1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and employees of agencies associated with this promotion (and their immediate families) are ineligible to enter.
3. Promotion commences on 01/09/2012 and final applications must be received by 11.00pm AEDST on 31/10/2012 ("Promotional Period").
4. To be eligible to enter, individuals must, during the Promotional Period, sign up and be approved for a Caltex StarCard Debit Card. To do so, individuals must, during the Promotional Period, visit,
https://partner.caltex.com.au/starcard-debit/prepaid/starcardintro.aspx, enter the promotional code "STAR54" as well as all other required information and submit their fully completed online application form which may be accepted or rejected in the absolute discretion of the Promoter.
5. The first ninety (90) applicants to have their application for a Caltex StarCard Debit Card approved by the Promoter will each be awarded an Events Cinemas Double Pass valued at $40.00each. Successful applicants will be notified in writing and sent their Events Cinemas Double Pass one (1) week from the date they receive their Caltex StarCard Debit card. Events Cinemas Double Passes are not valid for use at sessions from 5.00pm on Saturdays. Surcharges apply for VMAX and 3D screenings, and 3D glasses are sold separately. Applicants will be responsible for any surcharges incurred and the purchasing of 3D glasses (if applicable). The Events Cinemas Double Passes cannot be extended replaced or refunded and are invalid without an expiry date. The onus is on the holder to use the Events Cinemas Double pass before the specified expiry date. Applicants must comply with the terms and conditions of Event Cinemas available from
www.eventcinemas.com.au.
6. All approved applications received, (regardless of whether or not awarded an Events Cinemas Double Pass), will be placed into the major prize draw.
7. The Promoter reserves the right, at any time, to verify the validity of applications and applicants (including an applicant's identity, age and place of residence) and to disqualify any applicant who submits an application that is not in accordance with these Terms and Conditions or who tampers with the application process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete or indecipherable applications will be deemed invalid.
9. Only one (1) Caltex StarCard Debit application per individual is permitted.
10. If there is a dispute as to the identity of an applicant, the Promoter reserves the right, in its sole discretion, to determine the identity of the applicant.
11. One (1) major prize will be offered. The draw for the major prize will take place at Handling Matters, 1/3 Green Street, Brookvale NSW 2100 at 12.00pm AEDST on 07/11/2012. The winner will be notified in writing and by telephone within two (2) business days of the draw and their name will be published in The Australian on 14/11/2012. The Promoter's decision is final and no correspondence will be entered into.
12. The first valid applicant drawn, from all valid applications received, will be deemed the major prize winner. The major prize winner will win a trip for four (4) adults to the Gold Coast, Queensland, valued at up to $6,100.00, depending on date and point of departure. The major prize includes:
•return economy airfares from the winner's nearest capital city for four (4);
•four (4) nights twin share accommodation at The Mantra, Sun City, in a two (2) bedroom apartment;
•breakfast daily;
•five (5) days car hire;
•four (4) x VIP Theme Park Passes (valid for redemption at Warner Bros. Movie World, Sea World and Wet 'n' Wild); and
•one (1) x $150.00 Hard Rock Café dinner voucher.
Spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The major prize must be taken by 30/06/2013 and is subject to booking and flight availability. Block out periods apply for Australian Public Holidays and bookings must be made at a minimum of forty five (45) days in advance of requested departure date.
13. Frequent flyer points will not form part of the major prize. The major prize is subject to the standard terms and conditions of service providers of components of the major prize. The winner may be required to present their credit card at time of accommodation check in.
14. Any ancillary costs associated with redeeming an Events Cinemas Double Pass, VIP Theme Park Pass or Hard Rock Café dinner voucher are not included. Any unused balance of an Events Cinemas Double Pass, VIP Theme Park Pass or Hard Rock Café dinner voucher will not be awarded as cash. Redemption of an Events Cinemas Double Pass, VIP Theme Park Pass or Hard Rock Café dinner voucher is subject to any terms and conditions of the issuer including those specified on the applicable pass/voucher.
15. The car hire prize component is subject to standard rental conditions. One (1) full tank of petrol will be included upon pick up of the vehicle. It is a condition of accepting the car hire prize component that the winner returns the vehicle with one (1) full tank of petrol. Insurance is not included and is the responsibility of the winner.
16. The VIP Theme Park Passes are subject to the venue and/or pass terms and conditions, including any applicable age restriction. The Promoter and VIP Theme Park employees hereby expressly reserve the right to eject the winner (and/or their companions) for any inappropriate behaviour whilst participating in any element of the prize.
17. As a condition of accepting the major prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
18. If anyprize (or part of anyprize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Total prize pool value is up to $9,700.00.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
20. A draw for the major prize, if unclaimed, may take place on 07/02/2013 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The winner, if any, will be notifiedin writing and by telephone within two (2) business days of the draw and theirname will be published in The Australian on 14/02/2013.
21. Applicants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud,the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any applicant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
23. Any cost associated with accessing the promotional website is the applicant's responsibility and is dependent on the Internet service provider used.
24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, includingthe Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any application or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or applicant; or (f)taking of the prize/redemption of an Events CinemasDouble Pass.
26. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Submitting an application is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the applicant. Applicants should direct any request to opt out, access, update or correct information to the Promoter. All applications become the property of the Promoter.
