One (1) 2012 Jeep Grand Cherokee Laredo – 3.0L diesel with automatic transmission valued up to AU$55,000 which includes all on road costs, compulsory third party insurance, registration, stamp duty and dealer delivery charges (the value of which may vary State by State).
Total prize is valued up to AU$190,701 (including all on-road costs, which may vary State to State).
Prize does not include petrol or any other additional insurance or ancillary costs.
The winner must be over the age of 18 years to redeem the prize and have a current Australian drivers licence. It is a condition of entry that the winner provides the Promoter with certified copies of all required documentation before the car is handed over to the winner. Winner will be informed of documentation required at time of notification of winning. The Promoters take no responsibility for any mechanical, body or paint repairs required from the date and time of delivery. All costs associated with providing required documentation will be the responsibility of the winner.
If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner (or the winner’s parent/legal guardian if the winner is under the age of 18) may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
The winner must collect the Airstream 762 “International Series” Travel Trailer at the Handover Presentation, and must make their own way to the Handover Presentation venue to collect the prize. Spending money, meals, insurance, transport, items of a personal nature and all other ancillary costs are not included. Date of Handover Presentation is subject to booking and availability.
Prize is subject to the standard terms and conditions of individual prize and service providers.
Prize must be taken as offered. Unless stated above, prize is not transferable or exchangeable and cannot be taken as cash.
The winner will be provided with an official letter announcing their prize winning status within 28 days on the draw. The winner must present the original letter announcing their prize winning status when redeeming both the Airstream 762 “International Series” and the Jeep Grand Cherokee Laredo.
The Airstream 762 “International Series” will be delivered to the Airstream Head Office within three months of the draw (subject to delivery restrictions from the USA) for collection by the winner. Airstream Head Office is 30 Cranbrook Rd Batemans Bay NSW 2536, ABN 60 156 335 769 (“Airsteam”).
The winner must collect the Jeep Grand Cherokee Laredo from their nearest Chrysler Jeep Dodge dealership (as nominated by Chrysler) no later than 30 April 2013. NOTE: This collection date may be extended if there are any delivery delays from the manufacturer.
Should a vehicle colour selected by the winner not be available for whatsoever reason at the time of collection, the Promoter will procure Chrysler Australia Pty Ltd ABN 23 125 956 505 of 437 Plummer St Port Melbourne, VIC 3207 (“Chrysler”) to provide the winner with their preferred car colour, but colours cannot be guaranteed and are subject to availability.
The Prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
If the winner of the Prize is under the age of 18 years, the Prize will be awarded to the winner’s nominated parent or guardians on the winner’s behalf.
As a condition of participating in the promotion and of accepting the Prize, the winner (or his/her parent/guardian, if under the age of 18) must sign any legal documentation as and in the form required by the Promoter and/or Chrysler in their absolute discretion, including but not limited to a legal release and indemnity form.
There are restrictions when towing a caravan of this size with a Grand Cherokee. These are outlined on the following towing guide. The diesel Laredo is capable of towing 3500KG - but only if the van is evenly loaded and not exceeding its max weight (which is 3447kg). Additionally, when towing this weight, the vehicle can only take three occupants at 68kg with 7kg of luggage each. It is recommend that stabilizer and sway bars are utilized.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, Airstream and Chrysler (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, Airstream and Chrysler (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/or (g) use of the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to: (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
In the event of war, terrorism, state of emergency or natural disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion with reference to all relevant state and territory regulations.
It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter, Airstream and/or Chrysler at their discretion.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The Promoter may conduct a further draw at the same time and place as the original draw as necessary on 8/05/2013 in order to distribute the prize if it remains unclaimed by that date subject to reference to all relevant state and territory regulations and any written directions. The winner will be notified in writing within 2 business days of the draw and the winner’s name will be in the Public Notices section of The Australian on 15/05/2013.
The Promoter, Airstream and Chrysler are not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, to publish the winner's name and locality as required under the relevant lottery legislation and, as required, to provide winner’s information to Australian regulatory authorities without any further reference or payment or other compensation to the entrant. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
