Tip Top The One Game of Skill Facebook Promotion Conditions of entry
1.Information regarding prizes and how to enter forms part of these conditions of entry. By entering, entrants accept these conditions.
2.Entry is open only to Australian residents aged 13 or over except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the companies, agencies or participating stores associated with this competition.
3.The competition begins at 12.01am (AEST) on 01/10/12 and closes at 11.59pm (AEDT) on 28/10/12 (Competition Period).
4.To enter, entrants must, during the Competition Period: a.purchase a loaf of Tip Top The One bread (Eligible Purchase) from a participating Woolworths, Coles or independent grocer (Store);
b.using the Tip Top One bread, create what they believe will be "Australia's Favourite Sandwich";
c.take a photograph depicting their creation of "Australia's Favourite Sandwich" in portrait or landscape format. The photograph must also clearly feature a pack of Tip Top The One bread. The photograph must be either a JPEG, PNG or GIFF image or in a format that Facebook will accept. All images must not appear to promote any supplier of goods or services other than Tip Top The One Bread;
d.visit the Tip Top Facebook page at
http://www.facebook.com/tiptop and if they haven't already done so, "like" the Tip Top Facebook page; and
e.follow the links to the "promotions" tab on the Tip Top Facebook page, upload their photograph taken in accordance with paragraph 4(c) and fully complete and submit the online entry form, including by selecting the name of the Store where their Eligible Purchase was made from the drop down list (either Coles, Woolworths,independent grocer or other), the name of their creation, the ingredients included in their creation and any additional information as required by the Promoter. Consumers are responsible for their own costs associated with accessing the Internet.
5.Once the entrant has accepted these terms and conditions and their photograph and entry details have been reviewed and verified by the Promoter in accordance with paragraph 9, their entry will be deemed to be accepted into this competition (and will constitute an entry) and the entrant's photograph will automatically appear within Tip Top The One Promotion Gallery on Facebook.
6.All entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter's database and not at the time of submission by the entrant. Entrants may enter as many times as they wish, provided that each entry is based on a separate Eligible Purchase and separate unique entry in accordance with paragraph 4. Entrants must retain their original itemised receipt to verify each entry. Failure to provide this/these (without alteration) to the Promoter upon request will result in an invalid entry (and, at the Promoter's discretion, in all of the entrant's entries being invalid). The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified.
7.It is a condition of entry into this competition that photograph(s) submitted by an entrant are taken by the entrant or taken by another person with the consent of the entrant and with the rights to use the photograph for the purposes of this competition. Photography must be the original work of the entrant or the other person and must not be not copied.
8.By entering this competition, entrants: a.under the age of 18 warrant that they have obtained parental or guardian consent to enter this competition;
b.grant the Promoter a world-wide, royalty free, perpetual, irrevocable, transferrable licence (with a right to sublicence) to use their entry (including their photograph) submitted as part of this competition for any purpose;
c.consent to the Promoter making and publishing copies of the whole or any part of their entry and otherwise exploiting the photograph and any rights in relation to their entry, to publicise this competition including on Facebook, in any publications and for any other purpose;
d.permit the Promoter to edit, adapt and alter their entry for inclusion on the Promoter's Facebook page;
e.acknowledge that their entry and their name may be made publicly available by the Promoter (in its absolute discretion) and will be accessible to the general public to view;
f.warrant that they own or have the right to licence the copyright and moral rights in each entry submitted into this competition, for the purposes of this competition, that no rights have been granted to any third party in respect of the entry which would prevent the entry being used as contemplated by this competition, and the use by the Promoter of the entry will not breach any laws or infringe the rights of any person (including without limitation with respect to privacy, intellectual property and defamation);
g.any person featured in any photograph has consented to the entrant submitting that photograph into this competition;
h.their entry does not include any content that contravenes any law, infringes the rights of any third party, is obscene, offensive, discriminatory, indecent, otherwise objectionable or inappropriate or makes any improper or inappropriate invasion of the privacy of any person. Without limitation, entrants must not include any content that involves nudity, malice or which may be defamatory or in contempt of court;
i.their entry does not include any literary, dramatic or artistic work, or any other item in which copyright subsists, unless the entrant is entitled to do so;
j.their entry contains no viruses or other computer code or material embedded in it which may have a negative impact on the Tip Top Facebook page or any network or third party computer systems; and
k.warrant that all persons appearing in their photograph are 18 years of age or older or, if any person is under 18 years of age, that their parental or guardian consent has been provided.
