Scholl Party Feet – GRAZIA COMPETITION

1.   Variables

1.1   Resident of: Australia only.
1.2   Minimum age: 18 years
1.3   Start time: 12.01 am (AEST)
1.4   Start date:  3 September 2012
1.5   Closing times: 11:59 pm (AEST)
1.6   Closing date: 31 October 2012
1.7   Judging time: 12:00 pm (AEST)
1.8   Judging date: 2 November 2012
1.9   The name and State/Territory of the competition winner will appear on the GRAZIA website www.windreamheels.com.au on the competition page between 9 November 2012 and 30 November 2012.

2.   Prize

2.1   There will be one (1) winner of the competition.

2.2   The winner will receive a prize consisting of:

•   1 x NET-A-PORTER Gift Card for the value of £1000
(This prize is valued at approximately AU $1485.00 based an exchange rate published on 13/08/2012).
               
2.3   The total value of the Prize Pool is up to AU $1485.00

2.4   Full conditions of use relating to the use of the Prize are available at http://www.net-a-porter.com/Help/TermsAndConditions#giftcardsterms. The Prize is valid for redemption for 12 months from the date of issue listed on the voucher.  The Prize may be used to redeem against products on the www.net-a-porter.com INTL site.

2.5   The judges' decision is final and no correspondence will be entered into.

3.   Who may enter

The only persons who may enter and be awarded prizes are residents of the place specified in Condition 1.1, who have attained the age specified in Condition 1.2 (if an age is specified in that condition), who are not (i) employees of, or contractors to, the Promoter, the Prize Suppler, or the Sponsor, or any of its agencies involved with this competition, or (ii) members of the immediate family of such employees and contractors.

"Immediate family" means spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor.

“Prize Supplier” means ACP Magazines Ltd, ACN 18 053 273 546, 54 Park Street, Sydney 2000

“Sponsor” means Reckitt Benckiser (Australia) Pty Limited, ACN  003 274 655, 44 Wharf Road, West Ryde NSW 2114. 


4.   Entrants bound by conditions

By participating, entrants agree to be bound by these conditions.

5.   How to enter

There are two ways of entering the promotion. To enter, entrants must:

(a)   Read and accept these terms and conditions;

(b)   Log onto www.windreamheels.com.au, follow the prompts to the competition registration page and register their details (full name, address, daytime telephone number and email address, among other things); and Answer the following question in 25 words or less “Tell us in 25 words or less, why you love Scholl Party Feet.” And submit the entry as instructed; or

(c)   To enter, individuals must select the view a channel and hold the phone over the competition page in Cosmopolitan, Cleo, Grazia, NW or OK! magazine during the promotional period to follow the prompts to the competition page. Individuals must fill in the entry form including full name, address, current valid email address and daytime Telephone number and answer the competition question in 25 words or less “Tell us in 25 words or less, why you love Scholl Party Feet.” And submit the entry as instructed.


6.   Selection of winner

6.1   At the time and date specified Condition 1.7 and 1.8, the judges will choose one (1) winner.  This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

7.   Special conditions of entry

7.1   The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

7.2   The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

7.3   Entries must not be offensive, defamatory or racist.  Any entry which the judges deem inappropriate will be invalid.  The entrant agrees to indemnify the Promoter.

8.   Limitations on entry

8.1   There is no limit to the number of entries per person, subject to the following:

(a) each entry must be substantially unique; and
(b) each entry must be submitted separately and in accordance with entry requirements.

9.   Duration

This competition starts at the Sydney time and date specified in Conditions 1.3 and 1.4. Entries must be received by the Sydney time and date specified in Conditions 1.5 and 1.6.

10.   Winner notification and publication

The winner will be notified by telephone and/or email, using the details provided in their entry, and the name and State/Territory of the winners will be published as specified in Condition 1.9.

11.   Use of Headings

Headings  and  subheadings  are inserted  for  convenience  only  and  shall  not  be  used  to interpret the text of these conditions in any way adverse to an interpretation in favour of the Promoter.

12.   General

Vouchers are valid for twelve (12) months from the date of issue.  Redemption of the voucher prizes are be subject to the terms and conditions stipulated on the voucher. The Promoter will not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way. Any ancillary costs associated with redeeming a voucher are not included. Any unused balance of the voucher will not be awarded as cash.
All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.  In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ online, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ online. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.

In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize

In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster)the  Promoter reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.

If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.

If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.

Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
