1. PARTICIPATION
1.1 Information on how to enter and prizes form part of these conditions of entry.
1.2 By participating, entrants agree to be bound by these conditions.
1.3 Entries are limited to one (1) entry per person.
1.4 Entrants warrant that they are entitled to submit their entry and the contents contained therein and that
by doing so there is no infringement of intellectual property rights of any third party.
1.5 Entrants warrant that their entry is original.
1.6 Entrants authorise the Promoter and its associated entities to publish all material contained in an entry
made in connection with this competition and by entering assign all rights whatsoever contained in the
entry itself, including all intellectual property.
1.7 To the extent that there are any claims, lawsuits or allegations in connection with the publication of the
Entrants’ entry, including based on allegations concerning infringement of intellectual property rights,
libel or defamation, the entrant indemnify the Promoter from all costs, fees and expenses associated
with responding to and defending such claims, lawsuits and allegations.
1.8 Entries will not be accepted if they are considered by the Promoter in its absolute discretion: to have
been made outside of the competition period; incomplete, incomprehensible; obscene; pornographic;
libellous; defamatory; threatening; inciting violence; hateful; racially or ethnically offensive; harassing;
tending to incite potentially criminal conduct; tending to incite conduct that may offend; or which result
in allegations of civil liability.
1.9 The Promoter takes no responsibility for ensuring entries are received. Entrants must ensure that
entries are received by the Promoter in accordance with these terms and conditions.
1.10 Entry via the nominated website is free, however all costs of accessing the website are at the sole
responsibility of entrants.
1.11 The Promoter may refuse an entry, if it is considered to have been made using an automated entry
means or by the use of a computer entry service.
1.12 It is the sole responsibility of entrants to ensure that the Promoter has current contact details and
should there be any change, entrants must notify the Promoter.
1.13 An entry made on behalf of a third party or by proxy will be invalid.
2. PROMOTER
The promoter is Quest Serviced Apartments Pty Ltd (ACN 119 523 483) of Level 5, 102 Albert Road, South
Melbourne, Victoria 3205.
3. ELIGIBILITY
Entry is open to residents of Australia aged 18 years or older. Employees and Franchisees of the Promoter
and/or any of their associated or related persons or bodies corporate are ineligible to enter. Insofar as family
members of excluded entities are excluded by this clause, this shall only extend to spouses, de facto
spouses, parents, children and siblings (whether natural or by marriage or adoption).
4. COMPETITION PERIOD
The competition commences at 9:00 (AEDST) on 2 November 2012 and closes at 23.59 (AEDST) on 31
January 2013. Applications for eligibility for the prize received outside these times will not qualify.
5. METHOD OF ENTRY
5.1 During the Competition Period, entrants are invited to complete the online entry form.
5.2 Entrants must include their contact details including their name, email address and phone number in
their entries.
5.3 Entry is limited to one (1) per person.
5.4 All entries become and remain the property of the Promoter.
6. JUDGING
6.1 The competition is a game of skill and is not determined by chance. The entries will be judged
individually according to criteria based around the entertainment value of the entry and marketing
value of the entry. The judges’ decision is final and no correspondence will be entered into.
6.2 Judging will take place from 12:00 (AEDST) on 4 February 2013 at Level 5, 102 Albert Road, South
Melbourne, Victoria 3205 (“the Judgement Date”).7. WINNERS
7.1 The Promoter’s panel of judges will in its sole discretion select three (3) entries. The authors of those
entries shall be nominated Winners and accordingly entitled to be offered one of three (3) available
prizes.
7.2 Within fourteen (14) days of the Judgment Date, Winners will be notified by email or telephone using
details provided to the Promoter by the Winner at the time of entry or subsequently (“the Prize
Notifications”).
7.3 Winners will forfeit their prize(s) if they do not claim their prize(s) as directed in the Prize Notification
within fourteen (14) days of such notification. In this event, a new winner will be selected in the place
of the winner that did not claim the prize(s) and the same process and timeframes as to notification
and claiming prizes will apply.
7.4 The Promoter reserves the right to require production of documentary proof of age, identity, residential
address of winners and any other information relevant to entry into or participation in this competition.
