Information on how to enter this promotion and prizes form part of these Terms and Conditions of entry. Entry into the draw is deemed acceptance of these Terms and Conditions of entry. Entry is via
www.visibledifferencecompetition.com.au. The competition will be advertised on this website.
Entry into this promotion is open to all Australian residents aged 18 years and over. Employees of the Promoter and their immediate families, associated agencies of the Promoter and companies associated with the promotion are not eligible to enter the promotion. Any person who within 365 days prior to the day on which the promotion first commenced has won a prize which is greater than or equal to $100 in value from another of the Promoter's promotions is not eligible to enter.
The promotion commences at 12:00 (AEST) on 5 August 2012 and closes at 17:00 (AEDT) on 31 December 2012.
To enter the promotion, participants must:
undertake a skin consultation at any Elizabeth Arden counter in any participating MYER or David Jones retailer or participating pharmacy in Australia ("Consultation"). Participants will receive a code word (in the form of a card at the conclusion of the Consultation), while stocks of code words last. It is the responsibility of the participant to ensure that they receive a code word at the conclusion of the Consultation;

enter the code word received at the Consultation; and
fully complete the online entry form. Entrants will be required to enter their details including name, date of birth, address, phone number, e-mail address and their skin type from the three options available (being Combination, Dry or Oily). One complete and valid online entry will provide the entrant with one entry in the draw.
Incomplete, incorrect and incomprehensible entries will be deemed invalid.
Only one complete online entry form will be accepted from the same email address.
To successfully enter the competition, an entrant must enter their own personal details into the promotion. If an entry is entered on behalf of the participant by a third party, then that entry will be invalidated.
Entries must be received by 17:00 (AEDT) on 31 December 2012. The time of entry will in each case be the time the online entry is received by the Promoter. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
The cost of accessing the promotional website will be dependent on the entrant's individual Internet Service Provider and the responsibility of the entrant.
Major Prize: There will be one (1) x Major Prize Winner. The Major Prize is a trip for the Major Prize Winner and one guest to New York, USA, valued at a maximum of up to AU$11,811.47. The Major Prize includes:
2 x return economy airfares from the Major Prize Winner's nearest capital city to New York, USA valued at a maximum of AU$5,908.47;
7 x night's twin share accommodation in a minimum 4 star hotel, valued at a maximum of AU$2,583.00;
AU$1,000 spending money for the Major Prize Winner;
1 x Iconic Red Door with Shampoo, Blow Dry and Finish for two (2) people, valued at a maximum of AU$1,920. The Iconic Red Door With Shampoo, Blow Dry and Finish includes the following for each person: an olive oil body glow; a 50 minute Red Door Signature Massage; a Red Door Signature Facial; a Red Door Signature Pedicure; a Red Door Signature Manicure; a shampoo, blow dry and finish; and a makeup touch-up;
Return airport/hotel transfers, valued at a maximum of AU$ 400; and
Minor Prizes: There will be ten (10) x Minor Prize Winners. Each Minor Prize Winner will win a 4 step Visible Difference Pack valued at $247 each. Each 4 step Visible Difference Pack includes:
1 x 200ml Visible Difference Toner, valued at $40;
1 x 125ml Visible Difference Cleanser, valued at $40;
1 x 50ml Visible Difference Serum, valued at $89; and
1 x 50ml Visible Difference Moisturiser, valued at $78.
The total prize pool is valued at a maximum of AU$14,281.47.
The draw will take place at the premises of Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250 at 14:00 (AEDT) on 7 January 2013. The first valid entry drawn will receive the Major Prize. The next ten (10) valid entries drawn, after the winning entry for the Major Prize is drawn, will each receive a Minor Prize. All winners will be notified by phone and by e-mail within 2 business days of the draw date. The Major Prize Winner will have their details published in the public notices section of The Australian Newspaper on 14 January 2013.
All prizes must be claimed by 09:29 (AEST) on 8 April 2013 and if, at this time, any prizes remain unallocated or unclaimed, (including after all reasonable efforts by the Promoter to contact the winners, the winners cannot be contacted using the details on their entry form), a further draw for such prizes will be conducted at 09:30 (AEST) on 8 April 2013 at the premises of Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250 (subject to any directions given under all State Regulations). Any Unclaimed Prize Winner will be notified by phone and by e-mail within 2 business days of the draw date. In the case of an Unclaimed Major Prize Winner, they will have their details published in the public notices section of The Australian Newspaper on 15 May 2013.
Only one prize per household will be awarded (SA residents are entitled to win more than one prize). In the event that two (2) people from the same household win two (2) separate prizes in this promotion, the first prize drawn will be awarded to that drawn winner and the remaining prize will be redrawn. In the event that an entrant wins more than one (1) prize (except for SA residents), the first prize won will be awarded and the remaining prizes will be redrawn.
Travel must be taken by 30 June 2013. All travel arrangements, return economy flights, accommodation, transfers and events including dates, times, logistics and mechanics are at the discretion of the Promoter and must be taken as specified by the Promoter. If the Major Prize Winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the Major Prize within the time stipulated by the Promoter then the prize will be forfeited by the Major Prize Winner. Cash will not be awarded in lieu of the Major Prize or any element thereof.
The Major Prize Winner and travelling companion must travel at the same time and must depart from the same capital city and are responsible for transport to and from their residence to their nearest capital city for flight departure.
The Major Prize Winner and their travelling companion are responsible for all other expenses including additional spending money, meals, drinks, additional transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the Major Prize), energy surcharges, gratuities, services charges, passports, travel insurance, items of a personal nature, in-room charges and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline. The Major Prize is subject to the standard terms and conditions of individual prize and service providers.
A credit card imprint or cash deposit may be required from the Major Prize Winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination.
Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
As a condition of accepting a prize, a winner (and any companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
By accepting a prize, the winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter's decision is final and no correspondence will be entered into.
Prizes will be awarded to the person named in the entry. Prizes are not exchangeable, transferable or redeemable for cash. All entries are deemed to be received at the time of receipt into the Promoter's database, and not at the time of transmission by the entrant.
All prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If the prizes (or any portion of a prize) are unavailable for whatever reason, the Promoter reserves the right to substitute that prize (or that portion of the prize) for a prize of similar value subject to state regulation.
Nothing in these Terms and Conditions of entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
The Promoter and each of their related bodies corporate, associated agencies, and companies associated with this promotion will take no responsibility for any delay in delivery once prizes have left the Promoter's premises.
The Promoter reserves the right to request entrants and/or winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that an entrant or winner cannot provide suitable proof of identity, the entrant or winner will forfeit their entry/prize in whole and no substitute will be offered.
All entries become the property of the Promoter. The Promoter collects personal information about the entrant to enable them to participate in this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) but no further use of this information will be made without prior consent. Entrant's personal information may be disclosed to State and Territory lottery departments and winners names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner's surname, initial and state. A request to access, update or correct any information should be directed to the Promoter using the contact details set out in clause 38 below.
If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the promotion, subject to state regulation.
STANDARD OPT-IN: All opt-in entries for the promotion will become property of the Promoter. All opt-in entries will be entered into a database and the Promoter and its related bodies corporate may use the entrants' names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on the details set out in clause 38 below. Any request to update, modify or delete the entrant's details should be directed to the Promoter. Information collected pursuant to the promotion from entrants is subject to the privacy policy of the Promoter, which can be obtained at the Promoter's website (

In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to state regulation.
The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this promotion by any person who tampers with or benefits from any tampering with the entry process or with the operation of the promotion or acts in violation of these Terms and Conditions of entry, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person, subject to State/Territory regulation.
