BIG BROTHER – BIG BROTHER SHUFFLE COMPETITION– GAME OF SKILL
CONDITIONS OF ENTRY
1. Information on how to enter forms part of the terms and conditions. Entry into this promotion is deemed acceptance of these terms and conditions of entry.
2. The promotion is open to all residents of Australia who are available to travel to the Gold Coast, QLD on a Sunday between 10 August 2012 to 30 August 2012 to coincide with the Launch Night of Big Brother 2012, except employees of the Promoter and their immediate families and all companies and agencies associated with this promotion.
3. To enter, entrants must record a 30 second video of either the entrant, another individual or a group of people (maximum 30 people in a group) doing the „Big Brother Shuffle‟. For clarity, The Big Brother shuffle must be the entrant‟s interpretation of the dance “The Shuffle”. The video and dance movement does not need to be to any specific music and/or artist.
4. Entrants must then, during the Promotional Period (as defined below), visit the official Channel 9 Big Brother Facebook page www.facebook.com/BigBrotherAU and then:
a) Indicate that they “LIKE” the page
b) Follow the prompts to the competition tab page, access the Big Brother Shuffle app on Facebook Application, input the requested details including the entrant‟s full name, address, day time telephone number, upload the 30 second video where indicated (a video must be no more than 5 MB) and submit the fully completed entry form as instructed.
The entry must not be, without limitation:
a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) discriminatory;
i) libellous;
j) threatening;
k) pornographic;
l) harassing;
m) hateful;
n) racially or ethnically offensive;
o) capable of encouraging of conduct that would be considered a criminal offence;
p) capable of violating any law;
q) capable of giving rise to civil liability.
5. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
6. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. 7. By submitting an entry in the Competition, all Entrants warrant to the Promoter that each visual entry media submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
8. All entry media submitted becomes the property of Nine Network. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entries to the Nine Network Australia Pty Ltd.
9. The promoter will not be liable for any breach of copyright. The entrant will be solely responsible for their own entry and the consequences of submitting them. The entrant represents and warrants that:
Their entry is their own and:
a) They own or have all necessary licences, rights, consents and permissions to use and authorize the promoter to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all entries to enable inclusion and use of the entries in the manner contemplated by these terms and conditions; and
b) They have the written consent, release, and/or permission of each and every identifiable individual person in the entry (including if the individual is a child – the child‟s parent or legal guardian) to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the entry in the manner contemplated by these Terms and Conditions
10. All decisions relating to the conduct of the Nine Network Australia and Promotion, including, but not limited to, the selection of any and all parts of an entry to be broadcast, and the awarding of prizes, are at the sole and exclusive discretion of Promoter and are final and not subject to appeal. The judge‟s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into.
11. Failure to comply with any term or condition may result in disqualification and/or forfeiture of Prizes at the Promoter‟s sole discretion.
12. This is a game of skill and chance plays no part in determining the winner. Each entry of the Big Brother Shuffle competition will be individually judged based on but not limited to talent, entertainment and creative merit. All decisions made by the promoter will be deemed final.
13. The Promoter reserves the right to verify the validity of entries at anytime during or after the promotional period, and reserves the right to disqualify any entrant who tampers with the
entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14. The Promoter‟s decisions in relation to all aspects of this promotion are final and binding on all who enter and no correspondence will be entered into.
THE PROMOTION PERIOD
15. The total Promotional Period commences on 3 July 2012 at 14:30 AEST and final entries close 23 July 2012 at 23:59 AEST (the Promotion Period).
16. All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.
17. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Entrants should not send in original copies of their entries. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing.
18. Multiple entries permitted, subject to the following: each entry must be submitted separately and in accordance with entry requirements and must be substantially unique
19. Each valid entry received during the Promotion Period will be submitted for judging. Judging will take place at the Promoters premises on 24 July 2012. Judging will be done by a panel of judges appointed by the Promoter. The winner will be notified by telephone and in writing.
20. Each entry will be individually judged based on its creative merit and suitability of the promotion. The judges‟ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
USE OF ENTRIES
21. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
22. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including (but not limited to) using the entries for broadcast purposes, social media purposes, online purposes, future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
23. Entrants may submit music with their videos for the purposes of judging only, but all broadcasted videos will be silent films only.
24. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.
