"DELL XPS12 FLIP YOUR THINKING" PROMOTION

Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 13 years or over. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and their immediate families) of the Promoter agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 3pm AEDST on 11/12/2012 and ends at 3:00pm AEDST on 11/01/2013 (“Promotional Period”).
To enter, entrants must, during the Promotional Period, access the Dell Australia Facebook Page at http://www.facebook.com/DellAustralia, ‘like’ the page or already be a fan of the page. Entrants must then access the Dell Flip Your Thinking Challenge (“Application”), select the “Dell Flip Your Thinking” promotional tile and play the online quiz (“Quiz”).
The Quiz consists of fifty (50) multiple choice questions, as determined by the Promoter. Entrants will commence each question with a score of 1,000 and will have a set time to complete each question dependent on the difficulty level of the question. The score will decrease every millisecond until their score reaches zero (0) or the entrant submits an answer to the question:
a)   if the entrant answers the question correctly: the entrant is awarded the score based on speed (time taken to correctly answer the question); or
b)   if the entrant answers a question incorrectly: no points are awarded for that question, the Quiz is over and the entrant’s total score is calculated; or
c)  if the entrant does not provide an answer to a question during the allocated time: no points are awarded for that question, the Quiz is over and the entrant’s total score is calculated.
For the avoidance of doubt, entrants will only be permitted to continue answering questions in the Quiz if their previous answer to a question was correct
Once an entrant has been given their total score they must follow the Application instructions to submit their score to the leaderboard. Once the entrant has come to the end and the entrant cannot proceed any further in the Quiz, they need to enter their email address in order to successfully submit their score to the leaderboard and finalise their entry into the competition.
Entrants should not rely on information featured on the leaderboard to confirm the winners. The leaderboard may not be a true reflection of the results. All entrants and scores featured on the leaderboard are subject to verification by the Promoter.
The Promoter reserves the right, at any time, to verify the validity of entries, scores and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry or score that is not in accordance with these Terms and Conditions or who tampers with the entry or Quiz scoring process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
Entrants are permitted to attempt to complete the Quiz multiple times, subject to the following: (a) each Quiz must be completed separately and in accordance with entry and Quiz requirements; and (b) each Quiz score must be entered separately and in accordance with entry requirements. For the removal of doubt this means that an entrant can enter the competition multiple times and have multiple scores appearing on the leaderboard should they choose to enter the competition more than once.
At the end of the Promotional Period, only the entrant’s highest Quiz score will be deemed the entrant’s entry into the promotion. For the avoidance of doubt, maximum of one (1) final entry permitted per person.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
This is a game of skill and chance plays no part in determining the winners. The Promoter’s decision is final and no correspondence will be entered into. Winners will be notified by email and announced on the Dell Australia Facebook Page at http://www.facebook.com/DellAustralia within a 2 week period from the close date. Entrants will be notified via email if successful in the competition. It is not a compulsory field to opt in to newsletters in order to be notified of being successful in the competition.
The three (3) entrants with the highest valid Quiz scores at the end of the Promotional Period will be deemed the winners. Prizes will be awarded as follows:
a)  the entrant with the highest valid Quiz score will win: $10,000 cash awarded in the form of an electronic bank transfer; and one (1) Dell XPS12 Ultrabook (valued at RRP AU$1,499 at the start of the promotion).
b)  the next two (2) entrants with the highest valid Quiz scores will each win one (1) Dell XPS12 Ultrabook (valued at RRP AU$1,499 at the start of the promotion).

In the event of a tie between two (2) or more entrants for a prize, the tied entrants will be contacted by the Promoter to answer a promotional question in 25 words or less (the question will be determined by the Promoter in its absolute discretion). The tied entrants must, in accordance with the Promoter’s instructions, respond to the Promoter by the time indicated with their answer to the question. Each response will then be judged based on literary and creative merit and the best response as determined by the judges will be deemed the winner of the prize.
If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
Total prize pool value is AU$14,497.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

Nice prize - but extremely difficult to match the scores that are already up there. You'd have to commit significant time to learn all the correct answers to the 50 questions and then be extremely quick on answering them. I also suspect that like many of the other competitions of this type it is open to being gamed.

