"TYREPLUS PORSCHE" PROMOTION
Eligibility Requirements

1.Entry is only open to Australian residents aged 18 years or over who have a valid unrestricted driver’s license issued in an Australian State/Territory. Employees (and their immediate families) of the Promoter, TYREPLUS stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entry and Claim Instructions

2.To receive a gift and be eligible to enter the major prize draw, eligible individuals must purchase, in a single transaction, four (4) or more Michelin Passenger Car or Michelin Light Truck tyres from a participating TYREPLUS store nationally between 06/09/2012 and close of business on 31/10/2012 (“Qualifying Transaction”). Fleet, trade and wholesale purchases are excluded and will not qualify for a gift or entry.
3.Immediately after completion of a Qualifying Transaction eligible individuals will be awarded a gift of a $50 EFTPOS card (by the staff at the TYREPLUS store where they made their Qualifying Transaction). There is a strict limit of one (1) gift per Qualifying Transaction, regardless of the number of eligible tyres purchased in that transaction in excess of four (4).
4.To be able to use the $50 ETPOS card and to enter the major prize draw, eligible individuals must activate their gift $50 EFTPOS card by visiting the URL address featured on the back of the $50 EFTPOS card (i.e. http://www.activatemycard.com.au/tyreplus) and following the prompts to provide all of the requested information and activate by 11.59pm AEDST on 30/11/2012. Individuals will be awarded one (1) entry into the Major Prize Draw for each gift EFTPOS card validly activated (corresponding to one (1) entry per Qualifying Transaction). Each gift $50 EFTPOS card can only be activated once.
General

5.Information on how to enter and claim and the prizes and gifts form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
6.The Promoter reserves the right, at any time, to verify the validity of entries and claims and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who makes a claim or submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry/claim process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7.Incomplete or indecipherable entries and claims will be deemed invalid.
8.Multiple entries permitted, subject to the following: (a) only one (1) gift and one (1) entry into the major prize draw permitted per Qualifying Transaction (regardless of the number of eligible tyres in excess of four (4) purchased in that Qualifying Transaction); and (b) each claim must be made and each entry must be submitted separately and in accordance with entry requirements.
9.Entrants must retain the following items as proof of purchase and entry/claim: (a) their original TYREPLUS purchase receipt(s) for all claims and entries; and (b) each original gift $50 EFTPOS card activated in accordance with clause 2 above (even if all funds on the EFTPOS card have been spent). Failure to produce the proof of purchase for all claims and entries (as applicable) when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s claims and/or entries and forfeiture of any right to a gift and/or a prize. Purchase receipt(s) must clearly specify the TYREPLUS store of purchase, products purchased and that the purchase was made during the promotional period but prior to entry.
10.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
11.Promotion commences on 06/09/2012 and ends in store (for purchases and gift claims) at close of business on 31/10/2012. Entries into the major prize draw close at 11.59pm AEDST on 30/11/2012.
12.The major prize draw will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne VIC 3004 on 12/12/2012 at 3pm AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
13.Major prize draw winners will be notified in writing and their names will be published in The Australian on 19/12/2012. Entrants will be notified that they are eligible to receive a gift at the time of the Qualifying Transaction by the staff in store.
14.The Promoter’s decision is final and no correspondence will be entered into.
15.As outlined in clause 2 above, each entrant will receive one (1) gift of a $50 EFTPOS card for each Qualifying Transaction he or she makes during the applicable promotional period. Once the EFTPOS card is activated (in accordance with the instructions provided in clause 2 above and on the reverse of the card), the EFTPOS card can be used anywhere EFTPOS is accepted (with the funds on the card becoming active the next business day at midday after activation date). The EFTPOS card will be TYREPLUS branded. EFTPOS cards must be activated by 11.59pm AEDST on 30/11/2012, or the card will be forfeited.
16.The first valid entry drawn in the major prize draw will win the 2012 model Porsche Boxster with manual transmission in platinum silver metallic colour. Total vehicle value is up to $123,044, including 12 months registration, 12 months compulsory third party (CTP) insurance, stamp duty, dealer delivery charges (which may vary State by State), and any other applicable on-road statutory and administration charges. The vehicle awarded is a standard specification vehicle with no optional equipment. Final value may vary from dealer to dealer and according to individual circumstances. Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The winner must collect the vehicle from an Official Porsche Centre nominated by the Promoter that will be located in Melbourne, VIC. If the winner is from outside of VIC, the prize will include a one-way economy airfare for the winner only, from the winner's nearest commercial airport to VIC to enable them to collect the vehicle, valued at up to $500 (depending on the point of departure). Any additional costs involved in getting the vehicle back to the winner's residence including transport, transfer or petrol fees are the responsibility of the winner. If the winner is from VIC then the airfare will not be included and will be forfeited and it will be the winner’s responsibility to collect the car from the nominated Official Porsche Centre in Melbourne at their own cost. The Promoter will liaise with the winner to determine a suitable time for vehicle collection, however, if agreement cannot be reached, the Promoter reserves the right to determine the date of collection. Total value of the major prize is up to $123,544, depending on the winner’s location.
