Terms and Conditions
A. INTRODUCTION.
1. All sections and information in this document form part of these terms and conditions.
Participation in the competition is deemed acceptance of these terms and conditions by the
participant.
2. The Promoter is Hyundai Motor Company Australia Pty Ltd, (ABN: 58 008 995 588) of Cnr
of 394 Lane Cove Road and Hyundai Drive, Macquarie Park NSW 2113 and includes its
agents, employees, officers, successors and assigns (Promoter).
B HOW TO ENTER.
3. Entry is
only open to Australian residents aged 18 years or over. Employees (and their
immediate families) of the Promoter and agencies associated with this promotion are
ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step brother,
step sister or first cousin.
4. The competition commences on Sunday 09 September, 2012 at 9.00am (AEST) and
concludes on Friday 9 November, 2012 at 3.00pm (AEDT)(Promotional Period).
5. To enter, participants must during the Promotional Period:
a. Log onto
https://www.facebook.com/HyundaiAustralia (Hyundai Page) and click the
āLikeā button (if they havenāt already done so);
b.
Select and dedicate a song to a friend on Facebook from the i30 Break Free
promotional page linked from the Hyundai Page, powered by Spotify.c. Include with their entry:
i. Full name
ii. Email address, telephone number and address including State
iii. Accept the Terms & Conditions of the competition
d. Submit entry
Each valid entry will entitle the entrant to one (1) entry in the weekly prize draw for every
song dedication or āShareā with friends on Facebook. Entrants will only be qualified to win
once within the weekly prize draw.GAME PARTICIPATION.

7. All entries must be received by the Promoter by the end of the Promotional Period. Entries
are deemed to be received at the time of receipt into the promotion database and not at
the time of transmission by the entrant. The Promoter has no control over networks or
communication lines and is not liable for any problems associated with them, whether due
to traffic congestion, technical malfunction or otherwise.
8. Any cost associated with accessing the Hyundai Page is the entrantās responsibility and is
dependent on the internet service provider used.
9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants
(including an entrantās identity, age and place of residence) and to disqualify any entrant
who submits an entry that is not in accordance with these Terms and Conditions or who
tampers with the entry process. Errors and omissions may be accepted at the Promoter's
discretion. Failure by the Promoter to enforce any of its rights at any stage does not
constitute a waiver of those rights.
10. Incomplete or indecipherable entries will be deemed invalid.
11. The use of any automated entry software or any other mechanical or electronic means
that allows an entrant to automatically enter repeatedly is prohibited and will render all
entries submitted by that entrant invalid. Any other forms of repeated entries will also
render all entries submitted by that entrant to be invalid.
12. All entries received from Sunday 09 September, 2012 at 9.00am (AEST) to the close time
and date of each draw outlined below, will be included in the applicable draws (except
those entries that have already won a prize:

13. Any entry that is made on behalf of an entrant by a third party will be invalid.
D PRIZES.
14.
There will be one hundred and fifty (150) prizes awarded in total, each consisting of a 6
month Premium Subscription to Spotify valued at $11.98/month or $71.88 per subscription.
Total value of all prizes in each Draw (for Draws 1-8) is $1,078.20. Total value of all prizes
in the Final Draw is $2,156.40.15. Total maximum prize pool value for the entire promotion is $10,782. The Promoter accepts
no responsibility for any variation in the total prize value or any individual prize value. Prize
values are based upon the published prices as of the 19
th
June 2012 (inclusive of GST).
16. Each valid entrant who has entered the competition during the Promotional Period and
before the deadlines specified in paragraph 12 will be entered into the draw. The winner will
be randomly drawn via computer generated system in accordance with the draw schedule
specified in paragraph 6 at 15 Grosvenor Street, Neutral Bay NSW 2089.
17. The winner will be notified within 2 days of the draw and will be notified of their prize by
email and telephone.
18. Prizes will be awarded to the person named in the entry. However, in the event of a dispute,
at the discretion of the Promoter prizes will be awarded to the account holder of the entry
mechanism used to submit their entry (i.e. Facebook account holder).
19. If any of the prizes (or any part of the prize) referred to in this promotion are unavailable,
the Promoter reserves the right at its sole and absolute discretion to substitute the prizes
(or any part of the prize) with a prize to the equal value and/or specification.
20. The prizes, or any unused portion, are not transferable or exchangeable and cannot be
taken as cash, unless otherwise specified by the Promoter.
