1. Information on how to enter and about prizes form part of these Conditions of Entry. Participating in this promotion is deemed acceptance of these Conditions of Entry.
2. The competition is only open to residents of Australia. Employees and the immediate families of the Promoter and the agencies associated with this promotion are ineligible to enter. The promotion commences on Friday November 30 and closes Wednesday December 12 at 5 pm (“Promotion Period”). All times indicated are either AEST or AEDST as applicable.
3. Entry is by completing the form included in the competition email.
4. The Promoter reserves the right, at any time during or after the closing date of the promotion to verify the validity of entries and to disqualify any entrant who tampers with the entry process or enter multiple times, not in accordance with these Conditions of Entry. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. No responsibility is accepted for late or misdirected entries. Incomplete or incorrect entries will be deemed invalid. Entries are deemed to be received at the time of receipt in the A-List Entertainment Comedy Christmas Super Santa Sack database and NOT at the time of transmission by the entrant.
6. Judging for the prize winner will commence at 9 am on 13th December 2012 at 9 am. The judging will take place at the A-List Entertainment office, 2/432 Parramatta Rd, Petersham on 13th December, with the winner chosen by A-List Entertainment staff members based on creative entry.
7. The prize winner will be notified by email only on 13th December 2012
8. One prize winner will receive the A-List Entertainment Comedy Christmas Super Santa Sack.
9. There will be 1 (one) prize winner with a total prize value of up to $5000. The Promoter accepts no responsibility for any variation in the prize value. Prizes, including any unused portion cannot be exchanged or redeemed for cash or other goods or services. Prizes cannot be transferred to any other person, unless agreed to by the Promoter.
10. The ‘A-List Entertainment Golden Ticket’ does not include the cost of travel associated with attending shows and may not be exchanged for cash. It is valid for one year from January 1st 2013 – December 31st 2013. No exact value can be given for this part of the prize as it is determined by how many shows the winner chooses to attend over the course of the year. As all shows have not been confirmed A-List are unable to give an indication as to how many shows they will be promoting in each city for the year,
11. If for any reason this competition is not capable of running as planned including (but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, war, terrorism or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion subject to state regulations.
12. The Promoter is not responsible for any incorrect or inaccurate information, caused by the website user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the Internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
13. If the major prize is unclaimed by Wednesday March 13 2013, 9 am the Promoter may conduct a further draw at the same place as the original draw as is necessary at Wednesday March 13 2013, 9 am. Unclaimed prize draw winners will be notified by email and the winner of the prize will be contacted by email on Wednesday March 13 2013, 9 am.
14. The prize must be taken as stated. If for any reason a prize winner cannot take a prize or any part of a prize in accordance to these terms and conditions, including at the time specified by the Promoter, the prize will be forfeited and will not be redeemable for cash.
15. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. It is a condition of accepting the A-List Golden Ticket portion of the prize that the winner and their nominated companions to take the prize will, upon request by the Promoter, be required to sign a legal release and indemnity in a form to be determined by the Promoter.
17. The Promoter and event organisers expressly reserve the right to eject any winner (and/or his/her companions) for any inappropriate behavior, including but not limited to intoxication, whilst participating in any element of the prize, or if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any liability incurred by a winner or entrant; or (g) use of a prize.
1.The Promoter may photograph, video and/or film the prize winner at the event or any other activity in connection with the prize. The winner should acknowledge that the Promoter has the right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it sees fit without further permission from or payment to the winner.
19. All entries remain the property of the Promoter. The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
20. Entrants grant the Promoter permission to communicate with them by email and/or telephone in order to provide details of the prize and/or instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
