TERMS AND CONDITIONS OF ENTRY - NANCY GANZ DREAM ESCAPE COMPETITION



1.          Information on how to enter and prizes form part of these terms and conditions of entry. Entry into this competition is deemed to be an acknowledgement and acceptance of these terms and conditions of entry.

2.          Entry is open to residents of Australia aged 18 years and over. Directors or Employees of the promoter or their immediate families, and third parties associated with this competition are not eligible to enter.

3.          Eligible participants can enter by:

(a)        "Liking" and subscribing to Nancy Ganz Facebook Page at http://facebook.com/nancyganz/; and

(b)        Publishing their "Ultimate Escape" in 25 words or less using the "Ultimate Escape" Facebook application; and

(c)        Selecting their "Escape Destination" using the "Ultimate Escape" Facebook application.

4.          Incomplete or unintelligible entries will be deemed invalid and will be excluded. The promoter accepts no responsibility for late, lost or misdirected entries.

5.          The competition commences 14 October 2012 at 9:00 am AEDT and closes 30 November 2012 at 5:00 pm AEDT. The prize winner will be chosen on 30 November 2012 at 5:30 pm AEDT at Gazal Pty Ltd, 3-7 McPherson St, Banksmeadow NSW 2019.

6.          The major prize will be awarded to the entrant who provides the most creative response as determined by the promoter. The twenty (20) runner-up prizes will be awarded to entrants who provide the next most creative responses as determined by the promoter

7.          The promoter's decision is final and no further correspondence will be entered into.

8.          The promoter reserves the right in its sole discretion to disqualify any entrant who appears to have tampered with the entry or voting process, who participates in a manner not in accordance with these terms and conditions of entry or who has, in the opinion of the promoter, engaged in conduct which is or may be fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the promoter.

9.          The winners will be notified in writing and their name will be published online at http://nancyganz.com.au/ on or before 1 December 2012. The promoter might also contact the winner by telephone.

10.       After the winners have claimed his/her prize, the prize will be delivered to the winners by cheque of funds transfer.

11.       There is one (1) major prize to be won, consisting of:

(a)        Two (2) adult economy class return tickets from the entrant's nearest state capital city to the "Escape Destination" chosen by the entrant at clause 3; and

(b)        Seven (7) nights twin share accommodation for two (2) people in a Luxury Accor hotel at the "Escape Destination" chosen by the entrant at clause 3 including transfers to and from the hotel; and

(c)        One (1) voucher to the value of $500 AUD able to be redeemed at http://modelco.com.au/; and

(d)        One (1) voucher to the value of $500 AUD able to be redeemed at http://nancyganz.com.au/.

12.       There are twenty (20) runner-up prizes to be won, each consisting of:

(a)        One (1) voucher to the value of $50 AUD able to be redeemed at http://modelco.com.au/; or

(b)        One (1) voucher to the value of $50 AUD able to be redeemed at http://nancyganz.com.au/.

13.       If the major prize is unclaimed, or unable to be claimed by 1 March 2013 at 5pm, the prize will be awarded to the entrant with the next most creative entry.

14.       Travel using the prize tickets must be completed between 1 May 2013 and 30 September 2013. If the prize winner fails to comply with these conditions for whatever reason, the winner will forfeit the prize in whole and no substitute or cash will be offered in lieu of the prize. Both passengers must travel on the same flights.

15.       All out of pocket expenses, additional or alternate accommodation, spending money, meals, Airport Taxes, insurance, transfers, passports, visas, excess baggage charges, transport to and from the departure point, airport transfers, and all other ancillary costs not otherwise listed are the sole responsibility of the winner. In this clause "Airport Taxes" refers to any taxes and/or other charges imposed by an Australian and/or foreign government department and/or authority on departing or arriving passengers.

16.       The promoter recommends that the winner and their guests take out insurance to cover any travel associated with this prize. The promoter accepts no responsibility for any tax implications that may arise from the winner accepting the prize. Independent advice should be sought.

17.       The prize winner and his/her guests must be 18 years of age at the time of prize redemption.

18.       The prize (and any unused portion of the prize) is not transferable, negotiable or exchangeable.

19.       All entries become the property of the promoter. The collection, use and disclosure of personal information provided in connection with this competition are governed by the National Privacy Principles. 20.       The promoter may use or disclose an entrant's personal information, such as name, address and other information for marketing and consumer research purposes.

21.       By entering this competition, each entrant accepts full responsibility for the decision to participate in the competition and prize should he/she be drawn as the winner. The winner releases the promoter, its related bodies corporate, affiliates, officers, agents, employees, suppliers and Facebook from all liability for any loss and/or damage whatsoever (including but not limited to indirect or consequential loss) or for any personal injury (including but not limited to death) suffered or sustained in connection with the acceptance of, and participation in, the prize or any part thereof, except for liability which can not be excluded by law.

22.       The Promoter acknowledges that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.

23.       If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond the control of the promoter which corrupts or affects the administration security, fairness or integrity or proper conduct of this competition the promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, subject to any written directions of any relevant authorities.

24.       All entrants and guests consent that the promoter may use the entrant's or guests name, likeness, image and/or voice in the event they are a winner (and including photograph, film and any recordings) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and promoting any products manufactured, distributed or supplied by the promoter.

25.       The winner agrees to provide to the promoter photographs, film or recordings of the winner's "Ultimate Escape".

26.       The promoter reserves the right to request the winner to provide proof of identity, age and/or residency at the nominated prize delivery address in order to claim the prize. Identification considered suitable for verification is at the discretion of the promoter. In the event that the winner can not provide suitable proof, the winner will forfeit the prize in whole and no substitute or cash will be offered in lieu.
