Entry is only open to Australian residents aged 18 years or over. Individuals must have a Facebook account in order to access the promotional page.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 9:00am AEDST on 08/10/2012 and ends at 12:00noon AEDST on 19/11/2012 ("Promotional Period").
To enter, individuals must complete the following steps during the Promotional Period:
a)visit the SEEK Facebook Page at
http://www.facebook.com/SEEK ("Facebook Page");
b)become a fan of the Facebook Page by clicking the 'like' button (if not an existing fan of the Page);
c)follow the prompts to the promotion entry page;
d)
specify their "calling" by selecting their preferred industry of study from the drop-down menu;
e)select a minimum of five (5) and maximum of twenty-four (24) song tracks from those available on the Spotify platform to make an original compilation that they feel best matches/represents their "calling" (i.e. their nominated industry of study). Any one (1) artist cannot be featured more than once in the same compilation;
f)select a unique and creative compilation title that represents their "calling" (i.e. their nominated industry of study) and their compilation song selections;
g)input the requested personal details (including their full name, telephone number and a valid email address); and
h)submit the fully completed entry form so it is received by 12:00noon AEDST on 19/11/2012.
Submissions (including but not limited to the song tracks and compilation title) must comply with the Content submission conditions as outlined in clause 22 below.
By submitting an entry into the promotion, each entrant agrees that the Promoter may publish the compilation and compilation titles submitted in any media for an indefinite period, without reference or payment to the entrant.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The judges may select additional reserve entries in each judging round which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
Winners will be notified by telephone and email.
This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the following criteria:
a)the originality and creativity of the music compilation and how well the song selections represent their "calling" (i.e. the industry of study selected); and
b)the originality and creative merit of the compilation title, and how well the compilation title represents their "calling" (i.e. the industry of study selected).
The Promoter's decision is final and no correspondence will be entered into.
There will be six (6) Minor Prize judging rounds and one (1) Grand Prize judging round conducted for the entries received during the Promotional Period. Entries into each Minor Prize judging round open at 12:01pm AEDST and close at 12:00noon AEDST on the dates outlined in the table below, with the exception of the first Minor Prize judging round where entries open at 9:00am AEDST on 08/10/2012 and close at 12:00noon AEDST on 15/10/2012. Entries into the Grand Prize judging round open at 9:00am AEDST on 08/10/2012 and close at 12:00noon AEDST on 19/11/2012. Entries in each Minor Prize judging round will NOT be entered into any subsequent Minor Prize judging round but will be entered into the Grand Prize judging round.

Grand Prize 08/10/2012 19/11/2012The best fifteen (15) valid entries in Minor Prize judging rounds 1 to 5 and the best twenty-five (25) valid entries in Minor Prize judging round 6, as determined by the judges, will each win a 12 month Spotify premium membership, valued at $143.88 ("Minor Prize").
The best valid entry received during the entire Promotional Period, as determined by the judges, will win $5,000, awarded in the form of a cheque ("Grand Prize").
Any ancillary costs associated with redeeming the Spotify membership are not included. Any unused balance of the Spotify membership will not be awarded as cash. Redemption of the Spotify membership is subject to any terms and conditions of the issuer including those specified on the Spotify website. See spotify.com.au for details.
If for any reason a winner does not take/redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
When an entrant submits any comments, compilation titles and their choice of songs in the compilation ("User Content"), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such User Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
Entrants agree that they are fully responsible for any User Content that they submit and for the content of the songs that they select from the Spotify platform for their entry ("Song Content"). The Promoter shall not be liable in any way for User Content and/or Song Content to the full extent permitted by law. The Promoter may remove any User Content and/or Song Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any User Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, or may be defamatory; (b) that they will not submit any User Content or select any Song Content that is obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the User Content, to the uses and terms herein; (d) their User Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Facebook Page is the entrant's responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt-out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
