Terms and Conditions



1.The Ray-Ban Legends Competition (the “Promotion”) is subject to the following terms and conditions (the “Terms and Conditions”). Entry of a photograph, video, description or any other participation in the Ray-Ban Legends Competition by any person is deemed to constitute their unconditional acceptance of the Terms and Conditions. Information on how to enter and prizes form part of these Terms and Conditions.
2.The Promoter is Luxottica Australia Pty Limited (ABN: 58054141150), of Level 1, 393 George Street, Sydney NSW 2000 Australia (the “Promoter”).
3.The Promotion commences at 9am (Sydney time) 3 September 2012 and ends at 5pm (Sydney time) on 25 November 2012 (“Promotional Period”).

Eligible Entrants

4.Entry and nominations are only open to Australian residents over the age of 16.
5.Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
6.Eligible entrants agree to provide accurate, current and complete information relating to their participation in the Promotion. Should an entrant’s contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter in writing.

The Competition

7.Entrants participate in the Promotion by uploading photographs or videos (that comply with these Terms and Conditions) of their unforgettable moment along with a brief description of the unforgettable moment during the Promotional Period directly on the :
(a)website www.rayban.com/australia;
b)Never Hide Ray-Ban iPhone application; or
(c)Never Hide Ray-Ban Facebook webpage.
8.The photographs or videos submitted must have been taken or created within the following period: 25 September 2011 and 25 September 2012. By submitting a photograph or video the entrant warrants that their photograph or video was shot within this period. The Promoter will be in no way responsible for ensuring any photograph or video submitted was created within the defined term.
9.There is no limit to the number of photographs or videos a participant can enter. Videos submitted must not be more than 2 minutes in duration and videos which do not comply with this condition will be deemed ineligible and will not be considered.
10.By participating and uploading a photograph, the participant represents and warrants that he or she:
(a)has personally created the photograph or video that is submitted;
(b)is the sole owner of the photograph or video and any intellectual property in the photograph or video or, if the photograph or video include any copyright works, the participant represents and warrants that it has procured the copyright holder to grant to the participant and the Promoter a world-wide, royalty-free, non-exclusive, transferable licence (including the right to sublicense) to use, copy, modify and communicate such works (which without limitation includes the right to use the works in any future promotional material)
(c)has the consent and permission from anyone pictured within the content to deal with the content in any way whatsoever without remuneration (including for the purposes of this Promotion);
(d)gives the Promoter and its associated agencies and entities permission and licence to use their name, photograph or video and description for promotion, advertising, marketing or other purposes, in perpetuity across all media without further correspondence or remuneration; and
(e)consents to the any infringement by the Promoter of any and all moral rights of the participant in the photograph or video.
11.Any photograph or video entered by the participant can be edited or otherwise modified by the Promoter in its sole discretion.
12.The Promoter shall have full discretion to deem invalid any entry that it considers in its sole discretion:
(a)to be offensive, insulting, defamatory, slanderous, pornographic, vulgar, obscene, pedo-pornographic or otherwise inappropriate; or
(b)may cause damage or offence or that violates any law including laws in respect of intellectual property rights.
13.Subject to these Terms and Conditions, the Promoter shall use reasonable commercial endeavours to ensure that all entries are received and processed. However, the Promoter will be in no way responsible for any entry not being processed due to technical, fault, omission or otherwise. The Promoter accepts no responsibility for any late, lost, not entered or incorrectly entered entries.
14.There is no cost to enter the Promotion levied by the Promoter. However, there may be costs associated with accessing the Website or other online content related to the Promotion. All such costs are the entrant’s responsibility and are dependent on the internet service provider used.

Determining the Winners


15.This Promotion is a game of skill and chance plays no part in the winners.
16.All entry processing, finalist shortlisting, vote qualification and quantification and judging will take place at the office of the Promoter at Level 1, 393 George Street, Sydney NSW.
17.A shortlist of the 50 entries depicting the most ‘unforgettable and legendary moments’ will be determined by the Promoter throughout the Promotional Period. The best 20 valid entries, as determined by the Promoter, will be selected from the shortlist by a judging panel selected by the Promoter at its absolute discretion on Sunday 25 November 2012. The judges’ decision is final and no further correspondence, discussion, compensation or debate will be entered into in regards to the outcome of their decision.
18.All winners be notified via email and telephone by the Promoter and will be published on the Promoter’s website, www.rayban.com/australia.

