The IGA Spring Clean Out Promotion (âthe Promotionâ) is provided by METCASH FOOD & GROCERY PTY LIMITED ABN 67 004 391 422 of 50 Waterloo Road Macquarie Park (âthe Promoterâ).
These terms and conditions (including without limitation the information on how to enter and prize details which we publish in relation to the Promotion) form part of the conditions of entry to the Promotion. By entering the Promotion, you acknowledge that you have read and understood, and agree to be bound by these terms and conditions.
IF YOU DO NOT ACCEPT THESE CONDITIONS YOU MUST NOT ENTER THE PROMOTION. Entering the Promotion
The Promotion runs from
Monday 20 August 2012 at 00.01am Australian Eastern Standard Time (AEST) until Sunday 16 September 2012 23:59pm AEST (âPromotional Periodâ).
Entry is open to all Australian residents except for residents of TAS or NT.
Directors, Management, employees and immediate family members of the Promoter and all agencies associated with this Promotion are ineligible to enter the Promotion.
If you are aged under 18, you must seek the consent of your parent or legal guardian before entering the Promotion.
To participate in the Promotion and to be eligible for a chance to win a prize, a person must, during the Promotion Period:
Purchase any two products from any one of the following brands: Chux, Ambi-Pur, Duck, Vanish Napisan, Omo, Ajax, Harpic or Pine O Cleen (Eligible Products) from a participating Supa IGA, IGA, IGA Xpress or Franklins Store;
Complete the entry form available online at
www.iga.com.au by entering their details in the locations provided on the website (including entrantâs name, address, email address, phone number, store and State/Territory of purchase, purchase date and time along with the total purchase amount as shown on your qualifying purchase receipt); and
keep each receipt they use to enter the Promotion .
Only one (1) entry per valid sales transaction is permitted however a person may make multiple entries into the Promotion, so long as they hold a receipt for each entry which they make to the Promotion. A receipt representing each transaction for which an entry form was completed will be required as proof of purchase before any prize is awarded.
Any form of automated entry using any automated device or software will be deemed to be invalid. We reserve the right to verify the validity of entries and to disqualify any entrant (and all their entries) who tampers with the entry process or who submits an entry that is not in accordance with these conditions.
All entries are deemed to be received at the time of receipt into the Promotion/subscriberâs database and NOT at the time of transmission by the entrant.
FAILURE TO PROVIDE ALL PURCHASE RECEIPTS FOR EACH ENTRY LODGED BY AN INDIVIDUAL ENTRANT MAY, IN THE ABSOLUTE DISCRETION OF THE PROMOTER, RENDER ALL THAT ENTRANTSâ ENTRIES INVALID.
Prize Draws
There are 4 Holden Barina prizes to be won. A computerised electronic prize draw in respect of each prize will take place at 11am AEST at Salmat Digital, Level 2, 116 Miller Street, North Sydney NSW 2060 on the following dates:
DRAW 1: Monday 27th August
DRAW 2: Monday 3rd September
DRAW 3: Monday 10th September
DRAW 4: Monday 17th September
If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
Holden Barina Prize
The first entry drawn on each of the above dates will win a Holden Barina 1.6L MY11 5 door hatch, with automatic transmission, alloy wheels and metallic paint. This prize includes all compulsory insurances and registration. Selection of colour of prize awarded is at the complete discretion of the Promoter and is subject to availability. The Promoter takes no responsibility for any mechanical, body or paint repairs from the date and time of collection of the prize. Winner must have a current valid Australian driverâs license. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such winner may assign the motor vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. The winner will be responsible for any expenses incurred in transport to and from their nearest authorised Holden dealership in order to collect the prize.
Total prize value is up to $85,838.20 ($21,459.55 per Holden Barina) including all on-road costs (on-road costs vary state by state). Additional insurance, additional options, petrol, taxes, and all other ancillary costs are the responsibility of the winner. Prize values are correct at the time of printing.
The Holden Barina will be made available to the winner within 28 days of the winning entry being drawn subject to the provsion, by the winner, of all required documentation to enable the winner to drive away the Holden Barina from their nearest authorised Holden dealership. If the winner fails to return the required documentation within 3 months of the closing date they will forfeit their prize and the prize will be entered into the unclaimed prize draw.
Notifying and Delivering Prizes
The Promoter will endeavor to contact all winners in writing via email within 2 Business Days of the Promotion being drawn. Contacted participants must provide their receipt(s) in order to validate their entry and confirm their address details.
All Prize Winners will have their name and postcode published in the Public Notices section of The Australian Newspaper on Thursday 11 October 2012.
