THE FINE PRINT
All entrants must be 18 years of age or over and hold a valid ticket to Homebake 2012 (or will have purchased a valid ticket to Homebake 2012 before 8 December 2012).
The Minor Prizes do not include admission into Homebake 2012. If a Minor Prize winner or his/her guest does not possess a valid admission ticket to Homebake, the Minor Prize will be forfeited in full and no substitute will be offered in lieu.
The Prize winners and their guests’ participation on the Channel [V] Ele[V]ator is expressly subject to them signing the necessary releases required by the Promoter and being in satisfactory mental and physical conditions necessary to safely take part.

CHANNEL [V] “HOMEBAKE ELE[V]ATOR” COMPETITION
TERMS AND CONDITIONS
ENTRY INTO THE COMPETITION
1. Entry into the Channel [V] “HOMEBAKE ELE[V]ATOR” competition (the “Competition”) is open to all
residents of Australia aged 18 years and over who holds (or will hold) a valid entry ticket to
Homebake 2012. The Promoter is FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5
Thomas Holt Drive, North Ryde NSW 2113, Australia (the “Promoter”). Information on how to enter
forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and
conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee)
of the Promoter, the agencies associated with this Competition, FOXTEL, TELSTRA, Optus TV and
their related bodies corporate are not eligible to enter.
3. Competition begins at 10:00am (AEDT) on Monday 22 October 2012 and closes at 11:59pm (AEDT)
on Sunday 25 November 2012 (the “Competition Period”).
4. To enter the Competition and be eligible to win, entrants must:
(a) be aged 18 years and over;
(b) have purchased a valid ticket to Homebake 2012 or will have purchased a valid ticket to
Homebake 2012 by 8 December 2012;
(c) register for membership online at
www.vmusic.com.au;(d) complete the online entry form; and
(e) in 50 words or less answer the following question, “Which band performing on the main
stage at Homebake would like to watch from the Channel [V] Ele[V]ator and why?” the
“Competition Question”).
5. All entries must include the entrant’s name, address, postcode, daytime phone number (including
area code), mobile phone number (if applicable), email address and date of birth. All entries must be
original and must not incorporate material which has been previously published. Incomplete entries or
those which, in the opinion of the Promoter, includes (but is not limited to) any objectionable content,
profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is
each entrant’s responsibility to inform the Promoter if his/her residential address, email address or
phone number changes during the Competition Period.
6. Only one entry per membership per day is permitted during the Competition Period, however, the
answer to the Competition Question in each entry by the same entrant must be unique and original. In
the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed
the intellectual property rights of any third party, that entrant will be disqualified without notice. The
use of any automated software or any other mechanical or electronic means that permits the
participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter
reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify
that entrant without notice.
PRIZE
7. There are fifty (50) x Prizes in total, consisting of one (1) x Major Prize and forty-nine (49) x Minor
Prizes. The Major Prize and the Minor Prizes are together referred to as the “Prizes”:
a) The Major Prize consists of:
I. Two (2) x General Admission tickets (valued at a maximum of $220) to the Homebake
Music, Film, Comedy & Arts Festival on Saturday 8 December 2012 held at The Domain,
Royal Botantic Garden, Sydney City NSW;
II. One (1) x double pass to ride the Channel [V] Ele[V]ator; ONLINE SKILL
III. Return economy airfare to Sydney for the Major Prize winner and a guest from the winner’s
nearest capital city, valued at a maximum of $1200; and
IV. One (1) nights twin-share accommodation in Sydney for Saturday 8 December 2012;
valued at a maximum of $300;
(the “Major Prize”)
b) Each Minor Prize consists of one (1) x double pass to ride the Channel [V] Ele[V]ator;
(NB: The Minor Prizes do not include admission to Homebake. The Minor Prize winners and their
guest must be holders of a valid 2012 Homebake ticket to partake in the Minor Prize) (the “Minor
Prizes”).
8. The Promoter will not, under any circumstances, reimburse the Major Prize winner for the
costs already incurred in purchasing a valid ticket to Homebake. In the event a Minor Prize
winner or his/her guest does not possess a valid admission ticket to Homebake, the Minor
Prize will be forfeited in full and no substitute will be offered in lieu under any circumstances.
9. All Prize winners and their guests‟ participation on the Channel [V] Ele[V]ator is expressly
subject to the terms and conditions set out under „Participation‟ below.
10. The total maximum Prize pool value is up to $1720. The Prize values are the recommended retail
values as provided by the suppliers and are correct at the time of printing. The Promoter is neither
responsible nor liable for any change in the value of the Prize occurring between publishing date and
date the Prize is claimed. All Prize values are in Australian dollars.
11. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes
cannot be exchanged for any other prize/s. The contents of the Prizes will be at the Promoter’s sole
discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying
the Prizes and the venues where the Events are held.
12. The Prizes must be used on the dates and at the venues specified. If a Prize winner is unavailable to
attend or travel for any reason, the Promoter may, at its sole discretion, award the Prize to the next
best entry. The Promoter will not offer a substitute prize under any circumstances.
13. All ancillary costs and expenses incurred in taking and using the Prizes (including but not limited to,
transport to and from the festival, spending money, food and accommodation) are the sole
responsibility of the Prize winners and their guests, unless otherwise expressly stated as included in
the Prize.
