1. DEFINITIONS
1.1. "Eligible Entrant" means any business that has entered through the landing page and has a valid email address. Eligible Entrants are not directors or employees of the Promoter and are not immediate families of the Promoter's employees.
1.2. The "Entry Period" begins at 12:01 am (AEDT) on 1st November 2012
and closes at 11:59pm on 31st December 2012. The promoter must receive all submissions via Internet by 11:59pm (AEDT) on 31st December 2012.
1.3. "Landing Page" means
www.powerbuy.com.au/promo1.4. "Participant" means any individual that successfully likes PowerBuys facebook page via the Landing Page.
1.5. "Prize" means an Apple iPad Mini (1st gen) 16GB WiFi valued at $369.
1.6. "Promoter" means Bold Blue Holdings Pty Limited (ACN 132 582 462) of L3, 30 Alfred St MILSONS POINT NSW 2061 trading as "PowerBuy Technologies".
1.7. "Winner" shall mean an Eligible Entrant of the draw who is successfully drawn at random to win the Prize.
2. ENTRY INTO DRAW
2.1. Entry is only permitted during the Entry Period via the Landing Page. All entry instructions and prize information published by the Promoter form part of these conditions.
2.2. Entry is free and only Participants who are deemed to be Eligible Entrants qualify for the draw.
2.3. The Eligible Entrant must use a compatible browser to visit the Website during the Entry Period and correctly complete the entry form on the Landing Page.
2.4.
Each Eligible Entrant may only enter the draw once during the Entry Period. Any contact details entered incorrectly on the Landing Page shall be deemed invalid and will result in an ineligible entry.
2.5. No entries will be accepted after the Entry Period lapses.
2.6. Any Participant who is not an Eligible Entrant and who does not comply with the terms and conditions herein (or such other terms and conditions and guidelines as the Promoter may specify from time to time) will be disqualified. The Promoter reserves the right to disqualify any entries (in its absolute discretion) in contravention of these terms and conditions.
2.7. The decision of the Promoter on when a submission is received is final.
3. THE DRAW
3.1. The judging will be held at L3, 30 Alfred St MILSONS POINT NSW at 10am (AEDT) on 3rd January 2013.
3.2. There is only one (1) Winner.
3.3. The Winner is chosen at random.
3.4. The Winner will be notified at the conference and in writing sent by e-mail to the address providing on the entry form within seven days of the judging. All reasonable steps to notify the Winner of the results of the draw will be taken by the Promoter.
3.5. The decisions made by the Promoter and/or its appointed judges are final and binding and no appeals shall be entertained for any reasons whatsoever.
3.6. The Winner must claim the prize by providing postage details by no later than 30th January 2013.
3.7. The prize will be delivered to the Winner via registered post.
3.8. The Winner acknowledges and agrees to their details being published on PowerBuy's website at
www.powerbuy.com.au within seven (7) days of judging for a period of at least one (1) month.
3.9. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
3.10. The Promoter reserves the right to request the Winner to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) before issuing the prize in order to confirm the Winner's identity and eligibility to enter and claim a prize.
3.11. False and/or deceptive entries or acts shall render Participants ineligible.
3.12. The Winner must, if requested by the Promoter, agree to and sign a form confirming their compliance with these conditions and eligibility to enter the competition and accept the prize before being awarded their prize. It is also a condition of accepting a prize that the Winner of a prize may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. A Winner who does not comply with this condition forfeits the prize.
3.13. If the Winner does not claim the prize, then the Promoter will conduct further judging on 3rd February 2013 at L3, 30 Alfred St MILSONS POINT Sydney at 10am (AEDT). The Winner of the Promoter's further judging will be notified by email before 5th January 2012. The Winner of the further judging prize will also be published on the PowerBuy website (
www.powerbuy.com.au) within seven (7) days of the judging for a period of at least one (1) month.
4. IMPORTANT INFORMATION
4.1. The Promoter takes no responsibility for late or misdirected online registration forms or any delays or failures in any telecommunications services or equipment.
4.2. The Promoter does not warrant that the content and delivery of this website shall be free from errors, bugs or viruses, or interruptions.
4.3. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for personal injury suffered or sustained, as a result of taking part in, the winning or use of any of the prizes, except for any liability which cannot be excluded by law.
4.4. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to Participants or any other person's computer and profile related to or resulting from participation.
4.5. The Promoter collects the Participants personal information in order to conduct the competition. If the information requested is not provided, the Participant may not participate in the competition.
4.6. All entries become the property of the Promoter. By taking part, the Participant irrevocably consents to the use of all information contained within the entry for marketing purposes by the Promoter.
