Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to Australian residents aged 18 years or over, excluding: (a) employees of the Promoter or any of its related corporations or Western Digital or any of their agencies associated with the promotion or any retailers of Western Digital products; and (b) a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.

Promotion commences on 09/07/2012 and closes at 11.59pm AEST on 30/09/2012 (“Promotional Period”).

To be eligible to enter, the individual must, during the Promotional Period, purchase any of the following Western Digital product(s) (“Eligible Products”) from a participating Australian retail store:

To enter, individuals must then, during the Promotional Period, visit
www.westerndigital.com.au/batman (“Website”) during the Promotional Period, submit all requested information including serial number from the Eligible Product(s) purchased during the Promotional Period and follow the instructions to play the Batman game. At the completion of the Batman game, each entrant will be notified instantly in writing online whether or not they are an instant winner. All valid entries received from winners and non-winners of an instant prize will be automatically placed in the major prize draw.

To claim an instant win prize, instant win prize winners must visit the website and in accordance with the instructions, submit all requested information including their full street address and contact telephone number within fourteen (14) working days from the date of winning notification. Final claims for instant win prizes must be received by 11:59pm AEDST on 14/10/2012.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Incomplete or indecipherable entries will be deemed invalid.

Multiple entries permitted, subject to the following: (a) only one (1) entry/game play permitted per specified Eligible Product purchased during the Promotional Period; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of one (1) entries/game play per person per day is permitted.
10.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

The major prize draw will take place at Targetbase Integrated (Sydney), Level 32, 101 Miller Street, North Sydney, NSW 2060 on 02/10/2012 at 1.00pm AEST. The major prize winner will be notified by email within two (2) business days of the draw. The name of the major prize draw winner will be published in The Australian on 16/10/2012.The Promoter’s decision is final and no correspondence will be entered into.

The first valid entry drawn in the major prize draw will win a trip for the winner and one (1) guest aged 8 years or over from the nearest capital city in Australia to Los Angeles, California USA valued at up to AU$9,256 depending on date and point of departure. Prize cannot be taken during Australian or USA school holidays, public holidays or other peak periods.

During the VIP Warner Bros Studio Tour, the winner and their companion must meet any movie certification criteria in order to attend any movie related event at VIP Warner Bros Studio Tour. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The major prize winner (and his/her companion) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Frequent flyer points will not form part of the major prize. Major prize is subject to the standard terms and conditions of individual prize and service providers. The major prize winner may be required to present their credit card at time of accommodation check in.

Instant win prizes:

Any ancillary costs associated with redeeming a double pass are not included. Any unused balance of a double pass will not be awarded as cash. Redemption of a double pass is subject to any terms and conditions of the issuer including those specified on the double pass.

If for any reason a winner does not take a prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
17.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
18.
Total prize pool value is up to $180,606. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
19.
A draw for the major prize, if unclaimed, and any instant prizes that are won, but not claimed, may take place on 02/01/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw. In the case of a major prize draw winner, their name will be published in The Australian on 16/01/2013. In the case of any unclaimed double passes to The Dark Knight Rises, an alternate prize of Western Digital merchandise to the equivalent value of the pass will be awarded.
20.
Entrants consent to the Promoter and/or Western Digital Pty Ltd (ABN 85 099 469 486) (“Western Digital”) using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or Western Digital.
21.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. There will be a total of 13,500 winning instant win online notifications for this promotion.
24.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Western Digital (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Western Digital (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s or Western Digital’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) receipt and use of a prize.

As a condition of accepting the major prize, the major prize winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter and Western Digital collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter and Western Digital may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
