Before entering our Escape photo competition, please review the terms and conditions of entry below:
1. Information on how to enter and prizes forms part of these Terms and Conditions of entry. Entry into the competition constitutes acceptance of these Terms and Conditions.
2. The promotion commences on Monday 8 October 2012 and ends at 5.00pm (AEST) on Sunday 4 November 2012 ("Promotional Period").
3. Entry is only open to Victorian residents aged 18 years and older. Directors, management and employees of the Promoter (and their immediate families) or of the agencies or companies associated with this promotion are ineligible to enter.
4. There are a total of twenty-four (24) prizes to be won:
Six (6) grand prizes each consisting of:
Winner’s photo included on a V/Line train wrap
Escape package including V/Line travel vouchers and one night’s accommodation for two adults valued at up to $800.00
Eighteen (18) runners-up prices each consisting of:
Winner’s photo included on a V/Line train wrap
The total prize value is up to $4,800.00 (inc GST).
5. Photos will be judged on Friday 9 November 2012 at 10am (AEST), at Level 23, 570 Bourke St, Melbourne VIC 3000. The judges' decision is final and no correspondence will be entered into. Prizes are not exchangeable or refundable and cannot be redeemed for cash.
6. To enter the competition, consumers must, during the Promotional Period, visit V/Line’s website
www.vline.com.au and fully complete and submit the online entry form. Photos must be no larger than 4MB. Winners will be required to provide to V/Line a high resolution image file where the image size is at least 3264 x 2448 pixels by Wednesday 21 November 2012. If a winner(s) is unable to provide a high resolution image file where the image size is at least 3264 x 2448 pixels by Wednesday 21 November 2012, then the judges may select a new winner.
7. Winners will be notified by telephone and in writing and prizes will be sent by registered post. Winners’ names will be published on
www.vline.com.au on Wednesday 14 November 2011 and in the Herald Sun on Friday 16 November 2012. By entering this competition, entrants request that their full address not be published.
8. If the winner of any prize is under the age of 18 years at the closing date of the promotion, the relevant prize will be awarded to the winner’s parent or guardian (at the Promoter’s discretion).
9. If a winning entry is deemed not to comply with these Terms and Conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 6. The judges’ decision is final and no correspondence will be entered into.
10. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
11. Prizes must be claimed by 31 December 2012.
12. You agree by entering this competition that you have taken the photo entered and will not:
Submit any photo that you do not have a right to make available under any law or under contractual or fiduciary relationships
Submit any photo that infringes any patent, trademark, trade secret, copyright or other propriety rights of any party
13. You consent to the Promoter, in its sole discretion, regardless of whether you are a prize winner: (a) uploading your photo at any time, including prior to 4 November 2012, onto the Promoter’s website or Facebook account and (b) using the photo in the Promoter’s publications in any form whatsoever regardless of size, shape or partial image, including using it on the outside or inside of the Promoter’s trains. You agree and acknowledge that the Promoter has no control over whether third parties download the photo from the Promoter’s website and for what purpose any downloads are used by third parties.
14. V/Line’s privacy policy and privacy notice may be viewed at
www.vline.com.au/privacy. Personal data collected from entrants by the Promoter as part of this competition will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants, to Public Transport Victoria or its nominee, if required by Public Transport Victoria or if disclosure is required or permitted by law. Personal information from entrants will not be used for any other purpose unless permission is provided by the entrant. Where permission is provided by the entrant, the entrant’s personal information will be stored in accordance with V/Line’s privacy policy. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter.
15. You acknowledge and agree that the Promoter may access, preserve and disclose your competition entry information and photo if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these terms and conditions; and (c) respond to any claim that the photo violates the rights of third parties.
16. The Promoter and its associated agencies and companies will not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss or loss of profits), or for any expense, death or personal injury suffered or sustained, (whether or not arising from any person’s negligence) in connection with this competition or as a result of taking or using any prize, except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
17. In the event for any reason a winner does not take an element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.
18. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.
19. The Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes nor be liable for failure of Australia Post to deliver the prize to the winner’s nominated address.
20. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
21. The prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
22. The Promoter may require winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.
