2. Competition Schedule
2.1 The competition opens on 15 August 2012 and has six (6) separate weekly rounds of the competition and one (1) final round of the competition, with each of the six (6) weekly rounds corresponding to the dates set out in the Competition Schedule below. All times in the Competition Schedule are Sydney time. All unsuccessful entries for a certain judging round (being entries submitted in a judging round that do not win one of the relevant five Weekly Winner Prizes for that round) will not be carried over for consideration in subsequent weekly rounds.

2.2 In each of the six (6) weekly judging rounds of the competition, five (5) weekly winners will be selected. There will be a total of thirty (30) weekly winners (“Weekly Winners”). Each Weekly Winner is a finalist and from these 30 finalist entries, the one (1) major prize winner (“Major Prize Winner”) will be judged at 5:00pm (Sydney Time) on Friday 28 September, 2012.
2.3 The one (1) Major Prize Winner will be selected from the 30 Weekly Winners’ winning entries.
3. Prizes
3.1 There will be one (1) major prize winner (“Major Prize Winner”) and thirty (30) weekly winners (“Weekly Winners”).
3.2 Major Prize
The Major Prize Winner will win a prize for themselves and one (1) guest consisting of:
a. Two (2) x return economy airfares from Major Prize Winner's nearest Australian state capital city to Ballina, including on-flight meals, taxes and checked luggage allowance (valued at a maximum of $1,850.00).
In the event that the Major Prize Winner lives within 200kms of Byron Bay, this part of the prize in condition 3.2(a) is forfeited and the Major Prize Winner must arrange their own travel to Byron Bay;
b. Car hire for 5 days of a Ford vehicle valued at up to $696.88. Pick up from and return to Ballina airport. Conditions of use apply to the car hire.
c. 5 nights accommodation for 2 people twin share in 1 room at The Byron at Byron Resort and Spa at 77-97 Broken Head Road, Byron Bay (to maximum value of $2250.00).

e. AU$250.00 spending money - Paid to Major Prize Winner by electronic funds transfer 2 weeks prior to travel date confirmed with the Promoter.
3.3 Other than the elements of the Major Prize specified above in Condition 3.2, the Major Prize does not include:
Meals, taxes, insurance, passports, visas, vaccinations, additional spending money, fuel for the hire vehicle, items of a personal nature, in-room charges and all other ancillary costs.
3.4 The Major Prize Winner can travel up to 12 months from the date of judging of the Major Prize Winner (being from Friday 28 September, 2012 to 28 September 2013). Travel must be booked within two months of the date that the Major Prize Winner is notified by the Promoter’s representative (“Booking Period”). Any date changes or other booking amendments made or requested to the booked travel after the Booking Period may incur charges and fees.
3.5 Use of the travel elements of the Major Prize (including but not limited to flights and accommodation) are subject to availability. The maximum total value of the Major Prize is $5296.88.
3.6 Each of the thirty (30) Weekly Winners will receive a Weekly Winner Prize being:

The total value of the Weekly Winner Prize Pool is $7,500.
3.7 The total value of the entire Prize Pool is $12,796.88.
3.8 The Major Prize and the Weekly Winner Prizes are collectively referred to as the “Prizes” and each of them is a “Prize”.
3.9 The judges' decision is final and no correspondence will be entered into.
3.10 All Prize items are valued inclusive of GST, are expressed in Australian dollars and the Promoter takes no responsibility for any variations in item values. The Prizes are not transferable, exchangeable or redeemable for cash. In the event that any Prize item is unavailable, the Promoter reserves the right to substitute a Prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a Winner receiving the Prize are the sole responsibility of the Winner.
4 Who may enter
The only persons who may enter and be awarded Prizes are residents of the place specified in Condition 1.1, who have attained the age specified in Condition 1.2 (if an age is specified in that condition), who are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition, or (ii) members of the immediate family of such employees and contractors.

"Immediate family" means spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor.

