COMPETITION TERMS AND CONDITIONS

Information on how to enter the "Depend and Poise Ask You - What Would You Do If You Had More Time" competition (Competition) and how entries will be dealt with forms part of these Terms and Conditions. Submission of an entry into the Competition is deemed to be an acceptance of these Terms and Conditions.

The Competition commences on 2 July 2012 at 9am AEST and closes at 1 September 2012 at 9am AEST (Competition Period).

The Competition is organised by the Depend and Poise team at Kimberly-Clark Australia Pty Limited (Organiser) and is open only to citizens and residents of Australia over the age of 18 who are carers and/or nurses employed or contracted in a dedicated aged care facility in Australia. Employees (and their immediate families) of the Australian Ageing Agenda, the Organiser and their agencies associated with this Competition are ineligible to enter. Entrants can only enter in their own name. The Organiser reserves the right to request entrants to produce (within the requested time) appropriate photo identification or other documentation (to the Organiser's satisfaction) in order to confirm their identity. If this is not received as required, that entry will become invalid.
To submit an entry you must:
go to www.dependprofessional.com.au;
click through to the competition page;
insert your full name, name of employer, your current position, contact address, phone number and email address;
provide your answer to the competition question: "In 25 words or less, Depend and Poise ask you what you would do if you had more time";
tick the box if you wish to receive correspondence from Kimberly-Clark;
press the enter button to finalise your entry.
To be eligible, the entry must (always having in mind that the internet is a public domain) not use any inappropriate words or be offensive.
Entries are deemed to be received at the time of receipt by the Organiser. Records of the Organiser are final and conclusive as to time of receipt. All submissions must be the sole work of the entrant, and the entrant must have all necessary consents in order to provide any submission for the proposed uses set out in these Terms and Conditions. All submissions will be reviewed by a moderator nominated by the Organiser for adherence to these Terms and Conditions. Submissions (including any part of the submission) which do not meet the criteria will be considered invalid.
By entering the Contest, in relation to your entry and any part thereof (Work), you:
declare that the Work is your own original work and not copied in whole or in part from any other person living or dead;
declare that to the best of your knowledge and belief the Work does not infringe the intellectual property rights of any third party. "Intellectual property rights" means all copyright, trade secrets, confidential information, trade mark, design, patent, trade name or other proprietary rights to registration of such rights;
agree that the Organiser and the Organiser's agents, licensees and assigns are entitled to use and reproduce the Work (and any part thereof) for any purpose whatsoever worldwide, including display in television commercials or online at the Website (indefinitely) and uses which, in the Organiser's opinion, are in connection with the promotion and sale of its products and services in any geographic region worldwide without restriction;
waive any right to inspect or approve any use or reproduction by or on behalf of the Organiser of any part of your Work, including any written copy or proofs that may be created in connection with the Work (including any photograph);
consent to reproduction of your name and other parts of your entry without limitation (including in any media);

consent to the Organiser and the Organiser's agents, licensees and assigns using your Work for promoting the Organiser's products and services without attributing to you the authorship of the Work, without you inspecting or approving the Work, and also to the extent that the Organiser's use of the Work materially alters or distorts the Work (whether by changing, adding to or deleting/removing any part of the Work).

The purpose of this Promotion is to acknowledge and provide recognition of the dedication of carers on the front line in aged care facilities across Australia. Entry is not dependent in any manner on, nor intended to reward, ordering or using any particular product. By entering this Promotion, each entrant acknowledges that this promotion only relates to the Organiser's Poise and Depend continence products; not to any medical technology or other therapeutic good. Entering this Promotion shall not obligate any entrant or its employer to purchase, use, recommend or arrange for the use of any product of the Organiser or its affiliates.

Each entrant, by entering the Competition, warrants that their entry into the Competition, and acceptance of any prize (including the Major Prize), is consistent with any industry code which applies to them, and consistent or otherwise approved by the aged care facility at which they work. Should this not be the case, the Organiser has the right to disqualify the entry.
There will be no chance to withdraw any entries from the Competition, unless the Organiser determines in its absolute discretion to do so.