21. All prizes are awarded subject to the standard terms and conditions of individual prize and
service providers.
22. Any ancillary costs associated with redeeming a prize are not included.
23. If for any reason a winner does not take ownership of the prize (or an element of the prize)
by the time stipulated by the Promoter, the prize (or that element of the prize) will be
forfeited.
24. The Promoter reserves the right to redraw in the event of a winner being unable to
satisfy these terms and conditions or forfeits or does not claim the Prize. If the
Prize remains unclaimed, or is forfeited through ineligibility or otherwise, the
Promoter will conduct a further draw/s at the same time and place as the original
draw on 1 March 2013 subject to any applicable law. Any winner/s will be notified by
email and telephone on 5 March 2013 .
E. PRIVACY
28. The Promoter collects personal information in order to conduct the promotion and may, for
this purpose, disclose such information to third parties, including but not limited to agents,
contractors, service providers, prize suppliers and, as required, to Australian regulatory
authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing,
publicity, research and profiling purposes, including sending electronic messages or
telephoning the entrant. Entrants should direct any request to opt out, access, update or
correct information to the Promoter. All entries become the property of the Promoter.
29. Entrants consent to the Promoter using any of the comments, answers, quotes or
testimonials provided on the online entry form which they completed to enter this
Promotion, their name, likeness, image and/or voice in the event they are a winner
(including photograph, film and/or recording of the same) in any media (including but not
limited to banners, press advertising whether online or otherwise) for an unlimited period
without remuneration for the purpose of marketing, publicity and promoting this promotion
(including any outcome), and promoting any products manufactured, distributed and/or
supplied by the Promoter. The winner agrees that the Promoter will own the copyright in all
content on online entry forms submitted, in any videos, recordings, images, comments,
writing and photographs provided to the Promoter.
F. GENERAL
30. The Promoterās decisions are final and binding and no correspondence will be entered into.
All decisions are made at the sole and absolute discretion of the Promoter.
31. If this promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the Promoter,
including but not limited to technical difficulties, tampering, infection by computer virus or
bug, bad weather or other acts of God, unauthorised intervention or fraud, or any other
causes beyond the control of the Promoter which corrupts or affects the administration,
security, fairness, integrity or proper conduct of the promotion, the Promoter reserves the
right, in its sole and absolute discretion, to the fullest extent permitted by law (a) to
disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, or any
part of it, as appropriate.
32. The Promoter will not be responsible for any act, omission, failure or delay not reasonably
within its control.
33. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under the Competition
and Consumer Act 2010, as well as any other implied warranties under the Australian
Securities and Investments Commission Act 2001 or similar consumer protection laws in
the State and Territories of Australia (Non-Excludable Guarantees).
34. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is not
responsible for and excludes all liability (including negligence), for any personal injury; or
any loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of this promotion, including but not limited to: (a) any
technical difficulties or equipment malfunction (whether or not under the Promoterās
control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize
claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by
the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any
variation in prize value to that stated in these Terms and Conditions; (e) if the prize or any
part of this promotion is cancelled, terminated, modified, varied or suspended for any
reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a
winner or entrant; (g) participation in the Promotion; (h) the acceptance and use of the prize
by the entrant or any other person; or (i) if an entrant is disqualified.
35. As a condition of accepting the prize, a winner (and their companion) must sign any legal
documentation as and in the form required by the Promoter and/or prize suppliers in their
sole and absolute discretion, including but not limited to a legal release and indemnity form.
36. It is the responsibility of the entrants to ensure that any contact details provided to the
Promoter are correct and to notify the Promoter of any changes to the contact details prior to the date for announcing the identity of the prize winners. The Promoter will not be liable if
it cannot contact any prize winner because of any incorrect contact details provided to it by
an entrant.
37. Entry and continued participation in the promotion is dependent on entrants following and
acting in accordance with the Facebook Statement of Rights and Responsibilities, which
can be viewed at
www.facebook.com/terms.php and any other terms and conditions set by
Facebook from time to time.
38. This promotion is in no way sponsored, endorsed or administered by, or associated with,
Facebook. Entrants understand that they are providing their information to the Promoter
and not to Facebook. The information an entrant provides will only be used for the purposes
outlined in these Terms and Conditions. Any questions, comments or complaints about this
promotion must be directed to the Promoter and not to Facebook.
