1.Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. All times stipulated in these Terms and Conditions are expressed in 24 hour time and are either AEST or AEDST, as applicable.
2.Entry is only open to Australian residents aged 25 years or over who hold a valid unrestricted driver’s licence, which they must have held for a minimum period of 3 years. Employees (and their immediate families) of the Promoter, participating retailers, agencies and suppliers associated with this promotion are ineligible to enter. Employees of the Promoter include employment agency employees who are currently performing work for the Promoter.
3.Promotion commences at 00:00 on 16/08/2012 and ends at 23:59 on 17/10/2012 (“Promotional Period”).
4.To be eligible to enter, Eligible Entrants must, during the Promotional Period, purchase any amount of either: 1.Shell V-Power petrol from any participating Coles Express site in NSW, VIC, QLD, WA, ACT or SA; or
2.Shell Unleaded 95 or Shell Premium Unleaded from any participating Coles Express site in TAS, NT or WA.
Entry is not available for Shell Card, Fleet Card, Motorcharge or Motorpass purchases. It is the Eligible Entrant’s responsibility to request a purchase reciept if one is not provided upon purchase of the product.
5.To enter, Eligible Entrants must then, during the Promotional Period; 1.Either, visit

Entrants who enter using multiple phone numbers /email addresses and/or aliases may be disqualified. In the event of a dispute regarding a prize awarded to an SMS entrant, the prize will be awarded to the owner of the relevant mobile phone number. SMS entries via the Internet are ineligible.
6.SMS winners will be contacted by SMS and/or phone and, if necessary, the Promoter will record their address details so that the prize may be awarded. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.
7.The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.Incomplete or indecipherable entries will be deemed invalid.
9.Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements. All entries must be received during the Promotional Period.
10.Eligible Entrants must retain their Coles Express service station purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s entries and forfeiture of any right to a prize. The promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure, or otherwise. 17.The first valid entry drawn in each weekly prize draw will each win a Luxury Weekend Escape prize package, for two adults (2) in Sydney NSW valued at up to $5,085.00 depending on point of departure. Prize must be taken on Friday 8 to Sunday 10 February 2013 (“Luxury Weekend Escape Prize”). The Luxury Weekend Escape Prize consists of:
•Return flexible economy class airfares for two (2) adults from winner's nearest Australian capital city to Sydney, NSW (if necessary);
•All airline & airport taxes;
•Return private car airport/accommodation transfers (if necessary);
•Two (2) nights’ twin share five (5) star accommodation, including breakfast each morning; plus lunch and dinner on Saturday
•Spa treatment – two hour treatment per guest
•One (1) day of driving on a set route (“Drive Day Experience”); and
•Fuel and insurance for the Drive Day Experience
18.The Drive Day Experience will be supplied by Adrenalin and Sportscar World Rentals and must only be driven by persons who meet the entrant criteria specified in Clause 2. The Drive Day Experience will be subject to Adrenalin and Sportscar World Rental’s standard terms and conditions, which are available at

Winners of a prize will procure that any other person who intends to drive a vehicle also satisfies the same criteria, and authorise Sportscar World Rentals to make enquiries with the local traffic authority in relation to the validity of any participant’s driver’s licence. Insurance is included as part of each prize on the provision that all drivers agree to pay an ‘at-fault’ insurance excess of up to $12,000 in the event that they are responsible for any damage. Further, the winner will be required to supply a credit card to allow a $2,000 pre authorisation deposit to be taken. The deposit will be refunded to the winner in full following return of the vehicle undamaged.
19.The model and type of vehicles that will be made available to winners depends on availability at the time the Drive Day Experience is taken. In the event a certain car is not available, a suitable replacement (determined by the Promoter in its absolute discretion) will be offered.
20.In the event of a delay or cancellation of the Drive Day Experience (due to unforeseen circumstances such as dangerous weather, road closures, or mechanical repairs), Sportscar World Rentals will notify winners of the cancellation and a voucher will be provided allowing the winner to choose an alternative date for the Drive Day Experience, valid for 12 months and subject to booking and availability. In the event the original date for the Drive Day Experience is cancelled the winner can choose an alternative date for the Drive Day Experience, however all other elements of the Luxury Weekend Escape prize including airfares, transfers, accommodation and meals must be taken on Friday 8 to Sunday 10 February 2013. All ancillary costs associated with taking the Drive Day Experience on an alternative day, including travel to and from Sydney, NSW and any accommodation required, will be the responsibility of the winner.
21.If a winner of a Luxury Weekend Escape Prize is from NSW, then the prize does not include airfares, airport/accommodation transfers, airline and airport taxes and the airfares, transfers, airline and airport taxes components of the prize are not redeemable for cash.
22.Additional spending money, meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner and his/her companion are responsible for ensuring that they have valid travel documentation.
23.Frequent flyer points will not form part of the Luxury Weekend Escape Prize. The winner of a Luxury Weekend Escape Prize may be required to present their credit card at time of accommodation check in.
24.Itinerary of the Luxury Weekend Escape Prize is to be determined by the Promoter in its absolute discretion.
25.Luxury Weekend Escape Prize is subject to the standard terms and conditions of individual prize and service providers.
26.The winner of a Luxury Weekend Escape Prize and his/her companion/s must depart from and return to the same departure point and travel together.
27.As a condition of accepting a Luxury Weekend Escape Prize, the winner (and his/her companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
28.Subject to the unclaimed prize draw clauses, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited and not be redeemable for cash.
29.If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
30.Total prize pool value is up to $77,265. Prizes are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.
31.A draw for any prizes that are won, but unclaimed, may take place on 18/01/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by will be notified in writing within two (2) business days of the draw. The winners’ names will be published online at
www.shellvpowerclub.com.au on 21/01/2013. In the event of VIC or SA winners, their names will also be published in The Australian on 02/02/2013.
32.Eligible Entrants consent to participating in any publicity activities as determined by the Promoter in its absolute discretion, including using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. If a winning entry is deemed not to comply with these conditions of entry, that entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry.
33.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud,the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrants; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
34.Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
35.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 36.Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) if the Luxury Driving Experience event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or Eligible Entrant; or (g) use of a prize.
