Choice Hotels Win A Car Competition Terms and Conditions
General
Information on how to enter and prizes form part of the Terms and Conditions of Entry (“Terms and Conditions”). Entry into this competition deems acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
Who can enter?
Subject to clause 4, entry is open to all residents of Australia
over the age of 18 who have fulfilled the requirements set out below.
Employees, and their immediate families, of the Promoter and Promoter’s franchisees and associated agencies and companies are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin. The Promoter is Choice Hotels Australasia Pty Ltd (ABN 41 081 959 891) of 150 Jolimont Road, East Melbourne Victoria 3002 Australia (the ‘ Promoter’).
How to enter
Entrants who are not existing members of the Promoter’s loyalty programme, Choice Privileges® may enter the competition during the Promotional Period (defined below) by:
Signing up to become a Choice Privileges member by visiting the website
www.choicehotels.com.au, by calling the Choice Privileges team on 1800 806 644 or by joining Choice Privileges during a stay at any of the Promoter’s franchised Econo Lodge®, Comfort™, Quality™ or Clarion® properties in Australia or New Zealand (each a ‘ Choice Hotel’) at the property reception; and then
Responding to the email sent by the Promoter confirming membership, by going to the URL displayed and then entering the unique code provided or by going to the URL displayed (
www.choicehotelscompetitions.com.au) on the entry coupon given at the Choice Hotel when signing up to be a Choice Privilegesmember in the hotel.
Entrants who are already members of the Choice Privileges program may enter the competition during the Promotional Period by responding to the Promoter’s email inviting the member to enter the competition, going to the URL displayed (
www.choicehotelscompetitions.com.au) and entering the unique code provided.
After successfully entering the “Win a Car” competition, via either clauses 5 or 6 above, entrants may submit a bonus entry by:
Booking a minimum one night stay at a Choice Hotel by going online at
www.choicehotels.com.au, or by making the booking directly at a Choice Hotel or by calling the Promoter’s booking number on 1800 116 004 (‘ Eligible Bonus Stay’); and then
Responding to the Promoter’s email confirming the Eligible Bonus Stay, going to the URL displayed (
www.choicehotelscompetitions.com.au) and entering the unique code provided.
Upon entering the “Win a Car” competition, further bonus entries will be awarded to entrants for ‘liking’ or ‘sharing’ the Comfort Hotels and Inns Australia (
http://www.facebook.com/ComfortHotelsAus) Facebook page from the Facebook application that will be embedded within the competition entry website (
www.choicehotelscompetitions.com.au).
Entries must include all requested contact details, including the unique code provided, to be eligible to win. Entrants may only enter their own name. Inaudible, incomprehensible, illegible or incomplete entries will be deemed invalid.
Number of Entries permitted
Entrants may only submit one entry using the methods outlined in clauses 5 and 6. After entrants have submitted an entry under clauses 5 or 6 they may enter one bonus entry under clause 8. After entrants have submitted an entry under clauses 5 or 6 they may enter one bonus entry for each Eligible Bonus Stay under clause 7.
Open, Close, Draw and Publish dates
The competition commences 17/09/12 at 00:01 AEST and closes 30/11/12 at 23:59 AEDT (the ‘ Promotional Period’). Entries must be received by the Promoter prior to the competition close date and time and in accordance with the following draw schedule to go into the corresponding draw.

The Promoter will ensure that all valid entries have an equal chance of winning a prize.
The winners will be notified by phone and mail within two (2) business days of each draw and names of winners of prizes over $250 in value, from Draw Three, will be published in The Australian newspaper on 06/12/2012. Winners will also be published on

Prizes will be sent within twenty-eight (28) days of each draw.
The Promoter may conduct such further draws on 11/03/2013 at the same time and place as the original draw in order to distribute any prizes unclaimed by this date, subject to State and Territory legislation. Winners of any further draws will be notified by phone and mail within two (2) business days of the draw and, if the prize they have won is valued at over $250, their names will be published in The Australian newspaper on 14/03/2013.

The Promoter takes no responsibility for petrol, comprehensive insurance, health, transport, body, paint or mechanical damage, or any other costs or damages associated with the Suzuki Swift Sport vehicle, from the date of delivery. The winner will be responsible for any expenses incurred in getting to and from their local Choice Hotel (where the winner will be required to have photos and/or video footage taken) and for collecting the vehicle from their local Choice Hotel or, if the winner is not located near a Choice Hotel, a Suzuki Dealer, within 30 days of the draw. The prize value includes on-road costs. In WA, winners will be responsible for arranging and paying for an immobiliser to be fitted, as required by WA Road Traffic regulations.
The Choice Hotel accommodation vouchers are valid for twelve (12) months and must be used in a booking made through the Promoter on 1800 116 004 within six (6) weeks of receiving the voucher.
Data charges or ISP charges do not form part of the Kindle Touch and will be the sole responsibility of the winner.
Further Terms and Conditions
Entrants acknowledge that their Facebook profile photograph may be featured on the Application and/or any associated Facebook page for public viewing. Facebook membership and the use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at
www.facebook.com. The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users via Facebook. To the extent permitted by law, each entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an entrant in respect of the entrant’s participation in the promotion. Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, then the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if an entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
If the prize is unavailable, for whatever reason, then the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize-winner.
The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generation and use “scripting” is not permitted and will not be accepted.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