THE PRIZE
25. The best entry (1) as determined by the judges will be deemed the major prize winner and will receive:
 Two (2) adults and two (2) children tickets to the launch night of Big Brother at Dream World on the Gold Coast including access to Dream world for one (1) day valued at up to $200.00
 Return economy flights to the Gold Coast, QLD from the winner‟s nearest capital city for Two (2) adults and two (2) children valued at up to $1977.00 (depending on point of departure)
 Two (2) nights‟ in a minimum three (3) star hotel for two (2) adults and two (2) children valued at up to $600.00
26. The total prize pool is valued at up to $2777.00 (depending on point of departure)
27. Prize must be taken to coincide with the Launch Night of Big Brother 2012 event and is subject to booking and flight availability. It is anticipated that the Launch Night of Big Brother 2012 event will take place on a Sunday between 10 August 2012 and 30 August 2012. Itinerary to be determined by the Promoter in its absolute discretion.
28. In the event that the winner is under the age of 18 years, they must be accompanied by their parent and/or legal guardian when redeeming the event based component of their prize.
29. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the scheduled event is relocated, postponed, rescheduled or cancelled for any reason whatsoever.
30. Prize does not include transfers to and from the winner‟s place of residence to the airport or hotel/ airport transfers. These costs are the responsibility of the winner.
31. Prize does not include travel to and from the event venue (unless specified). These costs are the responsibility of the winner. Frequent flyer points will not form part of the prize.
32. Redemption of the prize is subject to the standard terms and conditions of individual prize and service providers. The prize does not include any ancillary costs associated with redeeming the prize.
33. The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
34. It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.
35. The prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. The prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize subject to the standard terms and conditions and guidelines of the accommodation venue and the activity service provider. Failure to follow the standard rules and guidelines presented will result in the winner forfeiting their right to participate in the said activity.
36. All elements of the prize are subject to availability with no cash alternative and the prize package is non-transferable and non-refundable. The winner cannot change, vary, substitute or extend any element of the prize (in whole or in part).
37. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
38. If the prize or portion of the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, as appropriate.
39. The Launch Night of Big Brother 2012 ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
GENERAL CONDITIONS
40. The Promoter reserves the right to ask the prize winner to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
41. No compensation will be payable if the winner is unable to use the prize as stated and awarded.
42. The Promoter reserves the right to ask the prize winner (and companions) to sign a release as a condition of accepting the prize.
43. If the prize winner is disqualified in accordance with these conditions of entry, the Promoter reserves the right to award the prize to the next best entry as determined by the Promoter at its absolute discretion.
44. If for any reason this promotion is not capable of running as planned for reasons beyond the control of the Promoter, the Promoter may take any action available, including to cancel, terminate, modify or suspend the promotion, as appropriate.
45. The prize must be taken as offered.
46. The Promoter and their respective agencies and companies associated with this promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person‟s negligence) relating to this promotion or the awarding or taking of any prize, except for any liability which cannot be excluded by law. By entering this promotion, entrants accept and acknowledge full responsibility for their decision to participate in the promotion and in taking of any prize.
47. The Promoter and their respective agencies and companies associated with this promotion take no responsibility for prizes damaged in transit.
48. To the full extent permitted by law, the Promoter will not be liable to an entrant in respect of any claim for any loss or damage whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any personal injury suffered by an entrant as a result of or in connection with the Promoter‟s Promotion.
49. It is a condition of accepting the prize that the winner and companions agree to be interviewed, photographed and/or filmed at any time during the acceptance of the prize by the Promoter or their agents. There is no obligation upon the Promoter or to use such images or footage but if the Promoter elects to do so, the winner and companions consent to the Promoter using their name, likeness, image and/or voice in any media for the purpose of promoting this competition, (including any outcome), the Promoter itself, for an unlimited period of time without remuneration.
50. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest in and to their entry to the Promoter. Each entrant warrants to the Promoter that (a) each photograph/ clip/ material / entry submitted is an original artistic work of the entrant which does not infringe the rights of any third party, (b) if entering a clip/ photograph/ entry which includes an individual who is not the entrant, the entrant has obtained permission from the individuals appearing in the clip (including if the individual is a child – the child‟s parent or legal guardian. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry and to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes.
51. The Promoter collects entrants‟ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, including the entry itself, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
52. The collection, use and disclosure of personal information in connection with this Promotion is governed by the Promoter‟s Privacy Notice and these Terms and Conditions.
