METHOD OF ENTRY
Information on how to enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
Entry is open to Australian residents only. Any entrant aged under 18 years must obtain consent from their parent/guardian prior to entering the competition.
Employees of Stuart Alexander & Co Pty Ltd (the Promoter), PLAY Communication and Razor Group and their immediate families are ineligible.
To enter the Mentos Mystery Flavour Facebook competition, entrants must first 'Like' the Mentos Facebook page (if not already a fan) then
click on the Mentos Mystery Flavour application and guess the Mystery flavour by posting a flavour in the comment box. There are two (2) ways to win in this promotion; Instant Wins and a Mystery Location Major Prize.
The Mentos Mystery Flavour Facebook competition commences on 1st October 2012 at 10:00 am AEDT and
ends on 12th October 2012 at 11:59 pm AEDT (the Promotion Period).Entries must be received by the Promoter during the Promotion Period. Entries received after the end date will not count towards the competition. Records of the Promoter are final and conclusive as to time of receipt. Incomplete or indecipherable entries will be deemed invalid.
Multiple entries may be submitted.
WAYS OF WINNING
Instant Wins: After posting a Flavour guess, a computer-generated algorithm will randomly determine if the entrant is an instant winner or not. Winners will be told instantly if they have won a prize via a pop-up win message.Mystery Location Major Prize: The more guesses made by all entrants, the closer the map on screen will zoom into the Mystery Location.
The Mystery Location will be revealed at random during the Promotion Period. Once the Mystery Location has been revealed entrants will have a two (2) hour period, from the time of reveal, to get to the Mystery Location and claim the major prize by being the first person to stand in the dedicated Mentos area and shout 'Unwrap the Mentos Mystery' through the megaphone on siteThe Promoter reserves the right to disqualify any entrant submitting an entry that, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The Promoter's decision will be final and no correspondence will be entered into.
PRIZES
The instant win prize is a $20 iTunes voucher, 1 packet of Mentos 3D Mystery Gum and 1 packet of Mentos Mystery Candy. There are a total of 200 instant win prizes.
The major prize is AU$5,000.00 in cash plus 10 packets of Mentos 3D Mystery Gum and 10 packets of Mentos Mystery Candy.
Total prize pool value is $9,653.10.WINNER NOTIFICATION
Each entrant who is an instant winner, will be instantly told what prize they have won through a pop-up window in Facebook, after they have made their entry. This pop-up window will ask the entrant to fill in mandatory information, such as: First Name, Last Name, NickName, Email Address and Postal Address, so the prize can be distributed. The name of each instant winner will be posted on the Mentos Facebook wall.Instant win prizes will be distributed to each instant prize winner within 28 working days after the date of win.
The major prize winner will receive the major prize on site at the Mystery Location, immediately after being confirmed as the winner by or on behalf of the Promoter.
The major prize winner will be notified in writing and the winners name and state will be published in The Australian on 25th October 2012.
GENERAL
The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of entering this competition, accepting and/or using a prize, except for any liability which cannot be excluded by law.
The prizes are not transferable and the non-cash component of a prize is not redeemable for cash. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become and remain the property of the Promoter.
The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alterations of entries, and reserves the right to take any action that may be available. If for any reason this competition is not capable of running as planned, due to causes including, but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to: (a) disqualify any individual who tampers with the entry process; or (b) take any action that may be available, including subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Entry and continued participation in the promotion through Facebook is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at

The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees").
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