There will be ONE major prize (Major Prize) winner and TEN consolation prize (Consolation Prize) winners chosen by a judging panel organised by the Organiser based on skill; considering the originality and creativity of the entries with respect to the Competition Question. The judging will take place during 3–14 September 2012.

Winners of the Major Prize and the Consolation Prizes (Prize Winners) will be notified by email by the end of September 2012. The names of the Prize Winners will be published in the November/December edition of Australian Ageing Agenda and on the Website.

The Major Prize is a two (2) day 'Healthy Lifestyle Weekend' for two people sharing a one bedroom villa at the Golden Door Health Retreat – Elysia (Retreat) in Pokolbin, NSW. The prize includes:
Return economy flights for two people to Sydney;
Transfers to and from Sydney airport to the Retreat;
Luxury villa accommodation for two nights;
Breakfast, lunch and dinner for each person the duration of the stay;
Diverse selection of group fitness activities, relaxation classes and a daily program of health education seminars and workshops;
Use of all retreat facilities including pool, spa, steam room, tennis courts, gymnasium, activity studios and outdoor relaxation area; and
One complimentary spa treatment per person – choice of a facial or Swedish massage.

The winner will be notified via telephone, and the Golden Door voucher detailing all the prize inclusions will be sent in the post. The terms and conditions of that voucher will apply to redemption of the prize. Winner may be requested to sign a further release form in relation to redemption of the prize.

The Major Prize is valid for 12 months from the end of the Competition Period. Other terms and conditions imposed by the operators of the Retreat will also apply, including in relation to block out periods including school holidays and public holidays and cancellation or date amendment fees (and you will be responsible for any such fees).
The approximate retail value of the Major Prize is up to $4,000.

Each Consolation Prize is a luxury bathrobe, with approximate retail value of up to $100. Each Consolation Prize will be sent to the relevant Prize Winner within two weeks following the Competition Period.

The Major Prize and Consolation Prizes (or any part of them) are not transferable and cannot be exchanged or redeemed for cash.

None of the Major Prize or the Consolation Prizes (or any part of them) can be exchanged or refunded at any retail outlet.
The approximate retail values of the Major Prize and the Consolation Prizes are accurate at the date of printing, and no responsibility is accepted for any variation in the value of the Major Prize or Consolation Prize after that date. The Organiser retains the right to substitute the Major Prize or any Consolation Prize with an alternative product(s) of equal to greater value (including where the Major Prize or any Consolation Prize is unavailable for whatever reason).

The Prize Winners are solely responsible for any costs incurred in connection with their claiming or redeeming of the Major Prize or Consolation Prize (as applicable), such as any additional costs required for travel or any spa treatments or activities not included as part of the Major Prize.

The Organiser is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the internet.
The Organiser reserves the right to use any entries in the form of a name and/or the response to the Competition Question for the purposes of advertising, trade and/or publicity, irrespective of whether or not the entrant of that entry won a prize, without any prior notice to the relevant entrant and the entrant shall not be entitled to claim ownership or other forms of compensation on any such materials used by the Organiser.
The organiser reserves the right, in its sole discretion, to verify the validity of entries and reserves the right to disqualify any entrant that is found or suspected of tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions.
Organiser reserves the right to rejudge in the event of any entrant being unable to satisfy these competition conditions or forfeiting or not claiming a prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, Organiser reserves the right to award the prize to the entry judged as the next most creative entry received. The winner will be notified by email.
All entries become the property of Organiser. All entries will be entered into a database and Organiser may use the entrants' names, addresses, telephone numbers and the winners' names and addresses and photographs for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
Organiser shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law. Organiser shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services.
If for any reason this competition is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of Organiser, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, Organiser reserves the right (subject to any applicable law) in its sole discretion to disqualify any individual who tampers with the entry process.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; Organiser may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
