Yarra Burn Facebook Twin Pack Promotion Conditions of entry
Information regarding prizes and how to entering, entrants accept these conditions. enter forms part of these conditions.
By Entry is open only to Australian residents (excluding Northern Territory residents), aged or over except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this competition.
The competition begins at 12.01am (AEST) on 02/11/12 and closes to entrants 11.59pm (AEST) on 14/02/13 (Competition Period). The competition ends either: at
on the final draw date, being 15 February 2013 in accordance with clause 8; or
if necessary, on the draw date for any unclaimed prizes, being 23 July 2013 in accordance with clause 13.
To enter, entrants must, during the Competition Period, either:
visit the Yarra Burn website at www.yarraburn.com.au (Website); click on the entry button to be redirected to the promotional entry page on the Yarra Burn Facebook page (Facebook Page); if the entrant has not previously done so, click on the “like” button on the Facebook Page; and fully complete and submit the online registration form (including by providing their full name, date of birth, email address, postal address and post code); or
visit the Facebook Page and if the entrant has not previously done so, click on the “like” button on the Facebook Page; and fully complete and submit the online registration form, including by providing their full name, date of birth, email address, postal address and post code.
Entrants are responsible for their own costs associated with accessing the internet.
Once an entrant has entered the competition, the entrant may be given the option to click on the “Share with your Friends” button. If an entrant clicks on this “Share with your Friends” button, the entrant will be prompted to select individual friends from Facebook and if selected by the entrant, those friends will receive an invitation to enter the competition. Entrants warrant that any person who receives an invitation has consented to the receipt of that invitation. For the avoidance of doubt, the invitation of friends will not increase the entrant’s chance of winning the competition.
Each entrant will receive an online notification confirming their successful entry into the competition. By entering this competition, entrants consent to receiving this electronic message.
All entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter and not at the time of submission by the entrant. Maximum 1 entry per person. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise including failure of any event to forward entry forms to the draw location. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
Draws
Draws will be conducted at 2:15pm (AEST) every Friday commencing 09/11/12 and ending 15/02/13 (15 draws) at Kinetic Marketing, 201 Darling St, Balmain, NSW 2041. Where a draw date falls on a public holiday in New South Wales, the draw will take place on the next New South Wales business day. There will be a total of 15 prize winners (1 prize winner every week for 15 weeks) determined as follows:
the first valid entry randomly drawn in each draw from all valid entries received during the Competition Period (excluding the draw date) will win a prize; and
if no entries are received during any particular competition week, the draw will be postponed to the next draw date and an additional draw will take place on that draw date from all valid entries received previous to that draw date.
There will be a maximum of 26 x 750ml bottles of Yarra Burn range wine awarded to entrants residing in NSW throughout the Competition Period. Once 26 x 750ml bottles have been awarded to entrants residing in NSW, any further winning entries from NSW will be deemed invalid and will be discarded, and the remaining prizes will be awarded to entrants from ACT/QLD/VIC/SA and TAS. No substitute prize or compensation will be awarded to subsequent NSW entrants whose entries are drawn after the maximum of 26 x 750ml bottles have been awarded to NSW entrants.
There are a total of 15 prizes to be won. Each prize is 2 x 750ml bottles of Yarra Burn wine valued at $24 (inc GST). The total prize pool is valued at $360 (inc GST).
The winners will be notified in writing (via email) within 2 days of the draw. The Promoter may publish the name of the winners on the Website and/or the Facebook Page.
The winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their names and images in promotional material.
If a winning entry is deemed not to comply with these conditions of entry, that entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry in accordance with paragraph 8. The judges’ decision is final and no correspondence will be entered into.
If any prize is not accepted or claimed within 3 months of the last draw date, the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws on 23/07/13 at the same time and location as the original draw as are necessary to distribute any remaining prize/s, subject to any requirements of any gaming authority. Any winners in this draw will be notified in writing (by email).
The Promoter may require winners to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who (or who the Promoter in its sole discretion suspects): (a) tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions; (b) acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person; (c) enters the competition using multiple, non-current, invalid or illegitimate email addresses, facebook accounts and/or aliases; or (d) acts in a fraudulent or deceptive manner or otherwise attempts to enter via illegitimate means.
This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.
The prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the gaming authorities in each state and territory if required.
The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
If for any reason any aspect of this competition is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required.
The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. Unless the entrant has marked the “opt-out” box on the entry form, each entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the entrant via electronic messaging (and entrants consent to receiving SMS or email messages from the Promoter that do not contain any functional unsubscribe facility). Entrants can update their personal information or request access to the personal information the Promoter holds about them by contacting the Promoter. All correspondence should be to the attention of the General Counsel.