Prizes


19.20 winners will receive one double pass to the Ray-Ban 75th Anniversary Concert to be held on 5 December 2012 in Sydney and, where a winner does not live in Sydney or whose closest capital city is not Sydney, return flights from the winner’s nearest capital city to Sydney for 2 adults and 1 nights’ twin share accommodation at a Sydney hotel chosen by the Promoter (the “Prize”).
20.Each prize is valued at up to $2,500 depending upon point of departure. The total prize pool value is $50,000.
21.A Prize cannot be redeemed for cash and is non-transferrable. The Promoter accepts no liability and will pay no compensation if a winner is unable to redeem the Prize as described. Once Prizes have left the Promoter’s or its agent’s premises, no responsibility is accepted for prizes damaged, delayed or lost in transit.
22.The Prize does not include ground transport to and from the Ray-Ban 75th Anniversary Concert, meals, beverages or any expenses of a personal nature (including any extra money needed). These are the sole responsibility of winners and their guests.
23.If a winner is under the age of 18 as at the date of the draw, an adult must accept these Terms and Conditions and accompany the minor as the minor’s guest to the Ray-Ban 75th Anniversary Concert.
24.By accepting the prize, each winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
25.In consideration for the Promoter awarding the Prize to a winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the Prize and the winning photograph and/or video and, in so far as legal and beneficial ownership cannot be assigned, grants to the Promoter (and its related bodies corporate) an irrevocable, perpetual, non-exclusive, assignable, sub-licensable, royalty-free, world-wide license to use, copy, display and distribute the photograph and/or video and other content of the participant’s entry into the Promotion and to prepare derivative works or incorporate into other works. Each winner acknowledges that the Promoter is free to use the winning all such material and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
26.Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in Prize value between now and the ultimate prize redemption date.
27.In the event that a Prize item is unavailable despite the Promoter’s reasonable endeavours to procure it, the Promoter reserves the right to substitute a different prize of equal or greater value.
28.The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated Prize delivery address and/or proof of entry in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, that winner may forfeit the Prize in whole and no substitute will be offered.
29.The following additional terms and conditions apply to the travel component of the Prize:
(a)the winners and their guests must be available to travel to and stay at the hotel to be notified by Promoter on the dates specified by the Promoter to coincide with the Ray Ban event. Travel insurance is advisable for prize winners and, if it is to be taken, must be arranged by the winners and/or their guests at their own cost;
(b)it is the sole responsibility of the prize winners and their guests to ensure that their personal documentation is valid. Any expenditures incurred as a result of not meeting such requirements are the sole responsibility of the prize winners and/or their guests;
(c)in the event that a prize winner is a resident of Sydney or their nearest capital city is Sydney, the flight component and the accommodation component will be forfeited in full and no substitute will be offered. Where a prize winner is not a resident of Sydney or their nearest capital city is not Sydney, that prize winner and their guest must depart and return to the same capital city nearest to the winner’s address;
(d)the entire cost of the airline ticket (including taxes and other charges) and the hotel accommodation is included in the Prize. All other ancillary costs incurred in taking and using the prize (including but not limited to transfers to and from airport, meals, mini bar, spending money and insurance) are the responsibility of the winner and their guest. Unless expressly stated as being part of the Prize, all other expenses are the sole responsibility of the prize winners and their guests;
(e)Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize; and
(f)the Promoter reserves the right to refuse to allow the prize winners or guests to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that a prize winner or his or her guests are not in the mental or physical condition necessary to be able safely to participate in the prize.

Eligible Entrant’s Information


30.Entrants are required to provide personal information to enter the competition, including their first and last name, residential address, photographic, written and audio/visual material and email address.
31.Without limitation, the information provided by an entrant to the promotion may be used:
(a)as part of sales campaigns, contests, invitations and loyalty programs without any further reference, payment or other compensation to the entrant; and
(b)to communicate with finalists and winners.
32.The Promoter collects the information that entrants choose to provide to us – for instance by providing us with information by entering into a promotion (including this Promotion) that the Promoter is conducting. The Promoter adheres to privacy legislation by only using your personal information for the purpose it was collected or consented to be collected (for instance by agreeing to separate terms and conditions), and for directly related secondary purposes. By entering the Promotion, entrants agree that the Promoter and its related entities may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. For websites you visit in connection with us, the collection, use and management of your personal information while visiting the websites may be governed by additional privacy policies and terms and conditions. Rights of the Promoter


33.The Promoter reserves the right, at any time, to verify the validity of entries and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry/voting process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
34.If, for any reason, the Promotion is not capable of running as planned due to any reason including, but not limited to, infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion.
35.The Promoter reserves the right to disqualify any entrant who in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, infringes third party intellectual property rights, is misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter or its related entities. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
36.Nothing in these conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under any similar consumer protection laws in the States and Territories of Australia. The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
37.The Promoter reserves the right to change or amend any of the Terms and Conditions upon notification to entrants and in no way is held responsible for any consequential losses or actions stemming from these changes.
38.The Promoter’s decision in all matters is final and binding.