The Promoter may disqualify a winner for failing to produce documentary proof as required within 14
days of a request by the Promoter. Verification is at the discretion of the Promoter, whose decision is
final. The Promoter reserves the right to disqualify any individual who is involved in any way in
interfering or tampering with the conduct of this competition.
8. PRIZES
8.1 Winners will be offered vouchers entitling them each to stay at any Quest Serviced Apartment
business located in Australia for a continuous period of up to three (3) nights in either a studio, onebedroom apartment of two-bedroom apartment.
8.2 The prize vouchers will be valid for twelve (12) months, subject to general availability, subject to blockout periods and may not be used in conjunction with any other offer.
8.3 The total value of the prize pool which includes all three prizes is approximately AU$2000.
9. PRIZE CONDITIONS
9.1 The Promoter does not warrant the merchantability, suitability and/or fitness for purpose of any goods
and/or services awarded as a Prize.
9.2 No other associated costs are included with the prize. The winner is responsible for all other expenses
incurred, including spending money, meals, travel, ancillary costs, breakfast packs, menu, mini bar,
parking, etc.
9.3 The Prizes are not transferable or exchangeable and cannot be redeemed for cash.
9.4 In the event that any Prize becomes unavailable for reasons beyond the Promoter’s control, the
Promoter may substitute a Prize for one of equal or greater value.
10. PRIZE DELIVERY
10.1 The prize vouchers will be delivered to the winners’ supplied email address.
10.2 The Promoter is neither liable nor responsible for lost, stolen or misdirected Prizes.
11. LIMITATION OF LIABILITY
11.1 To the extent permitted by law, all entrants release from, and indemnify the Promoter against all
liability, cost, loss or expense arising out of acceptance of any Prize(s) or participation in the
competition including (but not limited to) loss of income, loss of opportunity, personal injury and
damage to property, whether direct or consequential, foreseeable, due to some negligent act or
omission or otherwise.
11.2 The Promoter reserves the right to cancel, terminate, modify or suspend the competition and these
terms and conditions, for any reason whatsoever, without liability.
12. PERSONAL INFORMATION
The information that entrants provide will be used by the Promoter for the purposes of conducting the
competition and to periodically keep the entrants informed about the goods and services provided by the
Promoter, related entities and its service providers. By entering this competition, entrants consent to the use
of their contract details for the purposes described in this clause.
13. GENERAL
13.1 These terms and conditions are subject to the law of the State of Victoria and solely justiciable in
Victoria.
13.2 These terms and conditions embody the entire terms and conditions between the Entrant and the
Promoter
13.3 The Promoter does not accept any responsibility in respect of any technical malfunction with a
telephone network or line, computer online system server or provide, computer equipment, or
software, or any technical problems or traffic congestion on any computer system or at any website, or
any combination thereof, including but not limited to any damage to participants property related to or
resulting from participation in this competition.13.4 The Promoter does not accept any responsibility in respect of any error, omission, interruption,
deletion, defect, delay in operation or transmission, communication line failure, theft or destruction or
unauthorised access to, or alteration of entries or entrants’ details.
13.5 All entries become the property of the Promoter. All entries will be entered into a database and,
entrant’s names, addresses and telephone numbers may be used for future marketing and publicity
purposes in any media worldwide without notice and without any fee being payable unless otherwise
advised by the entrant. If entrants no longer consent to their details being used for future marketing
purposes, the entrant should contact the Promoter by post to Attention: Marketing, Level 5, 102 Albert
Road, South Melbourne or via telephone to 03 8699 1500.
14. PRIVACY:
Your privacy is important to us. The Promoter is bound by the National Privacy Principles in the Privacy Act
1988. Entrants’ personal information will be collected by or on behalf of the Promoter to enable it to
administer this competition, publicise its Winner, and send entrants marketing information where entrants
have consented. Entrants’ personal information may be disclosed to marketing and communication
agencies, Prize supplies and Prize deliverers in order to conduct this competition. Personal information
about entrants may also be disclosed to the authorities responsible for the regulation of gaming. The
Winner’s name will be published and retained as required by relevant legislation and as specified in these
terms and conditions.
