SHARE A 'COKE' CAN PROMOTION
The Share a COKE can promotion is accessed via the coca cola.com.au website and allows registered user of the website to order up to 10 COKE cans with the names that they request to share their COKE with printed on the can. These terms and conditions ("Promotion Conditions") include all information on how to participate and purchase the cans displayed on the Promotion Website or in other advertising materials.
Steps for requesting a Share a COKE can:
1) You must visit the
www.coca-cola.com.au website ("Promotion Website") and follow the directions to register for a Coca Cola Account (unless you have a Coca Cola Account already).
2) To register for a Coca Cola Account, you must provide an email address, your date of birth, first name, last name, a password, contact number and your postcode and state. You may only register once for a Coca Cola Account.
3) Then, you must log on using your Coca Cola Account and you may order up to a maximum of 10 COKE cans via the Promotion Website by following the instructions on the Promotion Website. You can order this in a single order or in any combination up to 10 orders. It is cheaper, however, to make 1 order of 10 COKE cans.
4) Your order must comply with the Promotion Conditions. All names that you order are subject to our verification, and if you request an inappropriate word or name, we will contact you to request an alternate name. If you do not provide an appropriate alternative within 72 hours of our contact to you, your order may be invalidated.
5) You are required to pay for the cans that you order using a credit card. The costs of your order are stated on the Promotion Website (see "Cost & Shipping Breakdown" link). All costs are stated in Australian dollars.
By ordering cans you accept the Promotion Conditions, including but not limited to the following:
a.
The Promotion is open from 00:01 am Australian Eastern Standard Time on 13 August 2012 until 24:00 pm Australian Eastern Daylight Savings Time on 31 December 2012.
b. You must be aged 16 years or older to participate and be a resident of Australia. If you are aged between 16 and 18, you must have your parent's or guardian's permission to participate in this Promotion. c. You may order the COKE cans via the Promotion Website only. We do not accept phone or email orders. Once your order is placed and your credit card has been charged, the order cannot be changed or revised in any manner.
d. Any cost associated with accessing the Promotion Website is your responsibility and is dependent on the internet service provider you use. We will not accept orders made using automated entry software or any other mechanical or electronic means.
e. Every name that you request us to print on a COKE can must be the name of a real person, who is known to you, and who you could reasonably expect would like you to give them a COKE can with their name on it. When you complete the purchase instructions via the Promotion Website, you authorise us to print the name.
f. We will not print nor authorise the printing of a name or image that is illegal, obscene, derogatory, threatening, violent, scandalous, inflammatory, discriminatory (on any grounds), or would give rise to or encourage conduct which is inappropriate or illegal or which is otherwise unfit to be displayed. We won't print a name or image which is a 3rd party's intellectual property or which is clearly not yours or your friend's, such as a celebrity's name. You must not use a name that does not comply with this condition. We decide when this condition applies.
g. Check the name graphic generated by the Promotion Website closely to ensure it is correct. We will not reprint any cans that have been printed in accordance with the order, or because you have made an error in your order. You cannot save or retain the graphic generated and displayed by the Promotion Website which is provided for verification purposes only, and you should not attempt to retain it under any circumstances.
h. We are providing the can for your own personal use, or to give to a friend or loved one for their own personal use. The can is not provided for any form of commercial use, whatsoever. No can recipient may sell the can or the image on the can. No can recipient is granted rights in any of the intellectual property on the can, including the rendering of the name and the image of the can. Just enjoy it privately.
i. We recommend you consume the contents of the COKE can on or before the 'best before' date shown on the can. If you want to keep it after the 'best before' date, we recommend you empty the can (preferably by enjoying it!), and wash it out.
j. Your can order is not transferable, exchangeable, nor redeemable for cash. Neither the can, nor any image or the can, may be sold at any cost for any reason.
k. We accept no responsibility for any orders which are not received for any reason. We are not responsible for lost, late or misdirected entries. You must check all details entered on the Promotion Website carefully to ensure they are correct. We are not liable for orders which are stolen, damaged or tampered with in any way before they reach you. We are not responsible for any incorrect or inaccurate information, whether caused by Promotion Website or Coca Cola Account users or by any of the equipment or programming used in in association with the Promotion.
l. We accept no liability at all for any loss (including claims, damages, injury, costs or expenses) which is suffered by you or anyone else for any reason in connection with this promotion, to the fullest extent permitted by law.
m. If you do not comply with these conditions, we may take any items from you that you have created in breach of these conditions, and otherwise take action to protect our rights in our intellectual property and products.
n. We will be collecting your personal information to provide the can(s) to you. Check the Promotion Website for our Privacy Policy and to find out how we safeguard it. Your use of the Promotion Website is also subject to the Promotion Website Terms of Use.
