In T&I’s new weekly photographic contest, in association with Orion Expedition Cruises, you could be in the running to win a 10-night Forgotten Islands photography cruise for two, valued at more than $21,000, departing Bali on November 28, 2013. First runner-up will receive a $250 voucher for a selection of Orion boutique products, and second runner-up will receive a signed copy of The Bathers’ Pavilion Café Cookbook by Orion’s consultant chef Serge Dansereau, valued at $39.99.
 
To enter: simply send in your best travel photo capturing the spirit of Australia, titled and with detailed caption information.  Photos, which must be between 1 and 3 megabytes in size, must be titled and captioned, and entrants must supply their postal address and daytime phone number.  Click here to enter
 
 If yours is selected by T&I as one of up to five best images received that week, it will be featured in an online gallery on our website.
 
Online readers will vote for their favourite gallery shot, and each week’s winning image will be published in T&I’s weekend supplement.
 
Each week’s successful photographer will be shortlisted for the annual cruise prize, and runners-up prizes, to be judged on their creativity, technique and originality in capturing the spirit of Australia by T&I’s panel of experts on Wednesday, December 12, 2012.
 
One online voter each week will win an autographed copy of Dansereau’s The Bathers’ Pavilion Café Cookbook. To be eligible to win the book, voters must describe in 25 words or less why they chose the winning shot. The most creative and well-written entry, from those nominating the winning photo, gets the prize.

CONDITIONS OF ENTRY
THE AUSTRALIAN'S OZ IN FOCUS CONTEST
 
1.     Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant. Entry is online only.
 
2.     Entry into the promotion is open to residents of Australia aged 18 years or older. The Promoter is Nationwide News Pty Limited A.B.N. 98 008 438 828 of 2 Holt Street, Surry Hills, NSW, 2010. Officers and employees (and their immediate families) of the Promoter or Orion Expedition Cruises, newsagents, sub-agents and agencies associated with this promotion, are ineligible to enter any part of this competition.
 
3.     The promotion commences at 12.01 am (Sydney time) on Saturday July 28, 2012 and ends at 11.59 pm (Sydney time) on Saturday January 12, 2013 (“Promotional Period”).
 
4.     Weekly photo entry:
 
a.     To enter the photo competition, entrants must, during a weekly photo entry period, enter (in accordance with these terms) a photo which meets the requirements of these terms.  There will be 18 photo entry periods.  The first photo entry period will start with the commencement of the Promotional Period and close at 11.59pm (Sydney time) on Wednesday August 1 at 11.59pm (Sydney time).  Subsequent photo entry periods will commence on each of the following 17 Saturdays (the last being 24 November 2012) at 12.01am and end at 11.59pm on the subsequent Wednesday.
b.    After the weekly photo entry period closes at 11.59 pm each and every Wednesday, a panel of Travel and Indulgence editors will select a weekly shortlist of up to five (5) photos from those submitted in the just ended photo entry period, judged as the best in showcasing creativity, technique and originality in capturing the spirit of Australia.
c.     Entries of a photograph (between 1 and 3MB in size) should be uploaded online at theaustralian.com.au/travel/ozinfocus and must include the entrant’s name, full address, telephone number, email and title and description of their photo. All photo entries received during a photo entry period will be entered into the weekly photo judging for the period when the entry was received.
 
5.     Reader competition:  The shortlisted photos from each photo entry period will be displayed online at www.theaustralian.com.au/travel/ozinfocus for a period from 12.01am (Sydney time) the Saturday following the close of the previous photo entry period until the following Monday 11.59pm, allowing readers to cast a vote online for the photo they judge as best in showcasing creativity, technique and originality in capturing the spirit of Australia. Readers must explain in 25 words or less why they have nominated their selected photo and email their response from the online link at that url with their name, full address, telephone number, email and the title of their nominated image.  Entry to the Reader competition is limited to one entry per person per week.  From the reader’s votes cast in accordance with these terms each week, the most creative and well-written reader entry each week, selected from those entries nominating the winning photo (as judged by a panel of Travel & Indulgence editors) will receive one copy of The Bathers’ Pavilion Café Cookbook valued at $40.