Subject to the entry being validated the prize will be sent or available for collection (at the Promoterâs absolute discretion as to mode or method of delivery) by the winner within 28 days of the date the winnersâ entry is verified by the Promoter.
If any prize winner is under 18 years the prize may, in the Promoterâs absolute discretion, be awarded on their behalf to their parent or guardian.
Unclaimed Prizes
If any prizes remain unclaimed by close of business on Tuesday 8 January 2013, the Promoter may conduct an unclaimed prize draw at the same place as the original prize draw on Tuesday 22 January 2013 at 11am to award any unclaimed prizes, subject to any written directions from any regulatory authority. The winner of any unclaimed prize will have their name and postcode published in the Public Notices section of The Australian Newspaper on Thursday 7 February 2013.
The Promoter will contact the unclaimed prize draw winner via email within 2 business days of them winning their prize to confirm their address details.
Disclaimers
For the purposes of this âDisclaimerâ section âwe/us/oursâ means the Promoter and âyou/yoursâ means any entrant into the Promotion.
We are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of the Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
We are not responsible for lost, late, incomprehensible or incorrect entries in the Promotion. We also accept no responsibility for any tax implications that may arise from prize winnings in the Promotion. You should seek Independent financial advice about such matters.
In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the Promotion - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the Promotion.
If for any reason the Promotion is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various regulatory bodies), to cancel, terminate, modify or suspend the Promotion.
Exclusions and our liability
We shall not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the Promotion or accepting any prize offered as part of the Promotion, except for any liability which cannot be excluded by law.
The law implies various conditions and warranties which might apply to us supplying goods or services to you. We exclude all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose.
Provisions of the Competition and Consumer Act 2010 (Cth) and other statutes in some cases either cannot be excluded, restricted or modified; or can only be restricted or modified to a limited extent. If any of those provisions apply, then to the extent permitted our liability under those provisions is limited as set out below. Our liability in relation to goods we supply is limited at our option to: a) replacement of the goods or the supply of equivalent goods; or b) repair of the goods; or c) payment of the cost of replacing the goods or of acquiring equivalent goods; or d) payment of the cost of having the goods repaired; and our liability in relation to services we supply, is limited at our option to: a) the supplying of the services against; or b) the payment of the cost of having the services supplied again.
Virus Warning
In entering the Promotion, you assume the risks and responsibility for any loss, damage or consequence resulting directly or indirectly from viruses, damage or other defects.
Termination
We may terminate or cancel your entry in the Promotion immediately in our reasonable discretion or if you breach any of your obligations under these conditions.
Your personal information
As a result of you entering the Promotion, we will collect certain personal information about you, such as your email address and mobile telephone number. Unless you object, this information may be used to
send you news, information about our other promotions or products and/or general marketing material which we believe may be of interest to you;
provide you with news, information and material in relation to the Promotion;
monitor who is entering the Promotion; and
profile entrants.
We may share your personal information for any purpose incidental to your entering into, and our operation of the Promotion.
All entries become the property of the Promoter. By entering the Promotion, you are agreeing to receive further information from us delivered via email to the email address you registered when entering the Promotion.
We collect your information so that you can participate in the Promotion. If you do not give us the information, you cannot participate. We may use this information for the purposes of the conduct of the Promotion and the compilation of survey results and evidence. We may disclose this information to third parties who provide us with administrative services. This information will be stored at the office of the Promoter. Entrants may access, change and/or update their personal information (including by electing to unsubscribe from further communications) and obtain a copy of the Promoterâs privacy policy at the Promoterâs website or by contacting the Promoter on (02) 9741 3000 during office hours.
By entering the Promotion, you consent to us using and disclosing your personal information in the ways set out in this clause. We will not otherwise disclose your personal information to third parties.
If you advise us that you do not wish us to use your personal information for any particular purpose, we will endeavour to take the necessary measures to meet your request. Exceptions to this are:
where we are required to disclose information by law;
where we believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security as a necessary part of their business; and
if we notify you of an intended use or disclosure of your information and you do not object to that use or disclosure.
Telephone equipment and network access
You are responsible for ensuring that you have online access required to enter the Promotion.
You indemnify us
You release and agree to keep us indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your entry in the Promotion or any claim by a third party arising from an act or omission by you.
Failure to comply and severability
We are not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.
Entire agreement and governing law
These conditions constitute the entire agreement between you and us as to its subject matter. By entering the Promotion, you accept that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in New South Wales, in accordance with the laws in force in New South Wales from time to time.