5 Entrants bound by conditions
By participating, entrants agree to be bound by these conditions.
6 How to enter
To enter, entrants must:
(a) Read and accept these Terms and Conditions;
(b) either:
(i) log onto

(ii) enter via VIEWA by:
A. downloading the VIEWA app on a compatible smartphone (iOS requires 4.3 or later; Android requires 2.2 – 2.3.7);
B. select the relevant ACP magazine channel; being the magazine title that the entrant has that is promoting this competition channel;
C. hold your compatible smart phone over the magazine page with the VIEWA symbol until content appears on the phone;
D. select to enter this competition and register their details (full name, address, daytime telephone number and email address, among other things);
and
(c) Answer the following question in 25 words or less:

7 Selection of winners
7.1 At the times and dates specified in the Competition Schedule, the judges will choose five (5) Weekly Winners for each of the six

(6) weekly rounds of the competition. The Weekly Winners will be the entrants who have been judged to have entered the most creative, humorous and original responses to the question asked in Condition 6(c) for their particular round of the competition.
At the time and date specified in Condition 1.8, the judges will choose one (1) overall Major Prize Winner selected from the thirty (30) entries awarded a Weekly Winner Prize which is the one entry that is judged to be the most creative, humorous and original response to the question asked in Condition 6(c).
7.2 Each entry will be individually judged based on literary and creative merit. Chance plays no part in determining each Winner.
7.3 The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the Promoter, includes objectionable or unlawful content, including but not limited to profanity, nudity, potentially insulting, scandalous, racist, sexist, inflammatory or defamatory images or language or which is otherwise unsuitable for publication.
7.4 Incomplete or indecipherable entries will be deemed invalid.
7.5 Entrants may submit more than one entry. Each entrant is eligible to win a maximum of one (1) Weekly Winner Prize.
8 Special conditions of entry
8.1 All entries must be:
a. the original independent creation of the entrant;
b. owned by the entrant; and
c. free of any claims, including copyright or trademark claims by other parties.
8.2 Entries must not:
a. have been published previously;
b. have won prizes or awards in other competitions;
c. be restricted in any way;
d. infringe any third party rights (including but not limited to intellectual property rights); or
e. contain viruses or cause injury or harm to any person or entity.

8.3 It is a condition of the awarding of each prize that the winner must, if requested to do so by the Promoter, sign and return any Affirmation of Eligibility to Enter, Ownership of Entry, and Release and Compliance statements provided to the winner by the Promoter. The failure to return the signed statements will result in the entitlement to the Prize being forfeited and the selection of another Winner.
8.4 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.5 All entries must be submitted by a person and any automated entries, fraudulent entries or entries by persons using an alias shall be invalid.
9 Limitations on entry
9.1 There is no limit to the number of entries per person, subject to the following:
(a) each entry must be substantially unique; and
(b) each entry must be submitted separately and in accordance with entry requirements.
10 Duration
This competition starts at the Sydney time and date specified in Conditions 1.3 and 1.4. Entries must be received by the Sydney time and date specified in Conditions 1.5 and 1.6.
11 Conditions of Major Prize (including travel) and prize acceptance
11.1 The Major Prize Winner is free to select any person as their guest.
11.2 No compensation will be payable if the Winner or their guest is unable to use the Prize as stated for whatever reason. Any part of the Prize which is not taken for any reason is forfeited.
11.3 The travel suppliers, including the airline, will be chosen by the agency appointed by the Promoter for the purposes of booking and fulfilling the Prize (referred hereafter as “the Booking Agency”). During the Booking Period the Major Prize Winner must notify the Booking Agency of the identity and age of their travel

companion and the dates they want to book the flights (if applicable), accommodation, car hire and other elements of the Major Prize. Unless the Major Prize Winner is otherwise advised by the Promoter, all travel arrangement bookings will be made by the Booking Agency.
11.4 Travel must be completed by 28 September, 2013
11.5 If the travel companion of the Major Prize Winner is under the age of 18, either:
a. the Major Prize Winner, who is above the age of 18, must be that travel companion’s parent or legal guardian; or
b. the minor travel companion’s parent or legal guardian must provide to the Promoter written consent in relation to that travel companion’s travel and participation in the Major Prize.
11.6 The Major Prize Winner can travel using the Major Prize up to 28 September, 2013. All travel arrangements must be booked during the Booking Period.
11.7 Travel must be booked within two months of the date that the Major Prize Winner is notified by the Promoter’s representative (“Booking Period”).
11.8 The Promoter accepts no responsibility for variations in the Prize value. The components of the Prize may alter for reasons beyond the Promoter’s control.
11.9 The components of the Prize must be taken together as a single trip to be booked by the appointed booking agency (as described in condition 11.3) and cannot be separated into different holiday vacations.
11.10 Any part of a Prize that is not taken for any reason is forfeited.
11.11 Travel and accommodation are for the Winner and their guest (if a guest is part of the Prize) travelling together.
11.12 The Prize cannot be exchanged for other travel or accommodation at other destinations.
11.13 Frequent flyer points will not form part of the Prize.
11.14 The Prize is subject to the standard terms and conditions of the respective products and services which constitute the Prize.