6.     Overall photo competition:
 
a.     The photo that receives the most valid votes in any week of the Promotional Period will be automatically entered into the final major prize round.
 
 
b.    Those photos in the final major prize round will then be judged by a panel of Travel & Indulgence editors  to determine the best image in showcasing creativity, technique and originality in capturing the spirit of Australia. A second and third runner-up will also be selected.
 
7.     Entries in all stages of the competition are deemed received at the time noted by the Promoter’s servers.
 
8.     Entrants can only enter in their own name. The Promoter, Nationwide News Pty Limited reserve the right to request that the winners produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm each winner’s identity, age, residential or email address, eligibility to enter and claim a prize and any information submitted by the winner in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
 
9.     .Entry into the weekly photographic competition is limited to two per person per week. It is a condition of entry into the promotion, and the Promoter relies on the fact, that each entrant confirms to the Promoter and warrants that:
(a) they are the owner of the photograph which they have submitted as an entry into the competition;
(b) the entrant has the permission of people shown and recognisable in the entered photograph to include them and that they have no objections to the photograph being published in print and online; and
(c) entering the photograph and its publication by any person in any media anywhere in the world will not breach any person’s rights (including copyright or moral rights) and they waive their moral rights other than the right of attribution in relation to the submitted photos; and
(d) their submitted photos are their own original work and that they (and any substantially similar photos taken by them) have not been (in the 6 months prior to the commencement of the Promotional Period) and will not during the Promotional Period be included in any other competition, exhibition, promotion or published by any person anywhere in the world in any media.
 
10.  Each entrant agrees that their name and any of their submitted photos may be reproduced, and published by the Promoter or any other person authorised by the Promoter without the Promoter being required to make any payment or compensation to the entrant.
 
11.  Each entrant agrees that if their photo goes into the final major prize round under clause 6 of these terms and conditions, then the entrant will not and will not allow any other person to include, publish or use that photo (or any other substantially similar photo) in any other competition, exhibition, promotion or allow it to be published by any person anywhere in the world in any media.  This restriction will continue for 12 months immediately following the close of the Promotion Period.
 
12.   The judging will take place weekly by COB each and every Tuesday (for the weekly reader’s choice prize), and on Wednesday December 12 2012  at 12 Noon for the major prizes at 2 Holt Street, Surry Hills, NSW, 2010.  The winners will be notified by telephone and email/mail. Judges’ decision is final and no correspondence will be entered into. The weekly reader’s choice winner will be announced online and in print on each and every Saturday following the judging. The major prize winners will be announced online and in print on Saturday January 12, 2013.
 
13.  The Prizes comprise:
 
a) The Weekly prize for the Reader’s Choice section is a copy of The Bathers’ Pavilion Café Cookbook personally signed by Serge Dansereau. Valued at $40. There are 18 copies of this prize available. The winner each week will be notified by telephone and email/mail and the prize will be posted to the winner’s residential address within Australia.
b) The major prize for photography entrants: A 10-night Forgotten Islands Photography voyage for two onboard Orion Expedition Cruises, valued at over $21,000 (or similar voyage, as determined by Promoter in its sole discretion, if this particular cruise is no longer offered in November 2013). Conditions: Cruise must be taken on Forgotten Islands Photography Voyage departing 28 November 2013. The winner will be notified by telephone and email/mail. Prize includes luxury twin-share accommodation in a Junior Suite, all meals onboard, entertainment and educational programmes, use of ship’s sporting equipment and facilities, Zodiac excursions and tender transfers and professional services of the expedition team and crew. Flights are not included. Prize cannot be redeemed for cash. Prize winners and their companion must travel on the same itinerary and in the same cabin. Itineraries are subject to tides and weather conditions and may be changed without notice. Winner and their travel companion will be required to agree to Orion’s Passage Terms and Conditions, which can be found at www.orionexpeditions.com. The prize for first runner up is a $250 voucher for a selection of Orion boutique products. The prize for second runner up is a copy of The Bathers’ Pavilion Café Cookbook personally signed by Serge Dansereau. Valued at $40.
 
