‘Your chance to win a trip to Abu Dhabi competition’

By entering the ‘Your Chance To Win a trip to Abu Dhabi’ competition, you are agreeing to the following Terms and Conditions:

Information on how to enter this competition and the prize forms part of the Terms and Conditions.
The Promoter is Hill & Knowlton Strategies Pty Ltd T/AS Abu Dhabi Tourism & Culture Authority (TCA Abu Dhabi) (ABN 30 008 401 134), of Level 12, 338 Pitt Street, Sydney NSW 2000.
The competition commences on Tuesday 27th November at 00:01 am AEDST and concludes on Thursday 20th December 2012 at 23:59 AEDST (the ‘Promotion Period’)
The major prize will be judged commencing Friday, 21st December 2012 at 10:00 AEDST at Abu Dhabi Tourism & Culture Authority, Level 12, 338 Pitt Street, Sydney NSW 2000.
Entry is open to all residents of Australia.
Should the winner be under the age of 18 years at the judging date, the winner must be accompanied by a suitable and responsible adult, parent or guardian 18 years and over when they take the prize.
Employees and their immediate families of The Promoter, the prize sponsors and their associated agencies and companies associated with the competition are not eligible to enter.
To be eligible to enter, entrants are required to register and log into their account at www.96hoursinabudhabi.com.au during the Promotion Period, complete their ninety six (96) hour itinerary in Abu Dhabi (which needs to include 4 experiences), provide an answer in 25 words or less, to the promotional question, “Why you would like to visit Abu Dhabi?” and submit the fully completed online entry form.
A limit of one (1) entry per person is permitted. All entries must be received within the Promotion Period.
The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
Incomplete or incomprehensible entries will be deemed invalid.
All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party.  Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.  Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
The major prize comprises:
Two (2) x return coral economy class tickets from Melbourne, Sydney or Brisbane (as applicable) to Abu Dhabi flying with Etihad Airways;
Two (2) x night stay for two (2) people in a Deluxe Mangroves Balcony room at Eastern Mangroves Hotel & Spa by Anantara, including daily breakfast at Ingredients restaurant;
Two (2) x nights in a Deluxe Room at Jumeirah at Etihad Towers,  including breakfast, plus high tea for two (2) in the Observation Deck at 300;
Meet & Assist at Abu Dhabi International Airport;
Return airport transfers;
1 x City Tour; and
1 x Dune Dinner Safari for two (2), which includes guided sand dune drive in 4x4 vehicle to dinner location.
Total prize pool: valued up to AU$5,800 (inc gst).


If the winner does not reside in Melbourne, Sydney or Brisbane, it will be the responsibility of the winner (and their companion) to organise travel to the departure point. Any ancillary costs in doing so will be at the expense of the winner (and their companion).
If for any reason the prize, or any element of the prize, becomes unavailable for any reason, which is out of The Promoter’s control then a similar element to equal value, will be awarded in lieu.
The winner will be responsible for making the necessary arrangements for the prize, as detailed upon winner notification.
The winner and their companion are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding airline and airport taxes) , energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.  Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
During the accommodated stay, any damages and additional expenses not covered unless expressly specified above are the responsibility of the winner and their companion.
The prize must be taken in full by 31 December 2013 and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made.
All prize bookings need to be made at least thirty (30) days prior to travel.
It is the winner’s and their companion’s personal responsibility to ensure that they have valid documentation, including, but not limited to, valid passports and visas, which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and their companion.
Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
Passengers who are unable to make the flight will forfeit the prize tickets.
The winner and their companion may be asked to provide credit card details at the hotel at time of accommodation check in.
During the accommodated stay, any damages and additional expenses such as meals, mini bar, laundry etc are not covered unless specified above.
The winner and their companion may not use ‘Frequent Flyer’ points from any airline on the travel prize and cannot upgrade any travel prize using ‘Frequent Flyer’ points.
In the event that for any reason whatsoever the winner does not take the prize, or an element of the prize, at the time stipulated by The Promoter then the prize, or that element of the prize, will be forfeited by the winner and cash will not be awarded in lieu.
This is a game of skill and chance plays no part in determining the winner.
The most creative and/or original entry as judged by The Promoter will be selected as the winner.
The Promoter reserves the right to request the winner to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of The Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
Should an entrant’s contact details change during the Promotion Period, it is the entrant's responsibility to notify The Promoter. A request to access or modify any information provided in an entry should be directed to The Promoter.
The Promoter’s decision is final and The Promoter will not enter into correspondence regarding the competition result.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of The Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions or who has, in the opinion of The Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or The Promoter. The Promoter reserves the right to disqualify the winner if The Promoter becomes aware that the winner and/or the winner’s entry are of a type described in this clause.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is also a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by The Promoter in its absolute discretion.
Winners much comply with individual prize partner terms and conditions.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders The Promoter’s ability to proceed with the competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, The Promoter may, at its absolute discretion, suspend, modify or cancel the competition, as appropriate.
The Promoter and the prize sponsors shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
The Promoter and its sponsors are not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter, its associated agencies, companies and sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserve the right to take any action that may be available.
Entrants consent to The Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by The Promoter.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, The Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, The Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under The Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by The Promoter) due to any reason beyond the reasonable control of The Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of the prize.
The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to The Promoter. All entries become the property of The Promoter.
If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
