TERMS AND CONDITIONS:

1.  Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
2.   Entry is open to residents of Australia who have a valid YouTube account and are 18 years or over (“Eligible Entrant”). Employees of the Promoter, their immediate families, related companies and agencies associated with the Competition are ineligible to enter.
 
3.    The Competition commences at 9am Australian Eastern Standard Time (“AEDST”) on Thursday 1 November 2012 & closes at 12 noon AEDST on Sunday 16 December 2012 (“Competition Period”).
 
4.    To submit an entry the Eligible Entrant must upload a recent video of themself making a musical sound with their mouth inspired by the new DRUMSTICK Rock & Pop products
 
5.    Follow these steps to submit an entry:
 
a)    Record a Video of yourself making any kind of musical sound with your mouth, inspired by the two new DRUMSTICK flavours, Rock and Pop
 
b)    Upload your Video to your YouTube account
 
c)    Go to www.facebook.com/DRUMSTICKAustralia or www.youtube.com/DRUMSTICK Australia, enter your details & submit your Video
 
d)    Video is ‘pending’ until approved by the Promoter
 
e)    Share your entry with your friends to vote
 
6.    The Video must meet the following Video Requirements:
 
(a) it must be your original work;

 
(b) it must not be derogatory, offensive, threatening, defamatory or contain any content that is inappropriate, indecent, sexual, discriminatory in any way, or that promotes hatred or harm against any group or person;
 
(c) it must not contain any content, material or element authored by a third party;
 
(d) it must not contain any background music other than original music prepared by you, nor any advertising, slogan, logo or trademark that indicates a sponsorship or endorsement by a third party or commercial entity;
 
(e) it cannot be longer than thirty (30) seconds;
 
(f) it must be in a format accepted on YouTube;
 
(g) it must comply by the YouTube Terms: http://www.youtube.com/static?gl=US&template=terms and YouTube Community Guidelines: http://www.youtube.com/t/community_guidelines.
 
7.    During the Competition Period, the Promoter and its agency will be evaluating each Video to
 ensure that it does not violate the Video Requirements.
 
8.    Entry is limited to once per Eligible Entrant.
 
9.     Voting is restricted to 1 vote per IP over a 24 hour period.
 
 
 
10. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entrant for tampering with the entry process, including but not limited to using an image that is not an image of themself, providing information that is false, defamatory or offensive, making multiple entries, submitting an entry that infringes the copyright of a third party or for otherwise submitting an entry that is not in accordance with these terms and conditions.
 
 
 
11. The Prize is a trip for 4 people to attend Coachella in April of 2013 consisting of: economy class flights for 4 people to Los Angeles, United States, from the winner’s nearest capital city in Australia, 3 nights accommodation for 4 people in Palm Springs, 2 nights accommodation for 4 people in Los Angeles, rental car for the duration of the trip (seating for up to 4 people), 4 General Admission Tickets to Coachella 2013, transfers to and from the hotel and festival each day (for 4 people) and 24 hour winner assistance hotline for the duration of the trip. Full prize fulfilment and winner management from iMAR Entertainment. Prize valued at $18,700 AUD (based on current conversion rate on date of first publication).
 
 
 
12.  The Prize is not transferable and cannot be taken as cash.
 
 
 
13. In accepting the Prize, the Winner must have a valid Australian driving license and agree to pay any excess should the car be damaged. The Winner and their 3 friends must have valid Australian passports. They must take out their own travel insurance and obtain their own USA visas. The Winner must have a valid credit card so any additional hotel charges incurred not covered within the Prize can be charged.
 
 
 
14. This competition is a game of skill and chance plays no part in determining the identity of a successful entrant. The successful entrant will be determined by the entrant who receives the highest number of valid votes subject to the Promoter’s absolute discretion.
 
 
 
15. In order to claim the Prize, a successful entrant must confirm that they are available to participate in the Prize within 48 hours of being advised they are the winner from the Promoter.
 
 
 
16. The Promoter retains the absolute discretion to withdraw from a successful entrant the offer to participate in the Prize, including but not limited to if a successful entrant fails to confirm their availability to participate in the Prize. If the Promoter withdraws the offer from a successful entrant, the Promoter retains the absolute discretion to choose or not choose another entrant to whom to offer the Prize.
 
 
 
17. The name and postcode of the winner will be announced on the DRUMSTICK Australia Facebook Page and the DRUMSTICK Australia YouTube Page by close of business on Friday 21 December 2012.
 
 
 
18. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or participating in the prize, except for any liability which cannot be excluded by law.
 
 
 
19. All entrants’ information will be held in accordance with the Peters Privacy Policy which can be accessed by visiting www.drumstick.com.au. All personal information required to enter is for one-time use only and limited to this competition. The Promoter may disclose claimants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants. Entrants may choose to provide their personal information to receive further communication from Peters by selecting the opt-in checkbox.
 
 
 
20. The Promoter’s decision is final and no correspondence will be entered into.
 
 
 
21. Entrants release Facebook and YouTube from all liability in relation to the Competition. Entrants acknowledge that this Competition is in no way sponsored, endorsed or administered with Facebook or YouTube and that any information provided by entrants is provided to the Promoter and not to Facebook and YouTube.
 
 
 
22. By entering the competition each entrant acknowledges that the Promoter may use their video submission for any marketing purpose in perpetuity, including but not limited to publicity and promotional purposes in any broadcast, web and/or print media (including but not limited to the DRUMSTICK Australia Facebook Fan Page), without compensation. It is a condition of accepting the Prize that the successful winner acknowledges that the Promoter acquires the right to use their video submission for commercial purposes, agrees not to object to any such use on the basis of any moral right and warrants that the video submission is his/her own original work and does not infringe the copyright of any third party.
 
 
 
23. If for any reason this Competition is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Competition, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Competition. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
 
 
 
24. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Competition.
