The Promoter is LaCorium Health Australia Pty Limited (ABN: 29 089 285 861) of Level 3, 2A Lord Street, Botany NSW 2019 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions (“Terms and Conditions”).
1. Entry into the Dermal Therapy ‘Feet First Summer’ competition (the “Competition”) is open to all residents of Australia aged 18 years or older on the first day of the Competition Period, other than the officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, its related bodies corporate or the agencies associated with this Competition, (“Eligibility Criteria”), and who also meet the requirements specified in Condition 2 below.
2. Competition begins at 00.01 AEST on Saturday 1st September 2012 and closes at 23:59 AEDT on Friday 30th November 2012 (the “Competition Period”). To enter the Competition and be eligible to win, entrants must:
(a) satisfy the Eligibility Criteria;
(b) be employed by a pharmacy who has agreed to participate in the Competition;
(c) post a creative photo of trade display of the dermal therapy point of sale material on
www.dermaltherapy.com.au/feetfirst-trade: and
(d) complete an entry online at
www.dermaltherapy.com.au/feetfirst-trade Proof of employment is required to be eligible to win the Prize (as defined in Condition 5 below).
3. All entries must include the entrant’s name, name of pharmacy where they are currently employed, address of pharmacy where they are currently employed, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address (if applicable) and date of birth to be eligible for entry. All entries must be the original, independent creation of the entrant and must not incorporate material which has been previously published. Incomplete entries or those containing copyright material of third parties, pre-used, defamatory or offensive content will be ineligible to win the Prize. It is the entrant’s responsibility to inform the Promoter if their contact details provided change during or after the Competition Period.
4. Only 1 entry per pharmacy is permitted.
PRIZE
5. There are three (3) Prizes in total, valued at $500 each. Each Prize consists of:
(a) one (1) $500 Bank gift card (“Prize”).
6. The total value of all Prizes is $1500. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between the date the Terms and Conditions are published and the date the Prize is claimed. All Prize values are in Australian dollars.
7. The Prize is not transferable or redeemable for cash or other goods or services. The Prize or any element of the Prize cannot be exchanged for any other Prize. The Prize is subject to availability and the terms and conditions of the entities supplying the Prize. The Prize winner must contact the Promoter on 1300 55 55 97 or via email at
customerservice@lacoriumhealth.com.au within the time specified in Condition 12 to redeem the Prize.
8. The Prize must be taken as stated and no compensation will be payable if the Prize winner is unable to use the Prize as stated. Any unused portions of the Prize will be forfeited.
9. If a Prize or any part of a Prize cannot, in the opinion of the Promoter, be provided for any reason, then at its discretion the Promoter reserves the right to provide an alternative prize of approximately the same value as that part of the Prize being replaced.
10. The Promoter and its related bodies corporate and their respective officers, employees and agents (collectively, the “Promoter Parties”) will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with the use of any part of the Prize, except for liability which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
11. Without limiting Condition 18 below, if any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from, complying with the Terms and Conditions, the Promoter reserves the right to cancel, terminate, modify, suspend or recommence the Competition and will not be liable for any failure to perform or delay in performing its obligations.
JUDGING AND AWARD OF PRIZE
12. A panel of judges will be appointed by the Promoter. Subject to these Terms and Conditions, the best three (3) valid entries, as determined by the judges, will each win a Prize. The Competition will be judged on the basis of creativity at the Promoter’s offices at Level 3, 2A Lord Street, Botany NSW 2019 on or about Monday 3rd December 2012 at 3pm (AEDT). This is a game of skill and chance plays no part in the selection of the Prize winners. The Prize winner will be notified via phone on Monday 3rd December 2012 from 4pm (AEDT) and their names published on the
www.lacoriumhealth.com website from Wednesday 5th December 2012. The Prize must be claimed within 7 days of the publication of the Prize winner.
13. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date set out in clause 12, then the Prize will be awarded to the next runner up. In these circumstances, a substitute prize will not be offered in lieu of the Prize. The Promoter reserves the right to rejudge the Competition in the event that an entrant, who was initially deemed to be the winner, is unable to satisfy any of these Terms and Conditions.
AGE
14. The Competition is only open to entrants who are 18 years of age or over on the first day of the Competition Period. Entries submitted by entrants under the age of 18 will be ineligible.
GENERAL
15. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will not be eligible to claim the Prize in whole and no compensation will be offered.
16. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights, including without limitation copyright in their entry. Each entrant indemnifies the Promoter for any breach of the Terms and Conditions by the entrant. Entries that are found to have been derived from the work of another party will be considered invalid. The Promoter reserves the right to disqualify any entry it believes has breached any of these conditions.
17. To the maximum extent permitted by law, no responsibility will be taken by the Promoter for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning or utilising the Prize.
18. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prize to cancel the Competition or to vary or cancel the award of the Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
(a) the Prize winner does not satisfy the Competition entry requirements; or
(b) the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control.
19. In the event that the Promoter cancels the Competition or varies or withdraws the Prize no Promoter Party shall:
(a) be liable to any person for any loss or damage (including, without limitation, loss or damage caused by any negligence, or any direct, indirect or consequential loss) arising out of, or in connection with, such cancellation, variation or withdrawal; or
(b) be required to conduct the Competition at any other time.
20. No responsibility will be accepted by any Promoter Party for late, lost or misdirected entries, including those caused by technical malfunction or temporary shutdown of any communication network. All entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. No Promoter Party accept any responsibility for out-dated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
21. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
22. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law and without limiting the generality of any other provision of these Terms and Conditions (including without limitation Condition 10), no Promoter Party shall be liable for any loss or damage which is suffered (including but not limited to direct, indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.
23. Any costs associated with entering this Competition or claiming Prizes (such as internet service charges) are the responsibility of the entrant.
24. All entry details and any copyright subsisting in the entries become, and remain, the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which can be obtained by calling 1300 55 55 97. By entering the Competition, the Prize winner agrees to the use of their names, images, entry response, audio-visual recording and/or photograph/s, without compensation, and agrees that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s. The Prize winner accepts that they will not be entitled to any fee for such use.
25. The Prize winner agrees and acknowledges that tax implications may arise from their Prize winnings and that they should seek independent tax and financial advice prior to acceptance of their Prize.