11.15 The Winner may be required to present a credit card at the time of accommodation check-in.
11.16 Once the booking is confirmed, changes to the booking may incur a fee, including GST plus supplier charges.
11.17 The Winner and their guest may be required to sign a liability waiver form to receive the Prize. Failure to sign the liability waiver form may result in the Winner forfeiting the Prize.
11.18 It is a condition of accepting the Prize that the Winner and their guest comply with all the conditions of use of the Prize and Prize supplier requirements.
11.19 All entrants acknowledge that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of a person's ineligibility to enter or be awarded a Prize after the Promoter has awarded a Prize to the ineligible person. In the event that a Winner is found to be ineligible to enter or disqualified after a Prize is awarded, the Promoter may require the relevant Winner to return their Prize or pay the Prize’s equivalent value to the Promoter.
12 No quality, etc, representations/exclusion of liability
12.1 The Promoter:
a. makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as Prizes;
b. accepts no responsibility for loss or damage to Prizes in transit;
c. accepts no responsibility for late, lost or misdirected registrations; and;
d. is not liable, to the extent permitted by law, for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the Prize Winner and, where applicable, to any family/persons accompanying the Winner.

12.2 If the prize involves entry to an event and/or transport and accommodation, the Winner and his or her guests must sign and return any liability release provided by the Promoter and/or its contractors as a condition of the Prize being awarded.
12.3 If the Winner or any guest/companion of the Winner is under 18 years old, the underage person must be accompanied by a parent or guardian who signs any liability indemnity provided by the Promoter as a condition of the Prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the Prize being forfeited and the selection of another Winner.
12.4 Clause 12 does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again.
13 Winner notification and publication
The winners will be notified by telephone and/or email, using the details provided in their entry, and the name and suburb of each Winner will be published as specified in Condition 1.9.
14 Use of Headings
14.1 Headings and subheadings are inserted for convenience only and shall not be used to interpret the text of these conditions in any way adverse to an interpretation in favour of the Promoter.
15 Ownership of entries
15.1 All entries and their content and the intellectual property rights therein (collectively referred to as the “Entry”) become and remain the property of the Promoter, and are hereby assigned to the Promoter absolutely as sole and exclusive owner. The owner of any copyright in the Entry consents to any use of the Entry which may otherwise infringe the owner's moral rights under the Copyright Act 1968 (Cth). 15.2 Entrants acknowledge and agree that their Entry may be published by the Promoter on the Promoter's website(s) and/or

by Ford Motor Company of Australia Limited ("Ford") on its website (if applicable) for promotional purposes. 15.3 Each of the Promoter and Ford reserves the right to use the content of any of the Prize winning entries for the purpose of future promotions in any media.
16 Internet
16.1 If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
16.2 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries.
16.3 The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
16.4 CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
17 LIABILITY, INDEMNITY AND RELEASE
17.1 In consideration for the Promoter accepting the entrant’s entry, the entrant releases and forever discharges each of the Promoter and Ford from all claims that the entrant may have or

may have had but for this release arising from or in connection with:
17.1.1 any entrant’s participation in this promotion;
17.1.2 the Winner’s acceptance and/or use of the Prize, and
17.1.3 the Winner’s guest’s acceptance and/or use of the Prize.
17.2 The entrant indemnifies and holds harmless each of the Promoter and Ford to the extent permitted by law in respect of any claim by any person (including but not limited to other entrants in the promotion or a Winner’s travel companion), arising as a result of or in connection with:
17.2.1 the entrant’s participation in the promotion;
17.2.2 the entrant's non-compliance with these Terms and Conditions;
17.2.3 the entrant's (and/or their guest's) acceptance and/or use of a Prize and
17.2.4 the entrant's (and/or their guest's) acts or omissions whilst at any of the Prize locations, venues or sites (including travel to and from such locations, venues or sites).
17.3 In this Condition 17, “all claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising.

20 Privacy
Entrant personal information ("PI") will be collected to enable the Promoter to administer and promote this competition and its Winners and, if an entrant consents, may be used by the Promoter to market its services to the entrant. The PI of Winners may be provided to others assisting in the competition, including Prize suppliers and deliverers, in connection with publishing Winners’ details in accordance with Condition 13 above. Entrants may contact the Promoter at the address given above to request access to any of their collected PI that is still held by the Promoter. If an entrant does not truthfully provide all requested PI, the Promoter may determine that they are not eligible to win a Prize.

21 Entire conditions
These conditions constitute the entire agreement of the parties relating to the entry and the conduct of the competition.
