Terms and Conditions1. The Promoter is Kubota Tractor Australia Pty Ltd (ABN 72 005 300 621) of 25-29 Permans Way, Truganina VIC 3029, telephone (03) 9394 4400. A participant in this competition is referred to as ‘entrant’ or ‘you’.
2. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.
3. Information on how to enter and the details of this competition, including information contained on lovemykubota.com.au ("website") form part of these terms and conditions. Should there be any conflict between these terms and conditions and any competition details, these terms and conditions will prevail.
Entry and Eligibility
4. Entry is only open to Australian residents aged 18 years or older at the time of entering this competition. Employees (and their immediate families) of the Promoter and participating agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse; ex-spouse; de-facto spouse; child or step-child (whether natural or by adoption); parent; step-parent; grandparent; step-grandparent; uncle; aunt; niece; nephew; brother; sister; step-brother; step-sister, or first cousin. You may only enter this competition through the applicable application form online on the website. Entry into this competition is automatic upon submission of a correct and fully completed website entry form.

and 5:00pm AEST (Sydney time) on 31 October 2012.8. This competition will run as advertised in the Promoter's catalogue and on the website. The
end date may be changed or updated at the discretion of the Promoter, subject to approval
from the relevant State or Territory regulatory authorities, where required.
9. Entry to the promotion can only be made via the form on the website by following the
prompts to the promotion entry page and inputting the requested information. Entries cannot be emailed, faxed, mailed or sent by any other means. Entries must contain the following information:
(a) name of the entrant;
(b) a telephone number for the entrant;
(c) a residential postal address for the entrant, including postcode;
(d) an email address for the entrant;
(e) the entrant's date of birth; and
(f) any other information required by the website.
10. By
entrant’s name and entry for the purposes of promotion, marketing and publicity in any and all media, worldwide, for an unlimited period, without notice to the entrant and without payment of any fee or compensation of any kind.
11. The Promoter reserves the right to reject any entry, which is in the Promoter's opinion, attempting to scam this competition.
12. The Promoter accepts no liability for late, lost, delayed or misdirected entries that are not received for any reason, or any phone, line, network, website and/or any server technical failure involved in any communication related to this competition.
13. Entries are deemed to be received at the time of receipt in the competition database.

Selection of the Prize Winner
14. The Prize Winner will be selected by an electronic draw. A draw will take place at the offices of the Promoter at 9.00am on 2 November 2012. The name and postcode of the Prize Winner will be published in The Australian on 7 November 2012.
15. The Promoter reserves the right to select an alternate Prize Winner if the Promoter decides at its sole discretion that the Prize Winner or his/her entry does not comply with these terms and conditions.
16. The Prize Winner will be contacted by email and telephone within the week following the closing of this competition to notify the Prize Winner of his or her success and to provide a contact number of the Promoter. The Prize Winner will be required to call the Promoter on the number provided, or reply by email, in order for them to claim their prize.
17. If the Promoter is unable to make satisfactory contact with the Prize Winner for any reason within three months of the Prize Winner being announced, the Promoter will conduct another electronic draw at the Promoter's offices at 9.00am on 8 February 2013. The name and postcode of the Prize Winner following a re-draw will be published in The Australian on 15 February 2013.
18. If any winning entry is deemed not to comply with the terms and conditions, that entry will be discarded and a new Prize Winner will be drawn in accordance with the terms and conditions. If the prize is unavailable for any reason, the Promoter may substitute that prize for another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in all states, where required.
19. For the winning entry, the person entitled to the prize is the entrant. If more than one person claims to be the entrant and claims the prize, the Promoter will have the sole discretion to determine which of those persons is the Prize Winner.
Prize
20.
The Prize Winner will win a Kubota RTV500 Utility Vehicle (standard model). The total prize value of RRP $15,300 plus GST.21. The prize will be delivered to the Prize Winners address.
22. It is the Prize Winner’s responsibility to notify any change in email address by notice in
writing to:
sales@kubota.com.au. The Promoter will not be liable for any failure to receive the
prize.
23. The prize cannot be exchanged for cash. The Promoter reserves the right to provide an
alternative prize at its absolute discretion if for any reasons outside of its reasonable control the prize is unable to be supplied.
Intellectual Property and Privacy
24. Entrants acknowledge that all intellectual property rights in this competition belong to the Promoter.
25. Each entrant warrants that their entry complies with the terms and conditions of this competition, and does not infringe any third party intellectual property rights or any Australian law.
26. Any personal information collected about entrants will be used in accordance with the Promoter's Privacy Policy on the website ("Privacy Policy"). If an entrant does not provide their personal information, the Promoter will not be able to enter that entrant in this competition.
Publicity
27. By entering this competition, you consent to the Promoter and its designees use of your name, city of residence, photograph, voice, statement and image for any publicity and advertising purposes, in any and all media, now or hereafter devised, worldwide in perpetuity, without additional notification, permission or compensation, except where prohibited by law.
Governing Law
28. This competition and these terms and conditions shall be governed by Australian law and the courts of Australia shall have exclusive jurisdiction to hear and determine all issues and disputes that may arise in relation to this competition or these terms and conditions. Entrants submit to the jurisdiction of the Australian courts and agree that the Australian courts are a convenient forum in which to resolve any issue or dispute arising out of or in relation to this competition.
General Conditions
29. The Promoter reserves the right to alter, amend or supplement these terms and conditions from time to time at its absolute discretion, subject to approval from the relevant State or Territory regulatory authorities, where required. You agree that you will be bound by such changes and that you shall not hold the Promoter liable for any losses resulting from any such changes.
30. The Promoter alone will be the arbiter of any question of interpretation of these terms and conditions and any aspect of this competition or its content. The Promoter's decision as to any matter arising out of or in connection with this competition shall be final and conclusive.
31. In the event of any breach of these terms and conditions the Promoter reserves the right to refuse entry to this competition and/or disqualify the entrant in question from any further participation in this competition, and/or disqualify any entry and the Promoter's decision is final.
32. If for any reason this competition is not capable of running as planned, the Promoter reserves the right in the Promoter's sole discretion to discontinue, modify or suspend this competition, subject to approval from the relevant State or Territory regulatory authorities, where required.
33.
