Win the complete Beatles vinyl box set




MAX is giving the biggest Beatles fan it can the chance to win the ultimate collector piece - the entire Beatles catalogue remastered vinyl box set.

Containing 16 of the bands albums, as well as a massive, hard cover book that includes pictures and stories on each album, as well as a look at the remastering process (it also weighs just under 10kgs!).

But we won't be giving this prize to just anyone - we want to give it to the ULTIMATE Beatles fan - and you're going to have to prove yourself.

As well as answering the question in 25 words or less,  “Why are you the ultimate Beatles collector?” you'll have the chance to Enhance your entry with a Twitter photo.

Include a photo with you and your mega Beatles collection by uploading your photo to Twitter and including the hashtag #MAXBeatles, then enter the link to your photo in the entry form below.

The competition closes at 11:59pm (AEDT) on Sunday, December 9, 2012.

ENTRY INTO THE COMPETITION
MAX “BEATLES VINYL BOX” COMPEITION TERMS AND CONDITIONS

1. Entry into the MAX “Beatles Vinyl Box” competition (the “Competition”) is open to all residents of Australia. The Promoter is FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions. Entry into the Competition is deemed acceptance of these terms and conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, TELSTRA, Optus TV and their related bodies corporate are not eligible to enter.
3. Competition begins at 10:00am (AEDT) on Wednesday14 November 2012 and closes at 11:59pm (AEDT) on Sunday 9 December 2012 (the “Competition Period”).
4. To enter the Competition and be eligible to win, entrants must:
(a) go to the MAX website at www.maxtv.com.au;
(b) complete the online entry form; and
(c) in 25 words or less answer the following question, “Why are you the ultimate Beatles
collector?” the “Competition Question”).
Entrants also have the opportunity to support their entry by showing their commitment to being a Beattiles fan by submitting via Twitter at the hashtag #MAXBeatles a photo of him/her self with
their Beatles collection. This is not a mandatory component of the Competition. Only ONE photograph can be submitted along with each entry. The written answer to the Competition Question in each separate entry must be unique and original and does not contain any material which has previously been published or communicated, but the photograph submitted may be the same as one previously submitted by that entrant, or, at the entrant’s discretion, be a new and unique photo.
5. All entries must include all mandatory information as indicated on the form, which includes (not limited to the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringe the intellectual property rights of any third party, contain any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.
6. Only one entry per membership per day is permitted during the Competition Period, however, the answer to the Competition Question in each entry by the same entrant must be unique and original. In the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed the intellectual property rights of any third party, that entrant will be disqualified without notice. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.
PRIZE
7. There is (1) x prize to be won in total, that consists of One (1) x Limited Edition VINYL BOX SET by ‘The Beatles’, valued at $499 (including GST (the “Prize”).
8. The total maximum Prize pool value is up to $499.
The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.
9. The Prize is not transferable or redeemable for cash. The Prize or any element of the Prize cannot be exchanged for any other prize/s. The contents of the Prize will be at the Promoter’s sole discretion. The Prize is subject to availability and the terms and conditions of the entities supplying the Prizes. If the Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification. The Promoter accepts no other liability or responsibility for any loss incurred by the winner or any other party if the Prize is unavailable for any reason.
10. The Promoter takes no responsibility for any Prizes that are damaged, delayed or lost in transit. It is a condition of accepting the Prizes that each Prize winner must comply with any conditions of use of the Prize and the Prize supplier’s requirements.
11. The Promoter makes no warranties or representations about the fitness for purpose or suitability of any Prize and will not accept responsibility for the quality or fitness for any purpose of any Prize, or the failure of any Prize to be of merchantable quality.
JUDGING AND AWARD OF PRIZE
12. The Competition will be judged on the basis of originality and creativity at MAX, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Monday 10 December 2012 at 10:00am (AEDT). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via email or phone on Monday 10 December 2012 and their names published on the MAX website from Tuesday 11 December 2012. The Prizes must be claimed within 14 days of the notification of the Prize winners’ names.
13. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.
GENERAL
14. The Competition is in no way sponsored, endorsed or administered by, or associated with, the Beatles or Twitter.
15. Entry and continued participation in the Competition is dependent on entrants following and acting in accordance with Twitter’s terms of use.
16. Any costs of using and accessing www.maxtv.com.au or Twitter via a mobile phone, tablet or other devices will be dependent on the entrant’s individual mobile and internet service provider. The Promoter is not responsible for any costs associated with any mobile, telephony, internet, or Twitter access and usage. The Promoter is not responsible for any other costs associated or incurred as a result of the entrant’s entry into the Competition.
17. Each photograph by the entrant must be an original work and must not infringe the copyright or any other rights of any third party. Each entrant warrants that:
(a) each entry (including all photographs) is their own original work and not copied in any manner from any other works;
(b) he/she owns all rights and interest in the photograph(s) submitted and have obtained all necessary releases and consents from any other persons appearing in the photo and from the owner of any property photographed to enter the photograph for this Competition in accordance with these Terms & Conditions;
(c) he/she has the full power and capacity to grant the rights and consents set out in these Terms and Conditions; and
(d) he/she will fully indemnify the Promoter against any loss or damages suffered by the Promoter in the event any of the warranties set out in this clause are false.
18. Entrants will retain ownership of copyright in their photograph; however, as a condition of entry, each entrant:
a) agrees that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and videos) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter and/or other agencies associated with this Competition (including but not limited to Pepsi), in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.vmusic.com.au; for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, and royalty-free licence in any such written answers, photographs /images and videos; and
b) consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
In the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed the copyright or any other rights of any third party, that entrant will be disqualified without notice.
19. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof that Prize winner will forfeit the Prize in whole and no substitute will be offered.
20. No responsibility will be taken by the Promoter, MAX, FOXTEL, TELSTRA or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes.
21. The Promoter reserves the right, in its absolute discretion, to disqualify:
a) any entry which, in the opinion of the Promoter, includes any objectionable content,
profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry that is not in
accordance with these terms and conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.
22. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to cancel or vary the Prizes in any circumstances, including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
a) a Prize winner does not satisfy the Competition entry requirements; or
b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
23. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
b) be required to conduct the Competition at any other time.
24. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT at the time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
25. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
26. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter and Pepsi shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.
27. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions.
28. Entrants are advised that “opt-in” entries will be entered into a database. The Promoter may use the entrant’s names, addresses and/or telephone numbers for future promotional, marketing and publicity purposes in any media worldwide and without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants consent to and confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes by the Promoter or wish to update, modify or delete their details should contact the Promoter directly on their details set out below or follow the prompts in the communication to ‘unsubscribe’.