Nice prize - but extremely difficult to match the scores that are already up there. You'd have to commit significant time to learn all the correct answers to the 50 questions and then be extremely quick on answering them. I also suspect that like many of the other competitions of this type it is open to being gamed.

Agreed, I've learnt quick response on the first 10, but not sure I want to invest the time and then come fourth and no prize...

I've been at this for an hour or two already and have managed to memorise a good portion of the first 2 sets of questions... and even then I've already lost more "time" than the top few scores on the leaderboard... I honestly don't think their scores are possible

I think it's impossible also. Some questions take longer  to load, even with mega fast internet, then your brain has to analyse the question and then you have to select the correct option! With over 50 questions that has to come to a few seconds!! My daughter said computer buffs can write scripts and slow things down, I don't know but I don't think it's humanly possible to be that quick, even if you are a genius! I got to level 5 and did it heaps of times and could only improve my time marginally

Obviously others are feeling the same. This from Dells FB page:
Samuel Ferguson: Dell why not remove the cheater's times immediately (and block them entering again for good measure) that way honest people actually have an incentive to play. For example I have no idea if the top 3, 5, 10 or 20 people will be removed and hence where the real 1st 2nd and 3rd will actually start, not knowing what is a real score and who has cheated turns me off from even entering the competition to begin with and I just leave your page angry and frustrated - which I would assume is the complete opposite result you are trying to generate with such a promotion?

Dell: Hi Samuel, thanks for sharing your feedback and being part of the game. At the end of the competition and before awarding the final winner, we will be reviewing all data in relation to the top 3 on the leader board to determine whether these have been made via computer automated response or human interaction & based on data collected throughout the duration of the game. Hi eveready, yeah that was me complaining, dell put up a further response to someone else as well, which seems a pretty fair response, even if the approach is not what I'd do.

Julian Cartledge But Dell, the problem with your robotic response in reviewing the first 3 contestants and whether they are computer generated, does not address the fact that these flash programmers and repeated cheats in the gaming world have all sorts of stealth software available to them and all the tools in the book to make you look stupid. If you're aware of this, then i wish you would just do as others have requested and remove the cheats, and also assure us that you have the technology as a 'leader in technology' to do this. I know of 4 repeated gaming cheats in your top 10, and some others there cannot humanly achieve those scores. I've invited you to message me for all the evidence but haven't heard from you! Cheats shouldn't prosper, and unfortunuately do because companies don't want to spend the money on experts to REALLY analyse what's going on.

I do appreciate your point of view. I know you may experience robotic responses with various company interactions but we do try and tailor responses to the individual comment, I personally wrote those responses

We have known about some cheats long before anyone notified us.. its true. As much as we hope for honesty from all participants we have to expect that unfortunately cheats do happen so we have been monitoring day in day out and were prepared for it, we had some wonderful Dell lovers tell us about their concerns which we greatly appreciated. Most people want to do the right thing and we love that.

Back to the cheats - we know who the suspicious entries are, how they are doing it and have watched their patterns of behaviors for a long time. I think you are disappointed they are still on the list, fair point. Think about it this way, why would we remove the cheats when they are, visible, & exactly where we can see them (as the current profile they are using), in other words if we removed them, then they would simply create another profile and come up the ranks and potentially cause further confusion, possibly then track too many different cheats as opposed to a few. It also didn’t make a difference because even if the first 2 are cheats (for example) we would take the next on the board and so on until we award 3 legit & honest participants. Our T&Cs clearly stated winners would be reviewed for this precise reason. Now that, is what's fair for everyone.

This game was about a great way to be part of a Dell competition, a chance to win great prizes, trivia to get the brain buzzing and above all fun! We have loved seeing so many of our fans get involved and it has really setup a great platform for future competitions.

Why can't they just have the quiz but with a random draw for the winners instead of a 'top score' to stamp out the cheats?
