Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.

Entry is open to residents of Australia who have either a valid email address or Australian mobile phone (“Eligible Entrant”). Any entrant who is under the age of 18 years must have their parent or guardian’s permission to enter the promotion. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.

The promotion commences at 12:01am Australian Eastern Daylight Saving Time (“AEDST”) on Friday 28 December 2012 & closes at 11:59 pm AEDST on Thursday 28 February 2013 (“Promotion Period”).

To enter, purchase any specially marked “Live like a Rockstar” DRUMSTICK single cone or multi-pack product (“Promotion Product”) from a participating store. Each Promotional Product will contain an 8 character unique code (“Entry Code”). The Entry Code is located either under the lid of a single cone or on the inside of the multi-pack box. Choose the way you would like to send your entry:

a. Online – go to www.drumstick.com.au find the “Live like a Rockstar” promotion link and follow the prompts to submit your contact details and enter the entry code. (Keep your entry code safe until after the prize draw); or
b. Mobile phone – send an SMS message to 197 77 788 with the 8 character entry code, your first name then family name and your home postcode each separated by a space (e.g. 87654321 space JOHN space CITIZEN space 2001). Note that text entry may not be available from all mobile phone carriers or plans. (Keep your entry code safe until after the major prize draw).

The cost of sending an SMS entry is the responsibility of the entrant and will vary depending on the mobile network used. Total cost of SMS entry is 55 cents including GST. (Entry service is provided by Prime Focus Enterprises Pty Ltd, ABN 55 427 571 651, Support SMS helpline 1800 818 957).

Each entry code may only be used once. The Promoter reserves the absolute discretion to require any prize winner to produce the packaging that has the Entry Code they used for the winning entry in order to claim their prize.

The Promoter reserves the right to require any entrant to provide the entry code for every entry they made during the Promotion Period in order to claim a prize. Further, any winner who entered online may be required by the Promoter to present the entry code from a Promotion Product for every online entry made by their Household, including non-winning entries. The Promoter retains the absolute discretion to require any entrant, (including groups of entrants in the same Household), to provide proof of residency at the Household address shown on their entry before awarding a prize.

The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to the utilisation of techniques designed to avoid payment of call costs or for making multiple entries that are not associated with the separate purchase of a Promotion Product, or for submitting an entry which is not in accordance with these conditions of entry.

All valid entries received during the Promotion Period will be entered in the Major Prize draw, and will also have a chance to win a randomly awarded Minor Prize.

The following prizes will be awarded:

a. Major Prize is $100,000 awarded as the winner’s choice of either a cheque made payable to their name or an electronic fund deposit into their nominated bank account. There is one Major Prize to be won.
b. Minor Prize is a set of Skull Candy headphones valued at up to $49.99 RRP. Colours available include Black, Red, White and Blue which are subject to availability whilst stocks last. The Promoter will not be held responsible if preferred colour is unavailable at the time of prize claim. Minor prizes must be claimed by no later than 5:00pm Australian Eastern Standard Time (“AEST”) on Friday 31 May 2013.

All prize draws will be conducted at Suite 403/62 Beach Street, Port Melbourne, Victoria 3207 as follows:

a. The Major Prize draw will be conducted at 12 noon AEDST on Friday 1 March 2013. The first valid entry drawn will win the Major Prize.
b. Minor Prizes will be randomly awarded during the Promotion Period. There will be a total of 100 minutes randomly identified each day from the start time & date and finish time & date. The first valid entry received after one of those minutes has passed will win one minor prize. Depending upon the method used to enter the competition, each entrant will receive a winning or unsuccessful notification web message or SMS. The winning notification email or SMS will contain a prize claim code and instructions on how to claim the prize. Prize winners can redeem their prize online at www.drumstick.com.au by following the prompts to redeem their prize.

Quality control or printing errors will not invalidate an otherwise valid entry code in the random prize draw and the major prize draw. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all valid prize claims will be honoured. Any unclaimed minor prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw in accordance with clause 20. There will be a maximum of 6,300 minor win notifications sent to valid entrants for this Promotion.

All prize winners will be notified by either email or SMS depending upon the method they used to send their winning entry. The names and postcodes of the Major Prize winners will be published in The Australian on Monday 18 March 2013 and all prize winners’ names and postcodes will appear at www.drumstick.com.au.

Total prize pool is valued at up to $414,937.00 RRP.

Minor prizes are not transferable & cannot be taken as cash, unless otherwise stipulated.

Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes.

The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.

Each entry becomes the property of the Promoter. All details will be held in accordance with the Peters Privacy Policy which can be accessed by visiting www.drumstick.com.au. All claims will be the property of the Promoter. The information claimants provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose claimants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with claimants. By entering this promotion, claimants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotional and marketing purposes regarding the Promoter’s products including contacting the claimant via electronic messaging. By entering this promotion, claimants consent to receiving SMS or email messages from the Promoter that will contain a functional unsubscribe facility to opt out. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Claimants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address below.

Promoter’s decision is final and no correspondence will be entered into.

The Promoter may conduct an unclaimed prize draw at the same time and place as the original draw on Monday 17 June 2013 to distribute any prizes unclaimed by that date subject to any written directions given by a relevant lotteries or gaming authority. The first valid entry drawn will win the unclaimed prize of the highest value and the draw will continue until all unclaimed prizes have been distributed. The winner of any unclaimed major prize will be notified in writing and by phone and have their name and postcode published in The Australian on Monday 8 July 2013 and the name and postcode of any winner of such a draw will also appear at www.drumstick.com.au.

If any major prize winner is under the age of 18 years, the prize will be awarded to the winner's parent/guardian on the winner’s behalf.

Each winner should look to the manufacturer of products and provider or services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.

Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.

By entering the competition and claiming a prize, the major prize winner agrees that the Promoter may use their name, image and photograph/s for publicity, promotion purposes and social media, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.

Prizes will only be delivered in Australia and each winner should allow 28 days from the prize draw for delivery of their prize.

If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.

Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