14.  Maximum total prize pool value is up to $22,300. The major prize value is based on the recommended retail price and the exchange rate at the time of printing and includes GST (where applicable).
 
15.  The prizes, (or any part thereof) cannot be sold, are not transferable or exchangeable and cannot be taken for cash. Prize cannot be used in conjunction with any other special offer. No responsibility is accepted for any variation in the value of the prize.
 
16.  Unused prize cannot be refunded, transferred or redeemed for cash. All bookings are subject to the terms and conditions of the operators.
 
17.  All bookings must be coordinated and booked through Orion Expedition Cruises.
 
18.  It is a condition of accepting a prize that a winner (and their travel companion) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
 
19.  All additional costs not included in the major prize (including beverages, tips, extra activities, spending money, insurance, passports, visas, taxes not included in the price of ticket, transport to and from departure point, airport transfers and all other ancillary costs) are the responsibility of the winner and their travel companion, except to the extent expressly identified as included in the relevant prize. Compliance with any health or other government requirements is the responsibility of each prize winner and their nominated travel companion. There can be no changes made to travel arrangements by the winner or their travel companion once tickets are issued.
 
20.  The major prize winner and their travel companion are responsible for obtaining (and the cost of obtaining) any medical advice prior to taking the prize and obtaining any recommended medical treatment, including vaccinations and immunisations required by law (or otherwise), before travelling. Any travel insurance to be organised by the winner at his/her own expense.
 
21.  Taking of the major prize is subject to any prevailing terms and conditions of any accommodation/transport/services/transfers or tour providers (where applicable) and in particular, health, behaviour, age and safety requirements. Any part of a prize that is not taken for any reason is forfeited. No compensation will be payable if the winner, or their travel companion, are unable to use any element of the prize as stated for whatever reason, including participation in certain activities for health, behaviour or safety reasons.
 
22.  Use of any passes, tickets or vouchers issued as part of the major prize is subject to prevailing terms and conditions of use and passes. Tickets or vouchers are only valid for use within the duration of the winner’s holiday or the stated duration of the pass, ticket or voucher, whichever is shorter.  The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.  The Promoter accepts no responsibility for any variation in any prize value.
 
23.  In the event that any part of the major prize becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide an alternative prize (including to an alternative travel destination as specified by the Promoter) to the same value and same standard as the original prize as determined in its sole discretion by the Promoter, subject to any written directions made under applicable State or Territory legislation.
 
24.  The Promoter or Orion Expedition Cruises, related bodies’ corporate and respective officers, employees and agents shall not be liable for any loss (including, without limitation, direct, indirect and consequential loss), or for any damage, personal injury or death (including but not limited to that arising from any person's negligence) suffered or sustained in connection with this promotion, or the use of any prize (including but not limited to any component of the winner’s or their travel companion’s trip), except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agencies associated with this promotion takes no responsibility for prizes (or parts of prize) damaged or lost in transit.
 
25.  The Promoter reserves the right to refuse to allow the major prize winner to take part in any or all aspects of the prize, if the Promoter determines, in its absolute discretion, that the winner is not in the mental or physical condition necessary to safely participate in the prize.
 
26.  In the event of any circumstance beyond the control of the Promoter or Orion Expedition Cruises, including any act of God, fire, explosion, flood, war, acts of terrorism, theft, malicious damage, strikes, lockouts or industrial action of any kind, the Promoter reserves the right to either provide an alternative prize (including an alternative travel destination as specified by the Promoter) to the same standard as the original prize as determined in its sole discretion by the Promoter or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.
 
27.  The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
 
28.  Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and any suppliers of components of that winner’s prize. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
 
29.  The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant cannot participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials (including The Australian’s newsletters) via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies who may contact entrants in any of these ways for any of these purposes. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published each winner’s name and locality in any media as required under the relevant lottery legislation. 30.  Cruise and other vouchers comprised in the prize are redeemable once against the price, in whole or in part, of goods and/or services (as specified in the relevant voucher and subject to any terms and conditions) offered by Orion Expedition Cruises.
 
31.  Terms and conditions for Orion Expedition Cruises or Orion vouchers are subject to change.
