that is late, lost, incomprehensible, non eligible, incorrect, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; and/or (e) any participation in the prize.

19. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, ending of participating games or any other cause beyond the control of the Promoter that corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, at its sole discretion to the fullest extent permitted by law, to (a) disqualify any participant who is deemed by the Promoter to tamper with the process of this promotion; and/or (b) subject to any written direction given by a regulatory authority to modify, suspend, cancel or terminate the promotion, as appropriate. The Promoter assumes no responsibility for any loss or damage or consequence arising directly or indirectly out of an error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorised access to, or alteration of entries.

22. The Promoter and associated agencies will not be liable for any loss or damage whatsoever that is suffered (including but not limited to indirect or consequential loss and damages) or for any personal injury suffered or sustained in connection with the prize except for any liability that cannot be excluded by law.

23. The Promoter is not responsible for any lost, late, incorrect, inaccurate, incomprehensible or ineligible information, either caused by participants or for any of the equipment or programming associated with or utilised in the promotion or for any technical error, or any combination thereof that may occur in the course of the administration of the competition, including any omission, interruption, deletion, defect, delay in operation or transmission; communications line or telephone, mobile or satellite network failure; theft or destruction; or unauthorised access to or alteration of entries.

24. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside the Promoter’s reasonable control, the Promoter is entitled to cancel, terminate, modify or suspend the promotion, subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the promotion, if applicable.

25. The law implies various conditions and warranties which might apply to the Promoter supplying goods or services to the participant. The Promoter excludes all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose.

26. The Promoter may terminate or cancel the participant’s entry in the competition immediately at the Promoter’s reasonable discretion or if the participant breaches any of his or her obligations under these conditions.

27. As a result of the participant entering the competition, the Promoter will collect certain personal information about the participant. Unless the participant objects, this information may be used to (i) send news, information about other promotions or products and/or general marketing material, which the Promoter believes may be of interest to the participant; (ii) provide the participant with news, information and material in relation to the competition; (iii) monitor who is entering the competition; and/or (iv) profile participants. The Promoter may provide the participant’s personal information to third parties only where such information relates to, or is in connection with, one of the specified purposes, as set out in these Terms & Conditions.

28. The Promoter collects the participant’s information so that the participant can participate in the competition. The Promoter may use this information for the purposes of the conduct of the competition and the compilation of survey results and evidence. The Promoter may disclose this information to third parties who provide the Promoter with administrative services related to this competition. This information will be stored at the office of the Promoter. The Promoter will treat all personal information in accordance with the Information Privacy Act 2000 (Vic) and in accordance with its privacy statement (which may be found at www.esssuper.com.au). Any queries in relation to privacy may be addressed to the Privacy Officer of the Promoter. Participants may make a request under the Freedom of Information Act 1982 (Vic) to the Freedom of Information Officer of the Promoter if they would like details of their personal information held at: ESSSuper Level 16 140 William St, Melbourne, VIC 3000, Phone: 1300 650 161

29. By entering this competition the participant consents to the Promoter using and disclosing the participant’s personal information in the ways provided for under these Terms and Conditions. If the participant advises the Promoter not to use their personal information for any particular purpose, the Promoter will endeavour to take the necessary measures to meet the participant’s request. Exceptions to this are: (i) where the Promoter is required to disclose information by law; (ii) where the Promoter believes that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security as a necessary part of their business; and (iii) if the Promoter notifies the participant of an intended use or disclosure of personal information and the participant does not object to that use or disclosure.

30. The participant releases and agrees to keep the Promoter indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by the Promoter, its directors, employees, agents and representatives arising out of the participant’s entry in the competition, the use of the prize by the participant or any claim by a third party arising from an act or omission by the participant.

31. The Promoter is not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.

32. These conditions constitute the entire agreement between the participant and the Promoter as to its subject matter. By entering the competition, the participant accepts that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in Victoria, in accordance with the laws in force in Victoria from time to time.
