question,"Where you'd like to take your Breezercycle on it's first ride and
why?",in25wordsofless
andsubmitthefullycompletedentryduringthePromotional
Period.AllentriesmustbesubmittedintheEnglishlanguage.
5. ThePromoterreservestheright,atanytime,toverifythevalidityofentriesandentrants
(includinganentrant’sidentity,ageandplaceofresidence)andtodisqualifyanyentrant
whosubmitsandentrythatisnotinaccordancewiththeseTermsandConditionsorwho
tamperswiththeentryprocess.ErrorsandomissionswillbeacceptedatthePromoter’s
discretion.FailurebythePromotertoenforceanyofitsrightsatanystagedoesnot
constituteawaiverofthoserights.
6. Multipleentriespermitted,subjecttothefollowing:(a)eachentrymustbesubstantially
unique;and(b)eachentrymustbesubmittedseparatelyandinaccordancewithentry
requirements.
7. Ifthereisadisputeastotheidentityofanentrant,thePromoterreservestheright,inits
solediscretion,todeterminetheidentityoftheentrant.
8. Thisisagameofskill.Chanceplaysnopartindeterminingthewinner.Eachentrywillbe
individuallyjudged,baseduponliteraryandcreativemeritoftheanswerprovidedtothe
promotionalquestion"Where you'd like to take your Breezercycle on it's first ride
and why?"9. Allentriesmustbetheoriginalcreationoftheentrantandmustnotinfringeuponanythird
party’srights.
10. ThejudgingwilltakeplaceatBacardiLion,Level8,201KentStreet,SydneyNSW2000
11. Thejudgesmayselectadditionalreserveentrieswhichtheydeterminetobethenextbest,
andrecordtheminorder,incaseofanindividualentryorineligibleentrant.
12. Thewinnerwillbenotifiedbyemailorphone.Thewinnerwillbeannouncedaccordingto
entryparticipationattobepre-determineddates.Winnermustrespondwithin48hoursof
notificationorthenextbestentry,asdeterminedbythejudgesandselectedasareserve
winner,willbeawardedtheprize.
13. Thebestvalidentry,asdeterminedbythejudges,willwin aBacardiBreezerbike,valuedat
$350(excludingGST).Intheeventthatanagreementcannotbereached,thePromoterwill
endeavourtofulfilallreasonablerequestsofthewinner.
14. ForthepurposesoftheTermsandConditionsofthisCompetition,shouldthePromoternot
beabletofulfilarequestofthewinner,thePromoterwillcontactthewinnertoagreeona
secondchoice;(d)notreflectingbrandvalues;or(e)dangerous.Thewinneracknowledges
thatthePromotermustadheretogoverningLawsandRegulationsintheacquisitionofall
Prizestothewinner.Theprize,oranyunusedportionoftheprize,isnottransferable,
refundableexchangeableorreplaceableandcannotbetakenascash.Theprizeissubjectto
thestandardtermsandconditionsofindividualprizeandserviceproviders.
15. Ifforanyreasonthewinnerdoesnotaccepttheprize(oranelementoftheprize)bythe
timestipulatedbythePromoter,thentheprize(orthatelementoftheprize)willbe
forfeitedandwillnotberedeemableforcash.
16. Intheeventofwar,terrorism,stateofemergencyordisaster,thePromoterreservesthe
righttocancel,terminate,modifyorsuspendthepromotion,orsuspendormodifyaprize.

18. Anyandallancillarycostsoutsideofthemajorprizeincludingbutnotlimitedtoinsurance,
travel,transfers,accommodation,meals,drinks,taxesandanyandallotherexpenses
howsoeverarisingarethesoleresponsibilityofthewinner.
19. ThePromoterisnotresponsibleorliableforanyloss,damageorinjurysufferedbyany
winnerasaresultoftheconductoftheorganisers.
20. NothingintheseTermsandConditionslimits,excludesormodifiesorpurportstolimit,
excludeormodifythestatutoryconsumerguaranteesasprovidedundertheCompetition
andConsumerAct,aswellasanyotherimpliedwarrantiesunderASICActorsimilar
consumerprotectionlawsintheStateandTerritoriesofAustralia(“Non-Excludable
Guarantees”).Exceptforanyliabilitythatcannotbylawbeexcluded,includingtheNonExcludableGuarantees,thePromoter(includingitsrespectiveofficers,employeesand

24. Thejudges’decisionisfinalandnocorrespondencewillbeentertained.

28. EntrantsconsenttothePromoterusingtheirname,likeness,imageand/orvoiceinthe