If the major prize winner is, through any legal incapacity or otherwise, unable to register the vehicle in their own name, then the winner may assign the vehicle to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the vehicle is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
All warranty claims in relation to the vehicle should be directed to the manufacturer of the vehicle (in accordance with the standard warranty terms) and not to the Promoter. Winner must comply with all Porsche Cars Australia Pty Ltd agreements at the time of major prize receipt. Once the major prize has been collected from the Official Porsche Centre, the prize becomes the winner's responsibility. Porsche Cars Australia Pty Ltd and the Promoter take no responsibility and exclude all liability for any damage to the vehicle or any damage caused by the vehicle that occurs after keys have been provided to the winner (or the winner’s representative, as applicable), including but not limited to any damage resulting from the winner (or the winner’s representative as applicable) being involved in a collision (with a car or any other object or a person) while still on the premises of the Official Porsche Centre. It is a condition of accepting the major prize that the winner must comply with all the conditions of use of the prize and the prize supplier's requirements.
17.The next ten (10) valid entries drawn in the major prize draw will each win a Precision Driving Experience Prize at the Porsche Experience Driving Centre at Mt Cotton, Queensland, valued at up to $4,297, depending on the date and point of departure. Each Precision Driving Experience Prize will be redeemable by the winner only and involves a day long instruction course (maximum of 7.5 hours, provided by instructors selected by the prize supplier at its absolute discretion) on the basics of driving and mastering a vehicle, including but not limited to on the topics of correct responses to critical situations, identifying and dealing with and avoiding potential hazards and optimum ways to approach and tackle bends in road driving, valued at $1,397. The winner must have a valid unrestricted driver’s license issued in an Australian State/Territory to be able to take the Precision Driving Experience Prize. Each Precision Driving Experience Prize includes:
the use of a Porsche 911 (Boxster or Cayman, as determined by the prize supplier), under the supervision and direction of the course instructors on the practice track only by the winner;
insurance for the winner for the use of the vehicle during the course and in accordance with the directions of the course instructors;
two (2) sun hats (brand, colour and size determined by the Promoter);
a buffet lunch and refreshments for the winner (set menu).
If the winner is from VIC, NSW, ACT, SA, WA, NT or TAS, the prize also includes one (1) return economy airfare from the winner's nearest capital city to Brisbane Airport in Queensland and one (1) nights accommodation at a minimum 4 star hotel (as selected by the Promoter). The airfare and accommodation components of each prize are valued at up to $2,900 (depending on date and point of departure). Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the selected airlines departure city and their current flight schedule.
If the winner is from Queensland, then the prize does not include airfares or accommodation and the airfare and accommodation components of the prize will not be redeemable for cash.
Spending money, additional meals, additional insurance, transport to and from departure point, transfers, items of a personal nature and all other ancillary costs are not included. Prize must be taken sometime between 01/01/2013 and 31/12/2013 and is subject to booking and flight/accommodation availability (as applicable). Prize cannot be taken during Australian school holidays, public holidays or other peak periods. Once bookings for prize redemption have been made, bookings cannot be changed. The winner must sign the prize supplier’s terms and conditions of participation before taking the Precision Driving Experience Prize.
18.The next ten (10) valid entries drawn in the major prize draw will each win a Porsche City Index Carrera Cup Australia Paddock Pass Prize, valued at up to $1,750 depending on the winner’s location. The Porsche City Index Carrera Cup Australia Paddock Pass Prize includes an opportunity for each winner and one (1) companion (aged 18 years or over) to attend the Porsche City Index Carrera Cup Australia round in 2013 held in the winner’s State (where applicable) or alternatively the Porsche City Index Carrera Cup Australia round held in a State/Territory nearest to the winner’s State/Territory of residence if no rounds are held in the winner’s State/Territory in 2013 after the winner has been notified. The Porsche City Index Carrera Cup Australia rounds will be held in VIC, SA, WA, QLD and NSW. The exact dates of the Porsche City Index Carrera Cup Australia rounds relevant to each winner will be made available to each winner once the winner has been selected and the Porsche City Index Carrera Cup Australia round dates have been released. Dates for each Porsche City Index Carrera Cup Australia round once provided may be subject to change for reasons outside of the Promoter’s control. The Porsche City Index Carrera Cup Australia Paddock Pass Prize is not valid for any F1 Support Races.
