LIFESTYLE CHANNEL âCAROMA BATHROOMâ COMPETITION
TERMS AND CONDITIONS
ENTRY INTO THE COMPETITION
1. Entry into The LifeStyle Channel âCaroma Bathroomâ competition (the âCompetitionâ) is open to all residents of Australia. The Promoter is FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (the âPromoterâ). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, Caroma, FOXTEL, Telstra, Optus TV and their related bodies corporate are not eligible to enter.
3. Competition begins at 9.00am (AEST) on Thursday 18th October 2012 and closes at 11:59pm (AEDT) on Thursday 6th December 2012 (the âCompetition Periodâ).
4. To enter the Competition and be eligible to win, entrants must:
(a) Go to
www.lifestylechannel.com.au/granddesignsaustralia; (b) complete the online entry form;
(c) via the entry page, upload one photograph of their âGrand Designâ (i.e. a home/property which the entrant owns) (âImageâ), together with the name of their âGrand Designâ (if applicable). Photos should not be any larger than 2MB and must be in JEPG format, and must be taken and submitted by the owner of the property/home only. Entrants should submit the photograph on the basis of what best represents their home/property; and
(d) complete the following question in 25 words or less, âWhat makes your Grand Design so special and why?â (the Competition Question).
5. Eligible entries (including the photo and the response to the Competition Question) will be uploaded to the gallery on the LifeStyle Channel website. Visitors to the gallery (who are members) may rate their favourite image(s). The rating of an image will not be taken into consideration when the Promoter is judging the entries to determine a winner.
6. By entering this Competition, each entrant consents to having the entry (including the Image and answer) and his/her name and state-of-residence information reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional and publicity purposes in perpetuity (including by uploading it to the Competition gallery on the LifeStyle Channel website and/or social media pages), without compensation to the entrant.
7. All Images must be original and must not infringe the intellectual property rights (including copyright) of any third party. By entering the Competition and uploading the Image, each entrant warrants to the Promoter that:
(a) His/her entry (including the Image) is their own original work and he/she owns all rights in the Image and has the full capacity and power to grant the rights and licences set out in these Terms and Conditions;
(b) The Image was taken at a residential property owned by the entrant (or where the entrant is a co-owner of the property, the entrant has the consent from the co-owner(s) to enter this Competition);
(c) where applicable, he/she has obtained all necessary releases and consents from any persons appearing in the Image to enter the Image for this Competition in accordance with these Terms & Conditions; and
(d) he/she will fully indemnify the Promoter against any loss, costs or damages suffered by the Promoter in the event the warranties referred to in this clause is false or incorrect.
6. All entries must include all mandatory information as indicated on the form, which includes (not limited to the entrantâs name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringe the intellectual property rights of any third party, contain any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrantâs responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.
7. Only one entry per household is permitted for this Competition, however, multiple entries per person is permitted, provided that each Image and response to the Competition Question submitted are unique and that the entrant meets the eligibility requirements in clause 4. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (âRepeat Entry Deviceâ). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.
PRIZE
8. There is 1 (one) prize to be won, which consists of $5,196.66 worth of Caroma Bathroom products:

9. The total maximum Prize pool value is $5,196.66. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars. The Prize includes delivery to the Prize winnerâs home by the Prize supplier Caroma. However, the Prize does not include the installation of the appliances, which will be at the sole cost of the Prize winner.
10. The Prize winner must be the homeowner of the house/unit where the Prize will be installed. Following notification by the Promoter (or the Promoterâs agent or Caroma) that an entrant has won the Prize, the Prize supplier Caroma will endeavour to deliver the Prize to the Prize winner at the nominated residential address within 30 days, subject to any special provisions relating to the products and availability.
11. The Prize is not transferable or redeemable for cash. The Prize or any element of the Prize cannot be exchanged for any other Prize. The contents of the Prize will be at the Promoterâs sole discretion. The Prize is subject to availability and the terms and conditions of the entities supplying the Prize. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes. If a Prize is unavailable for any reason, the Promoter or the Prize supplier Caroma will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification. The Promoter and Caroma accepts no other liability or responsibility for any loss incurred by the Prize winner or any other party if the Prize is unavailable for any reason.
12. The Promoter takes no responsibility for any Prizes that are damaged, delayed or lost in transit. It is a condition of accepting the Prizes that each Prize winner must comply with any conditions of use of the Prize and the Prize supplierâs requirements.
13. The Promoter makes no warranties or representations about the fitness for purpose or suitability of any Prize and will not accept responsibility for the quality or fitness for any purpose of any Prize, or the failure of any Prize to be of merchantable quality.
14. All ancillary costs and expenses incurred in taking and using the Prize are the sole responsibility of the Prize winner.
15. All prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
JUDGING AND AWARD OF PRIZE
16. The Competition will be judged on the basis of creativity and originality (including the artistic merit and quality of the photograph and the design shown in the Image) submitted at The LifeStyle Channel, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on 11am on Wednesday 7th December 2012 (AEDT). Chance plays no part in the selection of the Prize winner. The Prize winner will be notified via phone or email on Wednesday 7th June 2012 and their name published on The LifeStyle Channel website from Friday 9th June 2012.
GENERAL
8. All entrants agree to provide the Promoter or the Promoterâs authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoterâs authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered.
9. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights (including copyright) in their entry. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter as a result of this warranty being false or incorrect.
10. No responsibility will be taken by the Promoter, The LifeStyle Channel, FOXTEL, Telstra, Caroma, or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes or using the Prizes.
11. The Promoter reserves the right, in its absolute discretion, to disqualify at any time:
a) any entry (including those judged as a winning entry) which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry (including those judged as a winning entry) that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.
12. The Promoter reserves the right, in its absolute discretion, to at any time, cancel or vary the Competition or to cancel or vary the award of the Prizes including, without limitation, circumstances where in the Promoterâs opinion (which it shall form in its absolute discretion):
⢠a Prize winner does not satisfy the Competition entry requirements; or
⢠the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
13. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
⢠be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
⢠be required to conduct the Competition at any other time.
14. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoterâs database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
15. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
16. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for (and the Prize winner and guest agree to release the Promoter from liabilities relating to) any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury or sickness suffered or sustained including any due to the Promoterâs negligence) as a result of accepting or using the Prize or entering the Competition.
17. The Promoter collects entrantsâ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions.
18. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter and/or Caroma in any media for its promotional purposes, without compensation to the entrants, subject to the Promoterâs privacy policy which is available at
www.lifestyle.com.au; for this purpose, each entrant grants to the Promoter and Caroma a non-exclusive, perpetual, irrevocable, worldwide, transferable and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter or Caroma which may infringe any of the entrantâs moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrantâs authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
19. Entrants are advised that âopt-inâ entries will be entered into a database. The Promoter, and/or (as applicable) third parties involved in promoting this Competition may use the entrantâs names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide and without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants consent to and confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes by the Promoter or wish to update, modify or delete their details should contact the Promoter directly on their details set out below. Entrants can also âopt inâ to have their personal information passed onto these third parties and/or to receive promotional information from third parties (as notified to the entrants in the opt-in stage). If you do âopt inâ, you agree that the storage and use of your personal information will be subject to the relevant privacy policies of those third parties and the Promoter will not be liable for any misuse of your personal information. If you later wish to âopt outâ of receiving third party information you will need to contact that third party directly.
