Terms and Conditions - Win a Laptop a Day For 30 Days
General

Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this competition deems acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
Who can enter

Subject to clause 4, entry is open to all residents of Australia over the age of 15, as of the date of entry, who have fulfilled the requirements set out below.
Employees, and their immediate families, of the Promoter and associated agencies and companies are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin. The Promoter is EmploymeAustralia Pty Ltd (ABN 57 152 441 195) of 1107/127 Beach St, Port Melbourne Vic 3207.
All entrants under the age of 18 must obtain the prior permission of their legal parent or guardian over the age of 18 to enter. The parent or guardian may be called to verify their consent and may be required to sign a release at the discretion of the Promoter. The release may also require the winner's parent or guardian to accept responsibility for the acts and forbearances of the winner. The release must be completed with the full name, address and telephone number of the winner's parent or guardian. Failure to provide such proof, particulars or releases will immediately invalidate the winner's entitlement to the prize, subject to State and Territory legislation.
How to enter

Entrants can enter the competition by going to www.employmeaustralia.com.au and registering as a job seeker during the Promotional Period (defined below). Each registered job seeker, who has not already won, will stay in the entry pool and be eligible to win a laptop for the duration of the promotion ('Eligible Entries').
Entries must include all requested contact details, including a valid email address, to be eligible to win. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries will be deemed invalid.
Number of Entries permitted

Entrants may register and enter once only.

Open, Close, Draw and Publish dates

The competition commences 15/10/2012 at 07:00 AEDT and closes 13/11/2012 at 23:59 AEDT ('Promotional Period'). Entries must be made via the website prior to the competition close date and time.
The first draw will take place on Tuesday 16/10/2012 at 09:00 AEDT from all valid entries received up to 15/10/2012 at 23:59 AEDT with subsequent draws occurring daily over the Promotional Period also at 09:00 AEDT from all valid entries received up to 23:59 AEDT the day prior to the draw. The final draw will take place on 14/11/2012 at 09:00 AEDT for all Eligible Entries. All draws will be conducted at the Promoter's premises. Over the course of the Promotional Period there will be a total of 30 draws representing one for each day.
The winner of each laptop will be notified by e-mail within two business days of each draw, and their name will be published on the www.employmeaustralia.com.au website and in The Australian newspaper on 21/11/2012.
Prizes will be sent within 28 days of each draw.
The Promoter may conduct such further draws on 14/02/2013 at the same time and place as the original draw in order to distribute any prizes unclaimed by this date, subject to State and Territory legislation. Winners of any further draws will be notified by e-mail within two business days of the draw and their names will be published in The Australian newspaper on 11/03/2013.
Prize on offer

Total prize value is up to $17,970.00 (inc. GST), as at 14/09/2012. There will be a total of 30 winners.

Further Terms and Conditions

The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, SMS entries via the Internet, computer generation and use "scripting" is not permitted and will not be accepted.
Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier's requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
The Promoter reserves the right to request winners to sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
The Promoter's decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner's nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.
Copyright, Statutory guarantees, Waiver and liability

All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. The Promoter and its related entities collects entrants' personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and for related purposes which would reasonably be expected without their permission. For example, from time to time entrants' personal information may be used to provide them with information about products and services which may be expected to be of interest to them. However, an entrants' right to opt out of any further communication from the Promoter will be respected on request. How to enter

To enter, register as a job seeker on the www.employmeaustralia.com.au website and follow the links on the website to the entry page to upload a photo that can be shown to potential employers. Entrants, at the time they upload their entry, will be given the opportunity to share their photo via Facebook and other social media to attract votes from the public. Voting for entrants will be accepted during the Promotional Period. Only one vote per person will be accepted. Only votes cast during the Promotional Period will be accepted. The entrant with the most votes will be the winner.
Entries must include all requested contact details and a suitable photo to be eligible to win. Each entry must be unique and received by the Promoter prior to the competition close date and time.
When to enter

The competition commences on 24/09/2012 at 07:00 AEST and closes on 30/11/2012 at 23:59 AEDT ('Promotional Period'). The winner will be the entrant who receives the greatest number of votes during the Promotional Period. In the event of a tied vote, between 2 or more entrants, the Promoter will judge the winner on the basis of the skill, creativity and originality of the entry on 07/12/2012 starting at 09:00 AEDT.
The Promoter may select additional entries to be used as a replacement in the event that the first entrant determined to be the winner cannot satisfy these Terms and Conditions or take a prize.
The winner will be notified by e-mail and their name will be published online at employmeaustralia.com.au on 10/12/2012.
The prize can be collected by the winner within 28 days of the conclusion of the competition.
Prize on offer
Total prize value is (up to) $16,990 (inc. GST), as at 14/09/2012. One (1) winner will receive a new Kia Rio, valued at up to $16,990.
If the chosen winner of the Kia Rio is under the age of 18 they must hold a current Australian driver's licence as at the date of winning. If a chosen winner under the age of 18 does not hold such a licence, the car will be registered in the name of the winner's nominated parent or adult guardian on behalf of the winner. The Promoter takes no responsibility for petrol, comprehensive insurance, health, transport, body, paint or mechanical damage, or any other costs or damages, from date of delivery. The winner will be responsible for any expenses incurred in getting to and from an Australian capital city and for collecting the vehicle within 28 days. The prize value includes on-road costs. In WA, winners will be responsible for arranging and paying for an immobiliser to be fitted, as required by WA Road Traffic regulations.
Each entrant warrants that the photo they upload is a genuine and accurate representation and that the photo has been taken during the Promotional Period. The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language.
Further Terms and Conditions

The Promoter, subject to State and Territory legislation, reserves the right to amend these Terms and Conditions if this competition cannot be run as originally planned.
