CONDITIONS OF ENTRY
 
 
 
1.) By participating in the Promotion, each entrant fully and unconditionally agrees and acknowledges that these Conditions of Entry are binding on the entrant. Information on how to enter and prize details set out in all communications regarding the Promotion form part of the Conditions of Entry.
 
 
 
2.) The Promoter is Elwood Clothing Pty Ltd (ABN 130 793 936 96), 26 St Edmonds Rd Prahran, Vic 3181. Employees of the Promoter and their immediate family members are ineligible to participate in the Promotion.
 
 
 
3.) Entry is open to residents of Australia who are 18 year or older by 30/10/2012, an that have a valid passport. To enter, participants must, during the period commencing on 30/10/2012 at 00.01 (AEST) and ending on 31/12/2012 at 23:59 (AEST) (Promotion Period), go to www.elwood.com.au/coachella and sign up to the Elwood mailing list (providing name, email address, postcode, gender, date of birth mobile phone number and list in 25 words or less "who they want to party with and why atCoachella 2013"). Only one entry per person will be accepted. One entry per person means that entrants may only submit their details online to enter once. Entrants must ensure that all details submitted are accurate.
 
 
 
4.) There is one prize to be won in the Promotion. The prize consists of a trip for the winner and their friend (who also needs to be 18 years or older and with a valid passport) to The Coachella Valley Music and Arts Festival, Indio California U.S.A,  including 2 x return airfares departing from the winner's nearest capital city (Australia) on 11/04/2013 and returning (departing LAX) on 16/04/2013 (RRP $5,000 depending on city of departure), 2 x tickets to attend Coachella Music Festival (RRP $1,400), 5 nights accommodation in a twin share room (RRP $1,500), 2 x $500 Elwood vouchers (RRP $1,000). The total RRP of the prize pool is $8,900. Any flights/travel to the winner's nearest capital city, and all other ancillary costs including but not limited to insurance, travel, transfers, mini-bar, meals and drinks, taxes and any and all other expenses are the sole responsibility of the winner and their choosen friend.
 
 
 
5.) The winner must take the prize on the exact dates specified above and at the flight times determined by Elwood otherwise the prize will be forfeited. The prize is not transferable or redeemable for cash.
 
 
 
6.) The winning entry will be selected based on Elwood's opinion of the best answer to "who do you want to party with and why at Coachella 2013" of the entries submitted during the Promotion Period at the Promoter's premises at 26 St Edmonds Rd Prahran 3181, Australia on 14/01/2013 at 12.00pm [AEST]. The prize winner will be notified by phone and email within two days after the draw by the Promoter using the contact details provided to the Promoter by the entrant during the registration process and the name of the winner will be published on the Elwood Clothing Facebook Page – if the winner gives their permission.
 
 
 
7.) If the initial prize winner does not claim the prize by 14/03/2013 the prize will be forfeited and an unclaimed prize draw will be held on 15/03/2013, at the same time and place as the original draw using the same method as the initial draw. The winner will be notified by email within two days after the re-draw by the Promoter using the contact details provided to the Promoter by the entrant during the registration process and the name of the winner in any unclaimed prize draw will be published on the Elwood Clothing Facebook Page – if the winner gives their permission.
 
 
 
8.) The Promoter reserves the right, and by their entry into the Promotion each entrant consents to the Promoter exercising this right, to validate the authenticity of entries and entrant details.
 
 
 
9.) By signing up to the Elwood mailing list, entrants opt-in to receiving further communications from the Promoter. The entrant's details, which include name, email address, postcode, gender, date of birth mobile phone number will be entered into the Elwood Backstager database and the Promoter may use those details to send future marketing materials to the entrant. Except where prohibited by law, participation in the Promotion constitutes entrant's consent to the storage, use and disclosure of entrants' entry details as set out in these Conditions of Entry.
 
 
 
10.) Information collected pursuant to the Promotion from entrants is subject to the privacy policy of the Promoter, which can be obtained at www.elwood.com.au.
 
 
 
11.) The prize-winner shall accept the prize ‘as is' and acknowledges that the Promoter is not responsible for any variation in the value of the prize.
 
 
 
12.) All decisions of the Promoter in connection with the promotion are final, and no correspondence will be entered into. Except for any applicable statutory guarantees, which cannot be excluded, or warranties and conditions implied by law which cannot be excluded, the Promoter makes no guarantees, representations or warranties, express or implied, regarding the quality or suitability of the prize awarded under these Conditions of Entry. Certain legislation may imply conditions or warranties which cannot be excluded, restricted or modified except to a limited extent.  These include without limitation terms relating to goods being of merchant ability quality or fit for the purpose for which they were supplied. In this event, to the extent permitted by law, the Promoter's liability is limited to, at its option: (i) the replacement of the prize or the supply of an equivalent prize; or (ii) the payment, if it does not contravene any law, of the cost of the replacement or supply.
 
 
 
13.) The prize is subject to the terms and conditions of Coachella Music Festival 2013. The Promoter will not be liable for any loss or damage (including personal injury) suffered or sustained inconnection with the entrant's receipt or use of any part of the prize, except for any damage or loss which is due to the negligence or willful misconduct of the Promoter or which otherwise cannot be excluded by law as referred to above.
 
 
 
14.) The promoter is not liable for the winner missing flights / transportation, coachella concert and accomodation at the proposed dates and times. If the winner misses any of these it will come at their own cost if they choose to re-book.
 
 
 
15.) To the extent permitted by law, the Promoter and its directors, officers, employees and agents shall not be responsible in any way whatsoever in respect of the following: (1) technical failures of any kind; (2) unauthorised human intervention in any part of the entry process of the Promotion, including but not limited to theft, destruction or unauthorised access to the Promotion; (3) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (4) any entry that is late, stolen, damaged or misdirected or otherwise not received.
 
 
 
16.) The Promoter reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond the Promoter's reasonable control adversely affects the Promoter's ability to conduct the Promotion as contemplated in these Conditions of Entry. In such event, the Promoter reserves the right to award the prize to one of the eligible entries received up to the time of the cancellation or modification. The Promoter also reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in breach of these Conditions of Entry or in breach of any law. This is subject to state regulation.
 
 
 
17.) Subject to state regulation, if any prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value.
 
 
 
18.) The Promoter's or an entrant's failure to enforce any term of these Conditions of Entry will not restrict the relevant party from enforcing that or any other provision at a later time.
 
 
 
19.) The Promoter accepts no responsibility for any tax implications that may arise from the winner's receipt of the prize. It is the responsibility of each entrant to seek advice on possible tax implications.
 
 
 
20.) If all or any part of any term or condition contained in these Conditions of Entry is or becomes unenforceable for any reason, the term or condition (or part) shall be deemed severed from these Conditions of Entry to the extent of the unenforceability and the other terms and conditions hereof shall remain in full force and effect as if the relevant term or condition (or part) were not included.