Each Porsche City Index Carrera Cup Australia Paddock Pass Prize includes the following:
Two (2) general admission tickets for two (2) days of the relevant Porsche City Index Carrera Cup Australia round, including access to the Porsche City Index Carrera Cup Australia Teams Lounge at the relevant Porsche City Index Carrera Cup Australia round;
Porsche City Index Carrera Cup Australia Paddock Tour for the winner and one (1) companion. Exact time of the tour will be confirmed with the winner once the winner has been selected; and
A meal for the winner and companion in Porsche City Index Carrera Cup Australia Teams Lounge (set menu). Time of meal service will be confirmed with the winner once the winner has been selected.
The elements of each Porsche City Index Carrera Cup Australia Paddock Pass Prize taken at the actual Porsche City Index Carrera Cup Australia round (as listed in the bullet points above) are valued at $350.
If the winner is required to attend a Porsche City Index Carrera Cup Australia round outside of their State/Territory of residence, then the prize also includes two (2) return economy airfares from the winner's nearest capital city to their nearest State where the relevant Porsche City Index Carrera Cup Australia round is taking place and one (1) nights twin share accommodation at a minimum 4 star hotel (as selected by the Promoter). The airfare and accommodation elements of each prize will be valued at up to $1,400, depending on the winner’s location. ). Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the selected airlines departure city and their current flight schedule.
If the winner is required to attend a Porsche City Index Carrera Cup Australia round taking place in their State of residence (as indicated by the Promoter), then the prize does not include airfares or accommodation and the airfare and accommodation components of the prize are not redeemable for cash.
Spending money, additional meals, additional insurance, transport to and from departure point, transfers, items of a personal nature and all other ancillary costs are not included. Prize must be taken to coincide with the relevant Porsche City Index Carrera Cup Australia round, on the dates reasonably provided to the winner by the Promoter once the winner has been notified and is subject to booking and flight availability. Once bookings for prize redemption have been made, bookings cannot be changed. The Porsche City Index Carrera Cup Australia Paddock Pass Prize must be taken at the Carrera round indicated to the winner by the Promoter (as per the above specifications) and must be taken during 2013. Alcohol will not be available or permitted in the paddock and lounge during the entire duration of the Porsche City Index Carrera Cup Australia Paddock Pass Prize.
19.Travel insurance is highly recommended to each winner (and his/her companion where applicable), to protect against the additional costs incurred in the event of unforeseen circumstances. Any costs incurred in obtaining such insurance are the winner’s responsibility and will not be borne by the Promoter.
20.Where applicable, each winner and his/her companion must depart from and return to the same departure point and travel together.
21.Itinerary for the Precision Driving Experience Prize and the Porsche City Index Carrera Cup Australia Paddock Pass Prize will be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Precision Driving Experience Prize or the Porsche City Index Carrera Cup Australia Paddock Pass Prize.
22.Each winner of the Precision Driving Experience Prize and the Porsche City Index Carrera Cup Australia Paddock Pass Prize may be required to present their credit card at time of accommodation check in, where applicable.
23.All prizes are subject to the standard terms and conditions of individual prize and service providers.
24.In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
25.The winners of the Precision Driving Experience Prize and the Porsche City Index Carrera Cup Australia Paddock Pass Prize (collectively “Activity”) and their companions where applicable acknowledge that the Activity can be a dangerous activity that may result in injury or death, and participate at their own risk. The winners and their companions where applicable must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear any safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or his/her companion from participating in the Activity if, at any time, they reasonably believe that the winner or his/her companion poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
26.Subject to the unclaimed prize draw clause, if for any reason a winner of a prize drawn in the major prize draw does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. If an entrant does not collect a gift at the time of completing the Qualifying Transaction then that gift will be forfeited by the entrant.
27.If any prize or gift (or part of any prize or gift) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize or gift (or that part of the prize or gift) with a prize or gift to the equal value and/or specification, subject to any written directions from a regulatory authority.
28.Total prize pool value of all prizes drawn in the major prize draw is up to $184,014.
29.The number of expected entrants in the ACT is 300 and the estimated total value of gifts in the ACT is $15,000, with the potential estimated total value of all prizes and gifts that can be won by ACT residents being up to $199,014.
30.Prizes and gifts, or any unused portion of a prize or a gift, are not transferable or exchangeable and cannot be taken as cash.
31.A draw for any unclaimed prizes drawn in the major prize draw may take place on 13/03/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner(s), if any, will be notified in writing and their name(s) will be published in The Australian on 20/03/2013.
32.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
33.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
34.Any cost associated with accessing the card activation website is the entrant’s responsibility and is dependent on the Internet service provider used.
35.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter or claim repeatedly is prohibited and will render all entries/claims submitted/made by that entrant invalid.
36.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
37.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize/gift value to that stated in these Terms and Conditions; (e) if the relevant Porsche City Index Carrera Cup Australia round is cancelled, rescheduled or postponed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize or gift; (h) participation in a prize and/or attendance at a prize event/location.
38.As a condition of accepting a prize, each winner (and his/her companion, where applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
39.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