9.The Promoter may (but is not obliged to) determine at any time, in its absolute discretion, whether or not to publish any entries on the Tip Top Facebook page, remove any entries once published on the Tip Top Facebook page, or amend, edit or modify any entries (or any part thereof), disqualify or invalidate any entry including (without limitation) if the Promoter is of the view that: a.the entry does not comply with paragraph 8; or
b.the entry otherwise breaches these terms and conditions.
The Promoter will have no liability to entrants if it exercises this right.
10.The Promoter reserves the right to verify the validity of entries. Entries not fully complying with these conditions of entry may be deemed invalid at the Promoter's absolute discretion. This is a game of skill; chance plays no part in determining the winners. Each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, creative merit. The judges' decisions are final and no correspondence will be entered into.
11.There is one major prize to be won. The best valid entry, as determined by the judges, will win the major prize, being $5000 (inc GST) cash for the winner (awarded by bank cheque) and $5,000 (inc GST) cash (awarded by bank cheque) donated by the Promoter on behalf of the major prize winner to the major prize winner's local school as nominated by the major prize winner and approved by the Promoter. In the event that the nominated school will not accept the donation or the Promoter for any reason in its absolute discretion does not approve the school nominated by the major prize winner, the major prize winner must select an alternative school for approval by the Promoter. In the event the major prize winner does not nominate a local school and/or fails to nominate a local school that is approved by the Promoter, the Promoter will nominate a school in the major prize winner's state to receive the $5,000 donation.
12.There are three minor prizes to be won, as follows: a.The best valid entry (excluding the major prize winning entry), as determined by the judges, from all valid entries received that shows that their Eligible Purchase was made at a Coles Store (in accordance with paragraph 4(e)) will win a $1,000 (inc GST) Coles Gift Card.
b.The best valid entry (excluding the major prize winning entry), as determined by the judges, from all valid entries received that shows that their Eligible Purchase was made at a Woolworths Store (in accordance with paragraph 4(e)) will win a $1,000 (inc GST) Wish Gift Card.
c.The best valid entry, as determined by the judges, from all valid entries received that shows that their Eligible Purchase was made at an independent grocer (in accordance with paragraph 4(e)) will win a $1,000 (inc GST) Gift Card for the store where their Eligible Purchase was made.
13.The total prize pool is valued at $13,000 (inc GST).
14.All vouchers are subject to the terms and conditions as imposed by the prize suppliers, including period of validity.
15.Winners will be notified in writing by email.
16.All prizes must be claimed by 31/01/12. If a prize remains unclaimed by that date, that entry will be deemed invalid and the Promoter reserves the right to distribute the relevant prize to the next best valid entry received during the Competition Period (in accordance with paragraph 11 or 12, as applicable) that has not already received a prize.
17.This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.
18.The prize winner's must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
19.If the winner of a prize is under the age of 16 years at the closing date of the competition, the prize will be awarded to the winner's parent or guardian.
20.The Promoter may require entrants to provide proof of identity, proof of age and residency. Identification considered suitable for verification is at the Promoter's discretion.
21.If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and the Promoter reserves the right to distribute the relevant prize to the next best valid entry (in accordance with paragraph 11 or 12, as applicable) that has not already received a prize.
22.The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person
23.Prizes are not transferable or exchangeable and (except where cash is specified) cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
24.The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
25.Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
26.If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
27.The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
28.All entries become the property of the Promoter and will not be returned to the entrant. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. If the entrant has marked the "opt-in" box on the entry form, the entrant consents to the storage of their personal information on the Promoter's database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter's products including contacting the entrant via electronic messaging. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.