14. Entrants are advised that the use of the Prizes may be subject to prevailing terms and conditions of
the venues, prize suppliers and/or event organisers. It is a condition of accepting the Prizes that the
Prize winners and guests comply with all such terms and conditions and it is the Prize winners’
responsibility to first check the tickets and with the venues and/or event organisers regarding any
such applicable terms and conditions before use. The Promoter takes no responsibility for any
cancellations, postponements or any other changes to the events and will not offer a substitute prize
under any circumstances.
15. Only one Prize per person will be awarded.
PARTCIPATION
16. It is a condition of accepting a Prize that a Prize winner and their guest will be required to sign 2 legal
releases: one in a form determined by the Promoter in its absolute discretion and the other a legal
release in a form determined by the entity providing the ride on the Channel [V] Ele[V]ator. Entrants
acknowledge and agree that the Prize involves an inherently dangerous activity. These releases will
require all Prize winners and their guests to release the Promoter and entity providing the ride from
any liability with respect to the Prize and to confirm that the Prize winner and guests’ participate in the
Prize on the distinct understanding that they do so entirely at their own risk. ONLINE SKILL
17. The Promoter reserves the right to refuse to allow a Prize winner or a guest to take part in any or all
aspects of the Prize, if the Promoter determines, in its absolute discretion, that the Prize winner or his
or her guest are not in the mental or physical condition necessary to be able safely to participate in
the Prize.
JUDGING AND AWARD OF PRIZE
18. The Competition will be judged on the basis of originality and creativity at Channel [V], Level 1, 5
Thomas Holt Drive, North Ryde, NSW 2113 on Monday 26 November 2012 at 10:00am (AEDT).
Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via email
or phone on Monday 26 November 2012 and their names published on the Channel [V] website from
Tuesday 27 November 2012. The Prizes must be claimed by no later than Monday 3 December
2012.
19. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the
Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.
AGE
20. All Prize winners and their guests must be 18 years or over.
TRAVEL
21. In the event that a Major Prize winner is a resident of Sydney where the Major Prize will take place
(which shall be determined in the absolute discretion of the Promoter) the flight component of the
Major Prize will be forfeited in full and no substitute prize will be offered under any circumstances.
22. The Major Prize winners and their guests must travel at the same time and must depart from the
same city. It is the responsibility of the Major Prize winners and their guests to ensure that their
personal documentation (including but not limited to passports, Visas etc) is valid. Any expenditure
incurred as a result of not meeting such requirements are the sole responsibility of the Major Prize
winners and guest.
23. The Promoter takes no responsibility for any cancellations, delays, postponements or any other
changes to the flights or other transport arrangements that are part of the Major Prizes and will not
offer a substitute prize under any circumstances.
GENERAL
24. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity,
residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested
by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry
considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize
winner cannot provide suitable proof that Prize winner will forfeit the Prize in whole and no substitute
will be offered.
25. By entering the Competition, each entrant warrants that their entry is their own original work, and that
they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter for ay
costs or loss incurred in the event that this warranty is false.
26. No responsibility will be taken by the Promoter, Channel [V], FOXTEL, TELSTRA or Optus TV for any
changes in dates, times or cancellations or other arrangements that may prevent the Prize winners
from winning the Prizes.
27. The Promoter reserves the right, in its absolute discretion, to disqualify:ONLINE SKILL
a) any entry which, in the opinion of the Promoter, includes any objectionable content,
profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry that is not in
accordance with these terms and conditions or who has in the opinion of the Promoter,
engaged in unlawful or improper conduct that is designed to jeopardise the fair and
proper conduct of the Competition or is generally damaging to the goodwill or reputation
of the Promoter.
28. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the
Prizes to cancel or vary the Competition or to cancel or vary the Prizes in any circumstances,
including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its
absolute discretion):
a) a Prize winner does not satisfy the Competition entry requirements; or
b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond
its control.
29. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it
shall not:
a) be liable to any person for any loss or damage (including loss or damage caused by any
negligence) arising out of, or in connection with, such cancellation, variation or
withdrawal; or
b) be required to conduct the Competition at any other time.
30. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries
are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT
at the time of transmission by the entrant. The Promoter accepts no responsibility for outdated or
incorrect contact details or contact details by which the entrant cannot be contacted during business
hours on the relevant dates.
31. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and
no correspondence will be entered into.
32. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be
excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including
but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result
of taking the Prize or entering the Competition.
33. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988
(Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to,
determining and notifying winners). Entrants are advised that their personal information may be
disclosed to State and Territory lottery departments and their names as the winner may be published
as required under the relevant lottery legislation. Entrants are also advised that from time to time, the
Promoter may disclose your personal information to third parties (including, but not limited to, third
party prize providers) for the purpose of administering prizes or for other purposes contemplated in
these Terms and Conditions.
34. By entering the Competition, all entrants agree that their name, image, biography and entries
(including, but not limited to, any written answers, photographs/images and audio-visual recordings)
may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in
any media for its promotional purposes, without compensation to the entrants, subject to the
Promoter’s privacy policy which is available at
www.vmusic.com.au; for this purpose, each entrant
grants to the Promoter a non-exclusive, perpetual, worldwide, transferable and royalty-free licence in
any such written answers, photographs /images and audio-visual recordings. Each entrant consents
to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the
meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the
entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature
to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
