TERMS AND CONDITIONS

Carlton Dry Hello Swapsies Splendour in the Grass Ticket Giveaway Game of Skill - Conditions of entry 1 Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions. 2 Entry is open only to Australian residents aged 18 or over able to take prize between 26/07/2012 and 30/07/2012 except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies, companies or participating venue associated with this competition. 3 The competition begins at 12:00pm (AEST) on 04/07/2012 and closes at 12:00pm (AEST) on 18/07/2012 (Competition Period). 4 Entrants must, between 12:00pm (AEST) on 04/07/2012 and 12:00pm (AEST) on 16/07/2012: (a) visit the Carlton Dry Facebook page at facebook.com.au/carltondryaustralia (Website); (b) click on the “Promotions” tab and upload a photo depicting “What you would swap for the Carlton Dry Splendour in the Grass ticket giveaway” and fully complete and submit the online entry form including their full name, date of birth, email address, postal address, contact phone number, entry title and any other details as required by the Promoter (Entry). 5 Once the Promoter has viewed the Entry and deemed it acceptable (in its absolute discretion), the Entry will be placed on the Website for Carlton Dry Facebook Fans to vote for the best Entry. Voting begins at 12:01pm (AEST) on 16/07/2012 and closes at 12:00pm (AEST) on 18/07/2012 (Voting Period). 6 The Promoter will select the winner from the 10 best entries as voted by the Carlton Dry Facebook fans, based on originality and creative merit. The judges' decisions are final and no correspondence will be entered into. 7 The Promoter is not liable for any technical difficulty or error that results in any Entry being wholly or partly unavailable for online access, for any period of time. 8 By entering, entrants acknowledge that their Entry and their name may be made available online by the Promoter (in its absolute discretion) in which case they will be accessible to the general public. The Promoter may copy, in part or in its entirety, the Entry, cause the Entry to be seen and heard in public, and communicate the Entry to the public. It may also allow third parties to do these things. 9 Consumers may enter as many times as they wish provided that each entry is based on a different photo of “What they would swap for the Carlton Dry Splendour in the Grass ticket giveaway.” 10 The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified. 11 Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter’s discretion. This competition is a game of skill; chance plays no part in determining the winner. 12 The entrant assigns all rights (including copyright) in each Entry to the Promoter at the time of submitting an Entry. By entering this competition entrants: (a) consent to the Promoter making copies of or publishing the whole or any part of their Entry and otherwise exploiting the Entry and any rights in relation to the Entry, to publicise this competition or the Promoter’s products or for any other purposes; (b) undertake to the Promoter that their Entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights; and (c) consent to any act by the Promoter in relation to their Entry which would otherwise infringe their moral rights in the content of the Entry. 13 Once submitted, entrants cannot alter or delete their Entry. 14 By entering this promotion, the entrant warrants that each Entry: (a) is original and not copied, and was created by the entrant; (b) does not include any image of any other person in the photo without that person’s express consent; (c) does not include any content that contravenes any law, infringes the rights of any person or is obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate. Without limitation, entrants must not include any content that involves nudity or malice or which may be defamatory or in contempt of court; and (d) is consistent with the Alcohol Beverages Advertising Code, including that it does not feature persons under 25 years old or associate drinking with sports or driving. 15 The Promoter may (but is not obliged to) at any time reject and/or remove from access by the public or disqualify or invalidate any Entry that it considers (in its sole judgment) infringes these terms and conditions. The Promoter will have no liability to entrants in that regard. 16 There is one prize to be won. The prize is a trip for the winner and three companions (who must be 18+ years) to attend Splendour in the Grass 2012, at Belongil Fields, Byron Bay, NSW valued at up to $6,269 (inc. GST), depending on the winner’s place of departure. The prize consists of: (a) 4 VIP tickets to Splendour in the Grass 2012; (b) 4 return economy airfares (including airfare taxes) for the winner and three companions from the winners nearest capital city to Coolangatta, Qld; (c) return private transfers for the winner and three companions from Coolangatta airport to Byron Bay; and (d) 4 nights accommodation at “Tent City Hire” at Belongil Fields, Byron Bay for the winner and three companions. Accommodation includes 4 x two person tents including fold-up beds and mattresses. The winner and their companions must bring their own linen. 17 Flights, activities and accommodation are subject to booking and availability and the prize must be taken between 26/07/2012 and 30/07/2012 (inclusive). All other costs associated with the prize, including but not limited to any additional transfer costs, additional meals, additional taxes, additional insurance and other ancillary costs are the responsibility of the winner and his/her companions, as incurred. The winner and their companions must depart and return at the same time. The prize is subject to any additional terms and conditions specified by the prize supplier/s. 18 The Splendour In The Grass tickets prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The winner should visit http://splendourinthegrass.com and take note of items banned at the event and important information about the event itself and camping at North Beach. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize. 19 Where a prize includes travel or involves the winner attending an event: (a) the prize must be taken on the dates as specified by the Promoter and/or prize supplier to coincide with the event date; (b) if any part of the event is abandoned, called off, varied or postponed for any reason, then at the Promoter’s discretion, the relevant winner (and their companion/s, if applicable) forfeits all rights to attend the relevant event and no cash or alternative tickets will be substituted for that part of the prize; (c) the Promoter may in its absolute discretion prohibit an entrant’s participation in this competition, cancel a prize or otherwise cease to provide any benefit of a prize to a winner and their companion/s if the entrant or the winner (or their companion/s), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate (or of the business of the Promoter or any of its related bodies corporate), is contrary to law or is otherwise inappropriate; and (d) the travel prize must be booked and completed as specified by the Promoter and/or the supplier or organiser of the prize. Any accommodation or flights constituting part of the travel prize are subject to booking and availability. 20 The winner will be notified by phone and published on the Carlton Dry Facebook page at 5:00pm (AEST) on 19/07/2012. 21 The winner must claim their prize by 20/07/2012. If a prize remains unclaimed by that date, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to distribute the relevant prize to the next best valid entry. 22 If a winning entry is deemed not to comply with these conditions of entry that entry will be discarded and the Promoter will distribute the relevant prize to the next best valid entry. 23 The winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material. 24 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 25 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the prize. 26 The Promoter may require the winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion. 27 The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. 28 The prize is not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize or any element of a prize is unavailable for any reason the Promoter may substitute for that prize or element of a prize another item of equal or higher value as determined by the Promoter. 29 If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries. 30 The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. 31 The Promoter may communicate or advertise this competition using Facebook. The competition however, is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability. 32 The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol. Entry and continued participation in this promotion is subject to the relevant Venue’s liquor serving policy. 33 All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
